Ct. 1785 p. 112, Ordered that John Wright, Isaac Acre and William Noyal Norsworthy divide and set apart one child's part for Mary Marshall agreeable to the last will of Henry Foote, dec'd.} She was named in the will, this probate record of her father, and then the 1819 Division of Slaves. She was named in division in the Est. of Henry Foote of Negros, in the month of Oct 1785 in Warren County, NC.123 "A share of the Est. of Henry Foote is allotted to Mary Marshall She was named in the Division of Negros between heirs of Henry A. Foote. on 2 Mar 1819 in Warren County, NC."124

      State of North Carolina being of Sound and disposing mind & Memory on
      this 10th day of April 1846 do make and publish this my last will and
      Testament - in manner and form of the following (to Wit)
      Item 1st I will, that all my Just debts and funeral charges be paid-
      Item 2nd I will and bequeath to my Frend (sic) Milton Campbell, my negro
      boy Silas, to him and his heirs forever, In trust that he may at his
      discretion permit and allow my son Theophilus Marshall & his heirs to
      have the use and Labour of the said Boy Silas and if requested by the
      Said Theophilus, to make him a full and complete title to the Said boy,
      provided my said Trustee shall think it best to do so, & my interest in a
      piece of Land secured to me by, J. F. Marshall
      Item 3rd I will and bequeath that what ever prCash I may have at the time
      of my death or whatevery may be due me be equally divided between my son,
      Eleazer & Theophilus Marshall and my Daughters Hetha Stewart & Margaret Marshall.
      Item 4th I desire that my son Theophilus Marshall be executor to this my
      last will & Testament. In Witness whereof I hereunto set my hand and
      Seal this date above written.

      man slaughter of John A. Colclough, who was a 2nd cousin to Richard
      Marshall. According to records John A. Colclough attempted to intervene
      between Richard and his wife, when Richard was beating her, and in the
      struggle, John was killed. In 1860 Lucinda, his wife and children are in
      Monroe County, TN, with brothers of Richard Marshall, and their families.

      "Theophilus Marshall, Aged nearly 92 years, died March 14, 1902,
      Sharpesburg Township, Iredell Co. He was the last survivor of a family
      of 14 children. He was the youngest member of the family, all of whom
      lived to remarkable old ages. Survived by his wife; son, T. M. and R. A.
      Marshall and Daughters, Mrs. Dorcus McLelland and Mrs. Newton Summers.

      He was the uncle of J. W. Marshall of Statesville. Buried at Mountain
      View Church."
