      In the name of God Amen I James Daniel of St. Annís Parish in Essex County being in perfect sense and memory praised be Almighty God for the same doe make and Ordain this my Last will and Testament in manner and form following (that is to say) first I give back my Soule into the Merciful hands of my blessed Saviour who gave it me and my boddy to the Earth to be decently buried at the discretion of my Exrx. Hereafter Named & And as for what worldly Estate it hath pleased God to bless me withall I give and dispose of as followeth (Viz) Item my will and desire is that all my Just debts and ffunerall expences be first paide and discharged
      Item I give unto my Loving son James Daniel one hundred and seventy acres of Land whereon he now lives
      Item I give unto my Loving son John Daniel one hundred acres of Land where he has Seated to be laid off with his Plantation
      Item I give unto my loving son William Daniel one hundred acres of Land with the plantation whereon I now live
      Item my desire is that my Deare and loving wife Mary Daniel shall keep all and Singular my personall Estate. I allso appoint my loving wife Mary Daniel Sole Exrx. of this my my Last will and Testament whereof I have hereunto sett my hand and Seale this 7th day of June 1731.

      THE DEPOSITION of JAMES DANIELL aged 30 years or thereabouts sworne saith that RICHD. RHODES was at the House of JOHN SEYMOURE about twelve moneths time to demand a Cow which the sd SEYMOURE had taken from the sd RHODES as the said RHODES said, And the said SEYMOURE denied the sd Cow, And the sd RHODES said what made ye buy ye Bull of me which came of ye Cow and further saith not.

      KNOW ALL MEN by these presents that I ROBERT PAYNE of ye County of Essex Gent. doe for a valuable consideration of Two thousand five hundred pounds of lawful tobacco to me in hand paid hereof sell alienate & make sure from me & my heires unto JAMES DANIELL of ye sd County of Essex, Planter, and to his heirs fore ver ye full quantity of One hundred acres of land being in ye sd County of Essex on ye South side of Rappa: River back in ye woods on ye branches of LUCAS his Creeke, beginning at a marked white Oake corner tree of ye land that I sold to JOHN DOORES, and NNW to a white Oake corner tree to ye land of JOHN HACKLEY extending thence East to a marked red Oake by ye beginning of JOHN HACKLEYs land, thence SSE to a marked red Oake sapling corner tree of JOHN DOORS his Land, thence West to ye first mentioned station, I ye sd ROBERT PAYNE do warrant ye One hundred acres of land unto ye sd JAMES DANIELL and to his heires & assignes forever, To have and to hold and peaceably to enjoye with out molestation & incumbrance of ye sd ROBERT PAYNE & my heires & all other persons that shall lay claime to any part thereof with ye profits & priviledges thereunto belonging forever. Witness my hand and seale this 23 day of February 1694

      THIS INDENTURE made the Nineteenth day of March in the year one thousand seven hundred and thirty eight Between JOHN HART of CAROLINE COUNTY of one part and DAVID PITTS of Essex County of other part Witnesseth that he the said JOHN HART for the sum of twenty and three pounds current money by said DAVID PITTS paid he the said JOHN HART hath sold unto said DAVID PITTS his heirs and assigns for ever one parcel of land being in ye aforesaid County of Essex and containing just one hundred acres of land (the said one hundred acres of land was formerly purchased of ROBERT PAINE by WILLIAM HART Uncle to the said JOHN HART party to these presents) and bounded beginning at a red oak Corner tree of ye land of JOB SPEARMAN thence with SPEARMANs line South West to a red oak Corner tree to said JOB SPEARMAN and JAMES DANIELs land and thence with a line of marked trees South East to a stake, thence with a line of marked trees North to an old marked white oak Corner tree to the land of JOHN HARRISON and thence with said HARRISONs line and the line of the said JOB SPEARMANs land North East to the first mentioned Corner trees. The said Land to Have and To hold to him the said DAVID PITTS behoof of him his heirs and assigns forever. In Witness whereof the parties have set their hands and seals . . . .
