      STERNE, DAVID, 8 September, 1691; 2 March, 1691/2.
      In the name of God Amen I David Sterne of the parish of Sitting- borne in the County of. Rapahannock Planter Being sick and weak in body but of pfect mind & memory (thanks be to Almighty God) doe make this my last Will & Testament in manner & forme following.
      First I comend my Soul into the hands of Almighty God hoping through the meritts and mediation of Jesus Christ my Redeemer to have and receive eternal' life And my body to the Earth from whence It came decently to be interred according to the discretion of my Executors hereafter named hoping for a glorious resurrection & reunion with my soul at the last day according to that Article of my Faith Xt
      Item I give & devise unto my Loving Brother Francis Sterne all my Trooping Furniture that is to say Bridle Saddle Pistol's and holsters. Item I give and bequeath unto my Loving Wife Agitha Sterne and my Daughter Frances Sterne by my former Wife And my daughter Ann by my now wife Agitha all those Lands goods Cattels & chattels unto them & their heyres forever to be equally devided amongst them which now I have or shall dye possessed of. Item I give and bequeath unto Sarah Wilden daughter of Jane Wilden one two year old heyfer to be delivered unto her when she shall attain to the age of sixteen years And lastly I doe by this my last will & testament desire Mr: Arthur Spicer & Mr: James Scott to be overseers of this my last Will & Testament hereby revoking annulling and making void all and every former will and wills heretofore by me made to all intents constructions and purposes whatsoever And my desire is that my Overseers herein above named see that my debts be first paid before my Lands and personall Estate be proportioned and divided as above I have willed and ordered In testimony whereof and that this is my last will and Testament I have hereunto set my hand and affixed my Seale this Eight day of September 1691

      - NICHO: SMYTH, as Marrying AGGATHA, Relict & Executrz. of DAVID STERNE, late of this County deced, humbly shewing that the sd DAVID by his last Will &Testament under his hand in Writing duly proved did amongst other things therein conteyned devise & bequeath all his Estate both real & personal in these words, vizt, I give & bequeath all my Estate both Reall & personal! to my loving Wife and my two Daughters equally to be divided between them and that the sd DAVID dying seized of three severall tracts or parcells of land all situate & being in the sd County doth therefore humbly pray that devision or partition may be made thereof according to Quantity & Quality as the Law in such cases directs, Where upon the Court have ordered that JOHN BURKETT, WM: CHAPMAN, WM. PAYNE, GILES MATHEWS or any three of them some time between this & the next Court held for this County do enter upon the Three several! tracts of land and devide the same into three equall parts according to Quantitie & qualitie and that the sd JOHN {sic Nicholas} SMYTH in right of the sd AGGATHA his Wife be possessed of one third part thereof according to the true intent & meaning of the sd last Will

      THIS INDENTURE made the seventh day of Decembr: in the 4th: yeare of the Reigne of our Sovereigne Lord & Lady, King William & Queen Mary An Dom 1692 Between MOSES BARROW of the Parish of SITTENBURN & County of Richmond, Pltnr:, of the one aprt and NICHO: SMYTH of the aforesd. Parish & County, Plantr:, of the other part Witnesseth that the sd MOSES BARROW for diverse good causes hereunto moving but more especially for the sum of Foure thousand pounds of Tobb: to him by the sd NICHO: SMYTH in hand payed, hath demised leased & to farms letten unto the sd NICHO: SMYTH, that is to say, Two hundred acres of land being in the aforesd. Parish & County abutting & bounding as followeth; Beginning at a corner Pock Hickory tree on the land of PETER FOXON and from thence running severall courses into the land of ROGER RICHARDSON, thence running severall courses into the land of Mr. JAMES SCOTT and upon the sd line to proceed until by the running a course away to the aforesd, Corner Pock Hickory tree to fully compleat the aforesd Two hundred acres of land To have and to hold the aforesd. demised premises & every part thereof with all rights belonging unto the aforesd. NICHO: SMYTH or unto his assigns for & during his naturall life, the remainder thereof to AGATHA, his Wife, & to her assigns for & during her naturall life; the remainder thereof after their said several deaths of NICHO: & AGATHA unto ANN, the Daughter of the said AGATHA & DAVID STERNE deced, for & during her naturall life yeilding & paying therefore yearly during the terms or Estate & every or any of them unto the sd MOSES BARROW his heirs or assigns one Eare of Indian Corne and the sd MOSES doth likewise promise & agree with the sd NICHOLAS, AGATHA & ANN their & every of them their heirs & assigns that if the sd MOSES now stands or hereafter he or his heirs shall stand seized of the aforesd. Two hundred acres of land in fee simple to the only proper use & behoofe of him the sd MOSES his heirs or assignes, that then it is the true meaning of this Deed and the sd MOSES doth sell for the consideracon above expressed the aforesd. Two hundred acres of land being as abovesd, unto the sd NICHO: SMYTH his heirs & assigns and for the only proper use of him the sd NICHOLAS his heirs & assigns forever; And the sd MOSES BARROW doth by these pr:sents for himself his heirs agree with the said NICHOLAS SMYTH, AGATHA his Wife and ANN STERNE to warrant & defend the aforesd. above particular Estates and lastly that he the sd MOSES BARROW for the true performance of all & every conditions herein these pr:sents conteyned doth bind himselfe his heirs in the penall sum of Twelve thousand pounds of Tobb: & caske unto the sd NICHO: SMYTH his heirs In Witness whereof the sd MOSES BARROW hath sett his hand & seale this day & yeare first written

      THIS INDENTURE made this third day of March in year One thousand Six hundred ninety & (blank) between NICHO: SMYTH of the Parish of SITTENBURNE in the County of Richmond, Plantr., & AGATHA his Wife of the one part and RICHARD JORDAN of the said Parish and County of the other Dart Witnesseth that Whereas MOSES BARROW late of the Parish &County aforesaid deced, did in his life time by one Indenture of Lease bearing date the Seventh day of December in the Fourth year of Reign of our Sovereign Lord & Lady, King Will & Queen Mary, and in the year of our Lord 1692 for the consideration therein mentioned did demise & to farme lett unto NICHO: SMITH, AGATHA his Wife & ANN her Daughter for their three lives Two hundred acres of land being in the aforesd. Parish and County butting & bounding as in the sd recited Indenture of Lease amongst divers other agrements therein contained more fully may appear. Now this Indenture Witnesseth that the sd NICHO: SMITH & AGATHA his Wife for diverse good causes them hereunto especially moving, as also for an hundred & fifty acres of land, the said Land duly & according to Law to be executed & vested in the sd NICHOLAS SMITH according to an Indenture of Sale thereof made by the said RICHD. JORDAN bearing date the 4th day of March 1694 as by the said Indenture relatiorn being had doth appear, have sold & sett over unto the sd RICHD. JORDAN his heirs & assigns the premisses & land contained in the before recited Indenture of Lease and the same to have & to hold to him his heirs without the disturbance of him said NICHOLAS SMITH & AGATHA they or either of their heirs or assigns.       the aforesaid County, Planter. I do by these presents grant unto the said NICHO: SMYTH his heirs and assigns forever one Tract of Land that is to say One hundred and fifty acres of Land being in the County aforesaid being part of a Devident that did formerly belong t.o JOHN BARROW deced, the said Tract of Land being butted and bounded as followeth; Beginning at a red Oak at the head of the RACE GROUND and extending thence North East being along the line of WM. RICHARDSON and to a Hickory corner tree to the said RICHARDSON, thence along the line of Mr. JAMES SCOTT North West to a double Poplar in the said SCOTis line by a great branch. thence South West to an Hickory, thence North West to a Stake by a white Oa.k in the line of ROWLAND THORNTON, thence South West along the same to a white Oak in the said line being in the clear'd ground of a Plantation belonging to the said THORNTON, thence South East to the first mentioned red Oak together with all houses gardens trees & appurtina.nces. To have and to hold to him the said NICHOLAS SMYTH his heirs and assigns forever, And I the said RICHARD JORDAN and I CISLEY for ourselves our heirs do warrant to defend the said Tract of Land with appurtenances from claims of any persons whatsoever, be the said NICHO: SMITH his heirs paying the yearly Fee Rent due for the same and payable to our Sovereign
      Lord and Lady, the King and Queen, as Cheif Lord and Lady of the Fee. In Witness we have sett our hands and seals
