      IN THE NAME OF GOD, Amen, the twentyeth day of June one thousand seven hundred and Sixteen, I JOHN DUNKIN of Westmoreland County, Planter, being weak in body but in perfect mind and memory. thanks be given to Allmighty God therefore, & calling to mind the mortality of my body and knowing tht is appointed for all men once to dye, doe make and ordain this my Last Will and Testament, that is to say, principally and first of all, I give and recommend my Soul into the hands of God that gave it and my body I recommend to the Earth to be buried in decent Christian burial at the discretion of my Executor. nothing doubting but at the general] day of Resurrecktion I shall receive the same again by the mighty power of God, And touching such worldly Estate wherewith it path pleased God to bless me with in this Life. I give devise and dispose of the same in the folloiwng manner and forme;
      Imprimis. I give and bequeath to my Son, PEETER DUNKIN the track of land which was left to me by the Will of my deceased Father, PEETER DUNKIN, with all my wareing cloathes to him & his heirs for ever.
      Item. I give and bequeath to my Son, WILLIAM DUNKIN, that track of land he now lives on which I bought of JOHN GINKENS for three hundred acres which land I give to my Son. WILLIAM DUNKIN, and the heirs of his body lawfully begotten fo ever, And if in case it shall please God to take my Son, WILLIAM, from this Life without such heirs as is hear mentioned and what I have given him shall redown and fall to my Son, JAMES DUNKIN and his heirs for ever; Allsoe I give to my Son, WILLIAM, all the moveable or parsonal Estate any wise belonging to the said Plantation he now lives on and namely the two pots and iron Skillet I have now in being;
      Item. I give and bequeath to my Daughters, ELIZABETH AN and EALIN one shilling Sterling each of them
      Item. I give and bequeath to my Grand Sons, JOHN and WILLIAM ROCHESTER each of them one sound heiffer a peas
      Item. I give and bequeath to my Daughter, PHILLIS ROCHESTER, my Rideing Horse or Mare which she is please to chose.
      Item. I give and bequeath to my Grand Son and Grand Daughter, JOHN and ELIZABETH DUNKIN, the Son and Daughter of my Son, JAMES DUNKIN, one young heiffer of two years old each of them;
      Item. I give and bequeath all my moveable and personall Estate in any wise belonging to me that I have on the Plantation I now live on except the partes I have allready mentioned and given to be equally devided among my Sons, PETER, WILLIAM and JAMES DUNKIN and allso my beloved Daughter, PHILLIS ROCHESTER, and Grand Son, JOHN DUNKIN, Son of PETER DUNKIN, with all and singular my Right to be devided among them and none others,

      The last will and testament of John Dunkon decd was presented into Court by Peter Dunkon and William Dunkon his executors who made ath thereto, and being proved by the oath of James Scott [Scutt] one of the witnesses thereto is admitted to record. And upon the motion of the sd. Executors and their performing what is usual in such cases certificate is granted them for obtaining a probate thereof in due form. It is ordered Geo. Walker, Elias Davis, Robt Tidwell and William Lane or any three of them being first sworn before a majestrate of the sd County do sometime before the next Court to be held for the County aforesaid value and appraise the Estate of the sd. John Dunkon decd in money and make report thereof to ye said next Court. And it is also ordered that the sheriff do sumon Frances Grace to be and appear at the next Court to be held for the said County in order to effectually prove the will of the afforsaid John Dunken decd she being one of the evidences thereto.

In the Ejectione Finne brought to this Court by Thomas Clay,Lessee of JOHN DUNKAN, Pltf. against WILLIAM REMY admitted Defendant in the stead ofJohn Day for lands and tenements with appurtenances scituate in the Parish of Cople and County aforesaid in the possession of WILLIAM NASH. After severall continuances of the same, the Pltf. and Defendt. at March Court 1714 agreed on the following facts, [vizt] that PETER DUNKAN was possest of the land in dispute in fee; 2ndly that he by his Will in writeing duely proved dated the 9th ofSeptember 1676 devised the same to his Son, WILLIAM, for one hundred acres of land called the "WOODYARD" and willed that if it should please almighty God to take his Sons, MATTHEW, WILLIAM and CHARLES out of this life or either ofthem without heir that then what he had given them in his Will should fall between his Daughters before in his Will named equally which Daughters were ELIZABETH, ANNE, ELLEN and REBECCA as by his Will a true copy whereofis hereunto annexed more at large appeares; 3dly that WILLIAM DUNKAN did depart this life without issue; 4thly that ELIZABETH, ANNE and REBECCA, [ELLEN being dead without issue] entered into the lands by vertue ofthe devise and with their Husbands made sale thereof to the Defendt. and are all since dead every one ofthem leaveing and haveing issue liveing, 5thly that JOHN DUNKAN, Pltfs Lessor is heir at Law to PETER DUNKAN the Testator and the point in question is what Estate the Daughters had in the lands in controversie whether an Estate only for life or an Estate of Inheritance in fee, and submitted the same to the Judgment ofthe Court. Upon consideration whereofthe Court are of opinion that the devise of PETER DUNKAN according to the intent and meaning ofhis Last Will and Testament creates an Estate in fee taile in his Daughters aforementioned and noe other; whereupon at the instance of the Defendt. the suit is ordered to be dismist with costs &c.
