Pages 139-139a. 18 9ber [Nov.] 1672. Instructions for Mr. James Taylor, surveighor of Westmoreland County:
You are to give notice to all the inhabitants of the County of Westmoreland that as soone as the land of the Northerne tract shall be surveighed the Proprietors intend to grant them conveighances of all lands taken up since Michaelmas 1661 uppon the rent of two shillings per hundred acres and under other reasonable conditions and that they shall hold of their Lordships in free and comon sociadge and not by Knight's service or any other tenour or service and that their Lordships expect that all the lands whatsoever in the said county be forthwith surveighed at the charge of all such as claime the lands.
That you first make diligent inquiry and find out where six parcells of land lying uppon the river at some navigable creeke betweene the falls of 10,000 acres in a parcell may be taken up for which noe one paies rent nor hath any legall title and give notice of the same to me to be surveighed to the use of the Proprietors.
That for present in respect to an addresse lately sent to his Majestie by the inhabitants of this tract, you suspend the surveighing of any lands untaken up till his Majestie's pleasure be first knowne, but you may proceed to surveigh any lands in controversy or any lands taken up and in actuall possession for which the claimant payes rent.
That you make diligent inquiry after all lands escheated within the county of Westmoreland since 29 7ber [Sept.] 1663 and what shall heerafter escheate and seize the same to the use of the Proprietors, but if any person pretending title to them shall desire the same they may make composition paying twenty shillings for every hundred acres and the reserved rent.
That you keepe particulars of all plotts of lands, harbours, creekes, swamps, mountaines and all notorious places that soe a generall plott may be made of the County.
That from time to time as occasion requires you give notice of all things further necessary to me that so you may proceede according to there Honors instructions.

THIS INDENTURE made the six and twentieth day of February in the yeare of our Lord according to the computation of the Church of England 1672/3 Betweene WILLIAM BALL the Younger of the County of Rappa (marked out) LANCASTER in the Collony of Virginia and MARGARET his Wife and JOHN ROSIER of the County of WESTMORELAND in the Collony aforesaid and MARY his Wife wch MARGARETT and MARY were Daughters and Coheirs of JAMES WILLIAMSON deceased of the one party and THOMAS KIRTON Gentleman of the County of Rappa of the other part. Whereas Sr. WILLIAM BERKELEY Knt. Governer of Virginia wth consent of Council of State did grant unto MARGARET and MARY WILLIAMSON Coheirs to JAMES WILLIAMSON three hundred and fifty acres of land being on RAPPA RIVER and lying thirty nine miles up the North side of the said River as by Pattent under the seals of this Collony bearing date the first day of May One thousand Six hundred Sixty and five amongst other things doth more at large appear Now These Presents Witnesseth that the said WILLIAM BALL and MARGARET his Wife and the said JOHN ROSIER and MARY his Wife for Ten thousand eight hundred pounds of tobaccoe to them or some of them in hand paide and by these presents granted unto the said THOMAS KIRTON his heirs and assigns forever all that said three hundred and fifty acres of land on the North side of RAPPA RIVER and beginning at a marked white Oake standing on the West side of the mouth of a Creeke & soe running for tenth North East nigh unto the said Creeke unto a marked red Oake including the said quantity of commonly knowne by the name of JACKMANS FOLLY withall and singular its rights and appurtenances together with all houses edifices buildings meadows feeding pastures woods fowling fishings waies easements and appurtenances whatsoever to the said lands or to any parte of them belonging as also all the Estate rights of them the said WILLIAM BALL & MARGARET his Wife and the said JOHN ROSIER & MARY his Wife and all evidences whatsoever touching the premises to have and to hold the said lands and all other premises with every of their Rights unto THOMAS KIRTON his heirs and assigns forever and for themselves and all persons whatsoever lawfully claiming under them shall warrant & defend that it is concluded and agreed betweene the parties that sd THOMAS KIRTON his heirs and assigns may forever enjoy all the before granted premises and kept harmless from all manner of encumbrances In Witness whereof the said (Parties) have hereunto sett their hands and seales the day and year written signed sealed & delivered

THIS INDENTURE made the 20th day of May in the six and twentyeth year of the Reigne of our Sovereign Lord CHARLES the Second over England Scotland France and Ireland King Defender of the faith &c Annoque Dom 1674 Between THOMAS KIRTON of the County of Rappa, Gent of the one part and JOHN HULL of the same County Gent of the other part Witnesseth that the said THOMAS KIRTON for twenty thousand pounds of tobacco in hand paid the receipt whereof said THOMAS KIRTON doth hereby acknowledge doth discharge and grant unto the said JOHN HULL his heirs and assigns forever Three hundred and fifty acres of land formerly granted by Pattent by the Right honble Sr. WILLIAM BERKELEY Knt. Governor and Capt. General! of Virginia unto MARGARET and MARY WILLIAMSON Coheirs to JAMES WILLIAMSON deced as by Pattent under the seals of this Colony bearing date the first day of May 1665, may and doth more at large appear which said land is scituated and being in the North side of RAPPA RIVER and beginneth at a marked red Oake on the Eastermost side of the mouth of a Creeke called WILLING CREEKE and tuning No. Ea. to a marked red Oake and from the first tree for breadth nigh the Maine River side with a marked white Oake standing on the West side of the mouth of a Creeke and so tuning for length No. Ea. nigh unto the said Creek unto a marked red Oake including the said quantity commonly called or known by the name of JACKMANS FOLLY withall and singaler its rights and appurtenances whatsoever withall houses edifices and buildings all woods underwoods fowling fishing profitts and appurtenances whatsoever as alsoe all the estate Right or Demand whatsoever of him the said THOMAS KIRTON to the same all which sd lands with appurtenances were lately sold unto the said THOMAS KIRTEN by WILLIAM BALL JUNR and MARGARET his Wife and JOHN ROSIER and MARY his Wife and to the said MARGARET and MARY granted by Pattent as Coheirs to JAMES WILLIAMSON as aforesaid as by Deed bearing date the 25th of February 1673 under the hands of WILLIAM BALL and MARGARET his Wife and JOHN ROSIER and MARY his Wife may more at large appear to have and to hold the lands and Tenements granted unto the said JOHN HULL his heirs and assignes forever against him the said THOMAS KIRTEN his heirs and all persons lawfully claiming under him and further the said THOMAS KIRTEN doth for himself his heirs promise with said JOHN HULL during the space of seven years next coming upon the request and at the behoof of the said JOHN HULL make and execute further lawfull act as by said JOHN HULL shall be reasonably required soe that the parties bee not compellable to travell further than the Court of Rappahannock or at the General Court at JAMES TOWNE and further it is agreed upon between the parties that the said JOHN HULL shall at all times hereafter as they shall come due paid or cause to be paid all such rents and services as shall be justly due to his sacred majestie As Witness his hand & seal

Robt: Gibbs at the house. of Mr. Jno: Frodsham 10 May next. And the, Court grant order on the report for finall determination of all accounts and claimes betweene them. Ordered that Majr. Isaac Allerton be at the meeting to administer oath if any occasion shall require.

Rich: Lee administrator of Mr. Jno: Lee, there is found due from Mr. Tho: Kirton'who married 'the relict and executrix of Mr. Rich:' Cole 3441 pounds of tobacco and £17 sterling. The Court order that Mr. Tho: Kirton make payment.

Michaell Wilson alias Plowman saith that when he lived with Mr. Tho: Kirton at Machotick he was well acquainted with James Jones alias Virginia James who came often to the house of Mr. Kirton and James acquainted him that Joan Punch was with child by him and that he would take care of her and that he would give a man servant for her and carry her to James River or Accomack and there shee should passe for a widdow; alsoe did nominate the person to whom he would committ her, whose name this deponent hath forgott.

Richard Cock and Phebe his wife say that they being at the house of Mr. Kirton at Machotick were acquainted with Joane Punch, servant to Mr. Kirton, who being in the kittchin, her master came to her and advised her concerneing her worke but Joane made answere shee had noe bussiness there and further said shee would treade her under her feet and takeing up a chaire threw it done and broke it and further say that this wench did give severall such opprobrious languages to her master that she absenting her selfe onely complayned of her hard fortune to have such a servant and Mr. Kirton never returned any passionate language to Joan.

It is ordered that at the next Court all partys concearned in the cause dependinge betweene Mr. John Rice that intermarried with the relict of Mr. Wm: Graves and Mr. Tho: Kirton in a suit depending app'eare at the next 0 Court and that all books and papers then appear or on delinquence, judgment to issue according to order of the Generall Court.
Mr. Tho: Kirton did demand from Mr. Law: Washington 1500 pounds of tobacco due from the estate of Coll. Washington and Mr. Washington produced a bill of 773 pounds of tobacco in discount. Mr. Kirton did in Court make oath that he did deliver to Mr. Law: Washington a bill of 500 in part to pay. The Court doth order that Mr. Law: Washington pay to Mr. Kirton in ballance of acbounts 1237.
