Will, EDWARD CARTER, THOMAS CHOWNING, WILLIAM THERIOTT and ROBERT NEUSUM are ordered to apprize the saide Estate and were sworne in Cort. An Inventory thereof to bee exhibited to ye nexte Cort,

      TO ALL XPIAN people to whom these presents shall come KNOW YEE that I JAMES YEATES of the County of Rappa. Cooper by and wth the Consent of JOANE his Wife for divers good causes and valluable consideracons him thereunto mooving and more especially for and in consideracon of the sume of Tenn thousand pounds of good Tob: and caske to him in hand paid by GEORGE BAYLY Mercht. wth full and Reall Content and Satisfaccon have bargained and sold unto the said George Bayly his heires three hundred acres of land (be it more or less) lying and being in Rappa. County and on the North side of Rappa. River begining at a marked oake white next and adjoyning to the lands of Mr. TOBY SMYTH decd and runing into the Woods N.E. 529 poles from thence So: E: 244 poles to the land formerly of WILL: MILLS thence So: West to the land of JNO. BURKETT thence up the River N:W: 122 poles uppon the head lyne of the said Burketts land whence by a lyne of marked trees that divides this land and the land of the sd Burkett So: West to the River 264 poles thence up the River No:W: to the first menconed white oake the begining Tree 122 poles To Have and to Hold the said three hundred acres of land be it more or less from him the said James Yeates and Joane his Wife his heires alsoe acknowledge these premises wth Joane his Wife in the Court of Rappa. when thereunto required the said Bayly his heires yeelding paying the Rents and Services from henceforth to be due & of right accustomed. In Wiliness whereof the said James Yeates and Joane his Wife have sett their hands and Seales this 28th of May 1667.

Cooper his heires the sume of Two thousand pounds of good sound merchantable Tobo: and Cske and three able men Servts. Each having foure yeares to serve at or uppon the Tenth day of March next ensuing the date hereof in Rappa. County but if in case that I the said Bayley my heires doe not pay or cause to be paid and delivered the premises in time and place as is above menconed unto the sd Yeates his heires That Then these presents shall oblidge me the aforesd Geo: Bayley my heires to pay or cause to be paid unto the said James Yeates his heires the sum of Tenn thousand pounds of good merchantable Tobo: and Caske conveniently in Rappa.       KNOW ALL MEN by these psents that I JAMES YATES of the County of Rappa firmely bound and indebted unto GEO: BAYLEY of PLIMOUTH in the sum of Twenty thousand pounds of good Tobo! & caske to be paid unto said GEORGE BAYLEY or his certaine Atturney or his heirs to the which paymt. well and truely to be made I bind me my heirs sealed with my seal &dated this Eight day of September one thousand six hundred Seventy.
      The Condicon of this obligation is such that whereas JAMES YEATES by his Deed conveyed unto GEORGE BAYLEY three hundred acres of land as relation thereunto had more at large appears that if ye above bounden JAMES YATES his heirs from time to time & at all times heareafter forever save defend keep harmeless & Indemnified the sd GEO. BAYLIE his heires from all manner of actions suites & pleas of & from all & every pson or psons whatsoever which shall at any time or times hereafter lay any lawful' clayme right title or property to the said three hundred acres of land as conveyed by the said Deed and every pte pcell thereof according to the intents & meanings that then this Prsent obligacon to be void and of none effect or else to stand and Remaine in full power force & vertue

      - Att this Cort WILLIAM THERIOT, Sonne of DOMINICK THERIOT, deced,, for and in consideracon of the quantity of five thousand pounds of tobaccoe and ca. to bee paide by this County out of this yeres Levie convenient in the saide County, and alsoe for the Lande belonginge to this County beinge one hundred acres of Lande more or lesse scituate lying and beinge in the saide County nexte adjoyneing to the Lande of the Widdowe BALLY and of JOSEPH BALEY (deced), which saide Lande this Cart: doe confirme unto hym the saide WM. THERIOT, his heires, executors, administrators and assignes forever, wth. warranty against all p:sons whatsoever; hath given granted aliened bargained solde enfeoffed and confirmed and doth by these pr:sents for hymselfe his heires and assignes and any of them give grant alien bargaine sell enfeoffe and confirme unto the justices of this County and their Successors all that House beinge the now CORT. HOUSE of this County, and commonly called or knowne by the name of this County NEW CORT: HOUSE wth: the Lande whereupon the saide House now standeth as alsoe twenty foote square of ground more adjoyneing to the saide House wth: previledge of free engres, egres and regres to and from the saide House and Lande together alsoe wth, priviledge of grounde sufficient for a PILLORY, WHIPPING POST and STOCKS to stande upon. To have and to hold the saide Lande and pr:misses wth: their appurtenances unto them the saide Justices and their Successors for ever in as large and ample manner and forme to all intents and purposes as are expressed in the Original Pattent of the saide Lande and by the Rents, Services, Pr:viions and condicons therein men- coned and conteyned wth: warranty against all p:sons whatsoever; the saide THERIOT to have Liberty hetweene Cort: and Cort: un till the nexte Spring to make use of the saide House, the Shedd thereunto belonginge only excepted, and that to the same their bee an Outside Doore made.
