      THIS INDENTURE made this Twenty ninth day of July in the year of our Lord 249a God one thousand seven hundred and thirty four, Between ISAAC ALLERTON of Cople Parish in Westmorland County, Gent. of one part and ROBERT TIDWELL of the same Parish and County, Planter, of other part; Witnesseth that ISAAC ALLERTON, Gent. in consideration of the sum of five shillings currant money of Virginia to him in hand paid by ROBERT TIDWELL. whereof he doth hereby acknowledge the receipt hath and by these presents cloth bargain and sell unto ROBERT TIDWELL and assigns a certain tract of land with every of their appurtenances containing One hudnred seventy three acres situate in Parish and County aforesaid and on Westward side of MACHOTICK RIVER and within the bounds of a Patent for five hundred acres granted unto ISAAC ALLERTON dated the 28th day of March 1662 and part of two hundred acres given and bequeathed by WILLOUGHBY NEWTON {sic Allerton}, Gent.. late of the aforesaid County, deceased, unto his Daughter, ELIZABETH, as by his Last Will and Testament dated the Sixteenth day of January 1723/4 and was purchased by ISAAC ALLERTON, party to these presents, of MATHEW ZUILL, Gent., who married the aforesaid ELIABETH as by Deed from the said MATHEW ZUILL and ELIZABETH his Wife bearing date the Eleventh day of July 1734 and the said One hundred seventy three acres of land is bounded; Begining at a marked Gum tree standing on North Northwest side of a Cove and corner to a parcel of land purchaed out of the said Patent by WILLIAM ROCHESTER and extending then S. S. E 144 poles to an old black Walnut tree on an Oystershell Point on the side of MACHOTICK RIVER and on the lower side the mouth of a Cove, then up the River and binding therewith the several courses and meanders thereof reduced to a right line S. 16d. W. 216 poles to the Land of CHANDLER AWBREY, thence along his line N. N. W. 160 poles to a marked Pine tree and red Oak sapling corner to the Land of said AWBREY and the Land of WILLIAM ROCHESTER, thence along ROCHESTER's line N. 18d. E. 177 poles to a Ceder Stake, still continueing along said ROCHESTER's line N. 56d. E. 32 poles to a red Oak, thence N. 61d. E. 16 poles to a Pine tree, then N. 26d. E. 9 poles to the begining, To have and to hold the Land with appurtenances unto ROBERT TIDWELL and assigns to the intent that by virtue of these presents and of the Statute for transfering uses into possession ROBERT TIDWELL may be in the actual possession of the land and inabled to take a Release of the same; In Witness whereof the said parties to these presents their hands and seals interchangeably have sett the day and year first above written

      IN THE NAME OF GOD, Amen. I ISAAC ALLERTON of Cople Parish in County of Westmoreland being weak and infirm in body but of perfect sense & memory do constitute and appoint this my Last Will and Testament, viz.
      First. my will is that my just debts be paid out of the profits of my Estate by my Executors hereafter named till my Children come of age, if my said Executors can by any means prevail with my Creditors to stay for there respective debts till such time as my Estate can raise money and tobacco to discharge them, but in case he cannot prevail on them. I impower my said Executors to sell any part of my Lands they shall think fit, enough to discharge and pay off my said Debts with the money or tobacco arising from such sale;
      Item. I give to my Loving Wife, ANN, after my Debts aforesaid are fully discharged. a third part of all my Lands including the Plantation whereon I now live and the use of half of my Negroes and personal Estate during her widowhood, but in case she should marry, that then she have no more of my personal Estate and Negroes than what the Law allows her as her Dower, after the said Debts are paid of,
      Item. I give and bequath all my Lands. Negroes & personal Estate to be equally divided between my three Sons. GOWEN. WILLOUGHBY & ISAAC respect being always had to the quantity and quality of my said lands. and that after such division made. my Eldest Son. GOWEN. to have his first choice: my Son WILLOUGHBY the second and my Son, ISAAC. the last. when they respectively arrive at the age of 21, to them and their heirs forever. But in case any of my said three Sons should die under age and without heir of his body lawfully begotten, then my Will is that such Sons part of my Lands, Negroes and personal Estate be equally divided between my two surviving Sons when they shall come at age, the Eldest to have his choice, and that the said respective dividends be and remain to them and their heirs forever: And whereas my youngest Son, ISAAC. is now weakly & may probably as he grows up want the right use of his limbs, if in case such weakness should continue after he is of full age, and that part of my Estate before bequathed him, should not be sufficient (blank) him maintainance, my request is that my two other Sons be at the charge out of their respective Estates of support him with the common necessaries of life during his natural life. It is likewise my desire that my Executors hereafter named. bring up my Children to Read & Write, that they may be taught arithmetick & Grammer or the Lattin Tongue and such other parts of learning as my Executors shall think them capable of and if any of my Children should be found of a genius or should make any progress in learning that then my Executors or the Guardians of my Children. put them under such persons of whom they may reap profit in the studdy of some of the profession as Law, Phisick or any other branch of learning that suits best with the said Childs genius but should my Executors, find that all or one of my Children should want a genius for learning that then they bind out such Child at the age of fifteen to such Mecanick Trade as the said Child shall make choice off: And in case my Children should the under age without heirs of their bodies lawfully begotten, then I give and bequath half of all my Estate real & personal to be equally divided between my Sister. ELIZABETH QUILLs Children, SARAH & MARGARETT, to them and their heirs forever: and the other half of my Estate real & personal I give and bequath to be equally divided between my Cozens, JOHN BEALE, & his Brothers, CHARLES, TAVINER, RICHARD and REUBEN: to them and their heirs forever:
      Lastly. I appoint my Loving Wife, ANN. my Friends JOHN BUSHROD and DANIEL HORN- BY. Gentlemen. Executors of this my Last Will and Testament. In Testimony whereof I have hereunto sett my hand and seale this 31st day of March Anno Dom 1739
