      IN THE NAME OF GOD, Amen. I THOMAS MUSE of the County of Westmorld. being well stricken in yeares but of perfect sence and memory & calling to mind the uncertainty of this life, doe prepare make and declare this my Last Will and Testament in manner & forme following; Imprimes. I resigne & recommend my immortal! Soule into the handes of my blessed Saviour and Redeemer Christ Jesus in firme hope & beleiff threw his meritorious death and passion to receive pardon & forgiveness of all my sines and a joyfull resurrection at ye last day to Eternal! Bliss & Happiness, And for whatt worldly Estate God in the abundance of his mercy hath been pleased to allow me, I dispose theireof threw his permission in manner & forme following;
      Item. I give to my loving Wife all her waning apparrell together with her Horse & side sadel;
      Item. I give & bequeath to my Son, CHRISTOPHER MUSE, twenty pounds Sterling to be paid to him by my Exers. immediately after my decease;
      Item. I give to my Son, DANLL. MUSE, my young bay Mare called Spearitt & her futer Encrease to hold to him my sd. Son, DANLL, his heires & assignes for ever;
      Item. I give and bequeath unto my Sons, JAMES and NICHLAS MUSE, to each of them, twelve pence Starling & noe more they being by me allready advanced according to my abillety.
      Item, I give and bequeath to my Daughter ANN TAYLOR, & to my Gran Daughter, MARY GEORGE, one sixth part of the remainding part of my Estate, the which is not allready bequeathed to be equally devided betwene them sheare and sheare alike, to them theire heirs and assignes for ever;
      Item. I give and bequeath to my Frend, BEN JA: WADDY, fifteen shillings to by him a Morning Ring;
      All the rest residew and remainding part of my Estate, my Debts and Funerall expences being paid, I give & devise to be equally devided betweene my Loving Wife, ELIZA: MUSE, & my Son, JOHN MUSE, my Son THOMAS MUSE, my Son CHRISTO: MUSE, my Daughter ELIZA: NUMAN, my Daughter MARY MUSE, and my Son DANLL. MUSE, sheare and sheare alike to be held to them my sd. Wife & Children and to theire heirs and assignes for ever.
      Item. It is my desier that my Son, THOMAS MUSE have the ceare & tuishan of my Son, DANLL and his part of my Estate until! my Son, DANLL. arives to the age of sixteen yeares old, at which age I leave my Son, DANLL. at his one liberty and that he then receave of his Brother my aforementioned Son, THOMAS, his part of my Estate, and I heareby appoint my Son, JOHN MUSE & my Son, THOMAS MUSE, whole & sole Exrs. of this my Last Will & Testament & doe hereby revoke all former and other Wills and Testaments by me att any time maid & I doe declare this and none other to be taken for my Last Will & Testament, In Wittness whereof I have heareunto sett my hand and affixed my Seale this 12th day of March 1729

      Westmorld. ss. At a Court held for the sd. County the 28th day of June 1732
      This Last Will and Testament of THOMAS MUSE, deced, was presented into Court by JOHN MUSE and THOMAS MUSE, his Sons and Executors, who made Oath thereto and being proved by the Oaths of BENJAMIN WADDY and WILLIAM DEBELL, two of the witnesses thereto, admitted to Record; And upon mocon of the said Executors and their performing what is usual in such cases, Certificate is granted them for obtaining a Probate thereof in due form; But ELIZABETH MUSE, the Relict of the said Decedent appeared and in open Court refused to accept of and disannulled such part of the said Will as any ways related to her so far as to debarr her of Dower or Thirds of her said deceased Husband's Estate Test G. TURBERVILE, C. C. W.

      ELIZABETH STURMAN (STEWART) MURPHY md. 3rd. about 1712, Thomas Muse, Sr., whose last wife she was. He was the son of John Muse, Sr. b. Eng., 1633, d. West'd. County, Virginia., 1723.

      In his will dated April 5, 1723: pro. Sept. 25, 1723, he names children: Thomas Muse; dau. Jane Pritchett; dau. Anne Willson; dau. Mary Quesenberry; dau-in-law Anne Muse, wid. of his son John Muse, to whom he leaves his whole estate, with the exception of the legacies to the children named. Beside the son John, dec'd., there was a son Nicholas 1st, also dec'd, who md. Mary, dau. of John Elliott, Sr., and his wife, Sarah Foxall.

      By her marriage to Thomas Muse, Sr., Elizabeth Sturman-Stewart-Murphy had:

      (5) Nicholas Muse, 2nd. b. 1713 or 1714, d. 1778, md. 1st, by Nov. 30 1732, Anne (Cullom) Finch, twice a wid. Her first husband was Mark Cullom, Jr., a great-gr. son of Henry Brookes. Her 2nd husband was John Finch, Sr.
      By Ann, Nicholas Muse 2nd had:
      a. Nicholas Muse 3rd, b. about 1733, d. 1768, unmd. and intestate.
      b. Mary Muse, b. , md. prior to 1760, Thomas Randall, and left issue.
      c. Elizabeth Muse, twin sister to Mary, md. John Washington, who d. 1790, his wife having pre-deceased him. No issue.
      d. Anne Muse, youngest dau., b. before 1745, d. 1816, md. April 3, 1766, Lieut. Thomas Washington, bro. to John above. Left issue.
      Anne (Cullom-Finch) Muse sued her husband for separate maintenence in 1742, but when the case was called, no one appeared. The case was dropped. She was still living with him in 1745.

      The Petition of JOHN STEWART against THOMAS MEWES who intermarried with the Relict of JOHN STEWART, deced. Father of the Petitioner, praying his part ofhis Father's Estate being read and considered it is by and with the request and consent of the parties that AUGUSTINE HIGGINS and LAWRENCE POPE doe some time before the next Court adjust and settle all Accounts relateing to the above affair between both parties and that they make report thereof to the Court
