Matthew Bayne's Will
In the name of God, Amen, the second day of March 1769 I Matthew Bayne of the County of Westmoreland although weak in body yet of sound and perfect mind and memory do constitute make and ordain this my last will and testament in manner and form as follows.
Imprimis, I leave to my loving wife the use of all my whole estate both real and personal within doors and without, during her remaining a widow or otherwise till her death and after her intermarriage or deceased to be disposed of in the following manner and form.
Item I give and bequeath to my son Matthew Bayne my tract of land that I now live on which I purchased of William Bridges, deceased, and my Negro wench Nann and my Negro boy Jessey.
Item I give and bequeath to my son Caron Bayne all my lands that I purchased of the Pope’s and also a tract of land that I purchased of Nathaniel Butler; except that my daughter Sarah Vigour shall live upon the said tract of land that I purchased of Nathaniel Butler during her widowhood; and also my Negro man Great Dick and my Negro wench Jenny.
Item I give and bequeath to my son William Bayne my tract of land I purchased of John Higdon, my Negro man Little Dick and my Negro boy Jesse.
Item I give and bequeath to my son Richard Bayne, Negro boy Charles during his natural life and after his decease to return to his daughter Mary Bayne.
Item I give and bequeath to my son John Bayne, 30 pounds to be paid him by my executors within nine months after my will is recorded and that my son have no more of my estate besides what I have already given him.
Item I give and bequeath to my son Daniel Bayne, Negro boy Jack during his natural life and after his decease to return to his daughter Anne Bayne.
Item I give and bequeath to my son George Bayne, Negro boy Clark.
Item I give and bequeath to my Daughter Sarah Vigour, Negro wench Lucy and her increase during her natural life and after her decease to return to the heirs of William Vigour.
Item I give and bequeath to my daughter Amy Bridges, Negro boy Natt during her natural life and after her life to return to her son Matthew Bridges.
Item I give and devise to my daughter Elizabeth Bayne, Negro boys Toney and Tom.
Item I give and bequeath to my two sons, Matthew Bayne and Caron Bayne in copartnership my still, kettle and worm.
Item my will and desire is that the profits that shall arise from the labour of my slaves after my decease during the time that my wife whall be possessed, shall be soley at her disposal to give to whomsoever she shall think fit.
Item I give and bequeath all the remainder part of my estate not before mentioned to be equally divided between my four children, Matthew Bayne, Caron Bayne, William Bayne and Elizabeth Bayne. And my will and desire is that my daughter Elizabeth Bayne should live and remain in my mansion house as usual till her intermarriage.
Item my will and desire is that if any of the legacies before mentioned in my will should die without an heir then the legacies devised to them should return and be equally divided between my four children, Matthew Bayne, Caron Bayne, William Bayne and Elizabeth Bayne.
I appoint, ordain and constitute my beloved wife Eleanor Bayne, my son Matthew Bayne and my son Caron Bayne to be my executors of this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal the day month and year first above written.

At a court held for Westmoreland County the 28th day of May 1771 this will was proved according to law by the oaths of George Payne and Charles Poor witnesses thereto and ordered to be recorded; and on the motion of Eleanor Bayne, widow and executrix named in the said will who made oath thereto according to law and together with Caron Bayne and Matthew Bayne her securities entered into and acknowledged bond with condition as the law directs, certificate is granted her for obtaining a probate thereof in due form, Matthew Bayne and Caron Bayne the other executors named in the said will personally appeared and refused to take upon themselves the burthen of the execution thereof. Mathew Bayne’s Will
In the name of God Amen, I Mathew Bayne of the County of Westmoreland in Parish of Washington being weak and low in health of body yet of sound sense and memory do make constitute and ordain this my last will and testament.
Imprimis, I give and bequeath all the land whereon I now live together with all the lands that my father purchased of Humphrey Pope, Sr., and Humphrey Pope, Jr., also that small parcel of land adjoining the said lands of Pope’s, which was given to me by my brother John Bayne, to my son William Bayne.
Item I give and bequeath unto my son William Bayne, Negro boy Josua and to receive no other part of my estate.
Item I give and bequeath all the rest of residue of my whole estate to be sold and the money equally divided among my children; Betsey Bayne, John Bayne, Richard Bayne and Martha Bayne, excepting my Negroes, them to be equally divided among my four said children.
Lastly, I appoint my two brothers Richard Bayne and Caron Bayne, also Richard Bayne and my son William Bayne executors of this my last will and testament in witness whereof I have hereunto set my hand and seal this 25th day of December 1795.

At a court held for Westmoreland County the 21st day of April 1797 this will was proved according to law by the oath of Robert Hall, Nathaniel Mothershead and David Annadale the witnesses thereto and ordered to be recorded; and on the motion of Richard Bayne one of the executors herein named who made oath thereto according to law and together with John Bayne and Thomas Yeatman [his securities] entered into and acknowledged bond with condition as the law directs, certificate is granted him for obtaining a probate thereof in due form.
