      THIS INDENTRE made the Nineteenth and twentieth day of February 1738 Between WILLIAM BEALE gent and HARWAR his Wife of the County of RICHMOND and Parrish of North farnham of the one part and SAMUEL BROOKS of the County of Essex and Parrish of Southfarnham Witnesseth that the said William Beale gent and Harwar his Wife in consideration of the sum of Twenty pounds twelve shillings Currt. money of Virga. doth grant unto the said Samuel Brooke and to his heirs a tract of land in the Parrish of Southfarnham in the County of Essex containing One hundred and three acres it being part of a Patent formerly granted to Mr. THOMAS HARWAR for Six hundred and twenty seven acres dated the 2nd day of September 1682 and bounded Beginning at a new made corner red oak standing in the line formerly called CUPTICES line, and running along the said line South SoWest to another Corner red oak standing in the head of a Valley thence East to a new Corner Maple standing by the run side thence along a new made line South to the beginning every part of said premises are now in the actual possession of the said Samuel Brooke by virtue of Indenture for term of one year and by the Statute for transferring uses into possession ... .

      At a Court held for Essex County at Tappa. on the XX$h day of February MDCCXXXVIII William Beale Gent.and Hatwar his Wife (the said Harwar being first privately examined by PHILIP JONES Gent) acknowledged the Indentures to be their act and deed which are admitted to record.
      KNOW ALL MEN by these presents that wee WILLIAM BEALE and HARWAR his Wife are bound and stand justly indebte to SAMUEL BROOKE in the sum of Forty one pounds four Shillings Currt, money of Virga, this 20th day of Feby. 1738,
      The Condition of the above obligation is such that if William Beale & Hamar his Wife do truly observe all agreements comprized in one pair of Indentures according to the effect of said Indentures touching their several rights and interest in premises comprized and well and truly pay to Samuel Brooke all other cost and dammages which shall or may happen by reason of any actions or suits whatsoever and if said Samuel Brooke shall be excluded or expelled out of any part of the aforesd premises that he or they shall receive of them the sd William Beale Gent & Harwar his Wife their heirs all such sums of money in proportion to the lands so lost according to ye rate first disbursed by the said Samuel Brooke for the same he being further allowed for his Improvements on the same if any then this obligation to be void otherwise to remain in full force.
