      Charles County. JOHN ALLIOTT late of Charles County otherwise called JNO. ELLIOTT of Saint Marys County Planter was summoned to answer unto GERRARD NEWTON of a Plea that he render unto him the full & just sum of 400 pounds of good sound merchantable Tobo. in cask and one barrel of Indian corn which to him he oweth & unjustly detains and so forth and whereupon the said Gerrard by WILLIAM HONE his attorney saith that the said John the 27th day July 1700 et St. Marys County that is to Say at Fort Tobacco within the jurisdiction of
      this Court by his certain Bill obligatory which the said Gerrard with the seal of the said John signed bringeth here into Court the date whereof is the day & year aforesaid acknowledged himself to be bound to the said Gerrard in the full & just sum of 400 pounds of good sound merchantable Tobacco and one barrel of Indian corn to be paid conveniently in Saint Clemmons Mannour at or upon the 10th of October then next ensuing the date of said Bill to the which payment well & truly to be made & performed the said John bound himself firmly by the sd Sill Nevertheless the said John altho often required ye sd sum of Four hundred pounds of Tobacco & 1 barrel of Indian Corn to said Gerrard hath not rendered but heath hitherto refused & still doth refuse to the damage of the said Gerrard of 1000 pounds of Tobo. & thereof he bringeth suit.

      At which day he came here as well the said Gerrard Newton as the said John Elliott by his attorneys .. prays to impart the next Court to be held 11th day of November next ..
      At which day here came as well the said Gerrard Newton as the said John Elliott by their attorneys .. James Haddock comes & defendeth .. and saith that he is not informed by Jno,. Elliott of any answer Therefore it is considered Gerrard Newton recover against said Elliott his Debt being 400 pounds Tobacco and one barrel of Indian Corn and damages by occasion of detaining the said Debt to 241 pounds of Tobacco ..
      All which at the request of Gerrard Newton we have caused to be exemplified .. Witness Wm. Dent. Gent, Chief Justice of our said Court at Port Tobacco the 27th day August 1703.
