      Memorandum that on the special petition of Thomas Hanson Marshall preferred to the justices of Prince George's County, Maryland on the 4th Tuesday in November in the 2nd year of our Dominion and so forth for a land commission which was issued on December 8, 1773, in these words, to wit, Prince George's County Court, Maryland the right Hon. Henry Hartford, Esq. absolute Lord and proprietary of the province of Maryland; to Messrs Nathaniel Newton, Richard Clagett, Hezekiah Wheeler and Thomas Clagett of PGCo Gentleman, whereas Thomas Hanson Marshall is seized of a tract called "Charley" and preferred his petition in writing to our county court held at Upper Marlborough Town for a commission to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract.       Whereas a commission empowering us to examine evidences to prove the bounds of to prove the bounds of "Charley" we intend to meet on March 15th next. We met at the said tract of land and being on the south side of the road that leads out of Pomonkey Neck to Piscattaway between a plantation of Mrs. Elizabeth Bealls and Susanna Dyar's and near to John Emerson, Jr.'s fence we took the following depositions
      Nathaniel Halley aged 44 years or thereabouts declares about 20 years ago Malcolm McBean showed me a tree and said it was the last or corner tree of Mr. John Beall's land and sometimes after he saw some person surveying and went to them and it was Mr. Hodgkinson's, George Parker and Edward Cole and as they were running out a line Mr. Parker wrote over for Mr. Beall and after some time Mr. Parker and Mr. Beall came together to the place where they and stop then Mr. Beall took Mr. Thomas Marshall aside after some time Mr. Parker was called to them in a little time after they all came to this said tree and went on surveying down to the nex. Sometimes afterwards he was in company with Mr. George Parker riding to Port Tobacco and he asked Mr. Parker what passed between him about the tree and he told me Mr. Beall's reason for not showing him the tree when he first came until he asked Mr. Marshall whether it be of prejudice to him or not and that Mr. Marshall said it would not then Mr. John Beall showed Mr. Parker the said tree and told him it was his last corner tree and further saith not
      Thomas Marshall aged about 59 years declares about 45 years ago he was with Thomas Marshall running from the river the 1st line of "Charley" they stopped and the number of perches were out and Thomas Marshall asked what they should do and William Marshall the deponent's father made answer and said not to go from that place where there was the tree where they begun the 2nd course at which was either red or black oak or near the place that Nathaniel Halley declared it to be above
      William Webster aged about 79 years declares about 30 years ago about 15 yards north east from the above place Mr. John Beall and this deponent were standing at the corner of Beall's fence and by the road and Beall told him he had the road cleared upon the back line of his land and on the outside of said land and they were standing at the corner of the aforesaid fence Mr. Beall told him the fence stood within the line between his brother Marshall and him and this deponent saw several marked trees about 10 or 12 feet without the fence and this deponent asked Mr. Beall what those trees were marked for and he's told him they were his line trees between him and his brother Marshall but did not show or tell him any bounded tree of his the said deals land.
      John Dunn age 68 years or thereabouts declares about 45 years ago there was a bridle path that went near this place he saw a bounded red oak and when he was in company with Duncan Ferguson, Mr. William Marshall or William Dyer he asked what that tree was and one of them told him it was a bound tree of Col. Fendalls but of what land he does not remember
