      Richmond County Court 3d of January 1699/1700
      - THOMAS DEW as Father & Guardian of ELIZABETH & ANN DEW , Complains against CHARLES & LUCY BARBER, Surviving Executr: of WM. BARBER Gent. deced, for that the said WM. BARBER in & by his last Will &Teatamt: duly proved in this Court and dated the 2d day of June in the yeare of our Lord 1699 did give and bequeath unto the said ANN & ELIZABETH and unto each of them. One thousand pounds of tobacco as in & by the said last Will doth appeare; And that the said CHARLES & LUCY in their Quality aforesaid, altho: often thereunto required have & still do refuse to pay the said two thousand pounds of tobacco unto the said ELIZABETH & ANN; Wherefore the Complt: hath brought his suit & craves Judgment. &c, And the Deft. for plea saith my Father hath given unto ELIZABETH DEW one thousand pounds of tobacco wch: tobacco due to any must be for the use of ELIZABETH DEW, the Eldest being at that time two of the named; And the Court being of Judgmt. that the Legacy given in the said Will unto the said ELIZABETH was intended & given unto ELIZABETH, Daughter of the said Testator, & not unto ELIZABETH, his Granddaughter, have granted Judgmt. unto the said THOMAS DEW as Father &c., for One thousand pounds of tobacco the legacy given unto his Daughter, ANN, to be paid wth: costs of suit als Exo.
