      TO ALL MEN to whom these presents come I THOMAS PAINE in the County of Rappahanock Planter for the sume of Nine thousand two hundred weight of Bright & large Tobacco & Cask of my own crop without any trash or Cast Tobacco to me in hand paid by THOMAS BOWLER Merchant at and before the sealing and deliverey do sell and sett over unto the sd THOMAS BOWLER and Company their Admrs. or assignes all my plantacon and Land thereunto belonging being in the County of Rappa. and now in the tenure and occupation of me the sd THOMAS PAINE together withall houses buildings or Orchards and all other the prmses there belonging to have and to hold the sd Land and plantacon with the appurtenances by these presents granted unto the said THOMAS BOWLER and Company for and during the terme of One thousand years fully to be compleated paying therefore yearly unto the said THOMAS PAINE his heirs and assignes one peper come at the Feast of St. Michael the Arch Angill if it shall be lawfully demanded and I the said THOMAS PAINE for my heirs and Admrs. do agree with the said THOMAS BOWLER and Company at all times hereafter during the sd Term quietly enjoy the said premises withal! appertaining without lets or incumbrances and I do further make and sell unto the sd BOWLER & Company their heirs or assignes three men Servants with one negro named ---ONLY, the other two English THOMAS GREEN and JAMES JOHNSON and to enjoy them for the term of years they have to serve Provided Always and on this condition that I the sd THOMAS PAINE or my assignes do truly pay unto the said BOWLER and Company or their assignes the lust quantity of Tobacco (missing) without fraud or deceit that then this Tobacco to be paid the 10th of Nber next ensuing and this bond to be void and of none effect or else to stand in full force and virtue in presence of us this 14th of February 1662

Merchant do grant and sett over unto the said THOMAS BOWLER & Company my right of Seven negros now in my possession being named as foll: Symon, James, Robin, Joane, Kate, Agare and Betty to hold the sd negroes granted & sould unto THOMAS BOWLER and Company during the terme of their lives the sd Seven negros being bought of THOMAS BOWLER aforesd and also I the said SAMUELL GRIFFIN for me my heirs do agree with the said THOMAS BOWLER and Company their Executors and assignes that the sd THOMAS BOWLER and Company may at all times hereafter have and enjoy the said premises by these presents granted without the denyall of me the said SAMUELL GRIFFIN my heirs or assignes or any other person PROVIDED Always and upon this Condition nevertheless that I the sd SAMUELL GRIFFIN shall truly pay unto sd THOMAS BOWLER and Company the just quantity of Twenty seven thousand three hundred pounds of good sound Merchantable tobacco and cask deer of ground and bad leaves of my crop upon the tenth of December next without any deceit that then these presents and everything conteined shall cease and of noe effect I do here promise to acknowledge the premises aforesaid either at the sd County Court or before Govr. and Councell In Witness I have sett my hand and seal this 13th day of Aprill 1663

PROSSER Planter of one pty and JOHN WEIGHT Planter of the other pty both of the Pish of Sittingbourne in the County of Rappa. in Virginia the first day of Apr11. in the 20th yeare of the Reigne of or. Soveraigne Lord CHARLES the Second by the Grace of God of England Scotland France and Ireland King Defender of the faith &c. Anno Dom 1668. Whereas the sd JOHN PROSSER and JOHN WAIGHT doe hold Seaventeene hundred acres of land in Copntship scituate lying and being in the County of Rappa. be the same more or less and are now each seated uppon pte thereof as by two sevrll. instrumts Wrighting remayning uppon Record both taken in the name of the sd JNO. PROSSER and acknowledged in the County Court of Rappa, aforesd more at large appeareth Now it is Covenanted and agreed by and Betweene the sd ptyes to these pnts and the sd JOHN PROSSER in pursuance of the sd two Deeds of Bargaine & Sale Both hereby for himselfe his heires grant and agree to and with the sd JOHN WEIGHT his heires and to and wth every of them by these pnts that he the sd JNO. WEIGHT his heires shall or lawfully may quietly and peaceably have hold occupy possess and en ioy Eight hundred and fifty acres being the Moyety the one full halfe pte of the aforesd 1700 acres in manner and forme according to the Bounds & Divisions herein menconed and expressed that is to say as for touching and conerning the plantation cleare ground and Housing the Moyety of the same to be held and enjoyed by the sd JOHN WEIGHT his heires as formerly they have ben enjoyed by the said JOHN WEIGHT and as they are now divided by bounds & stakes and also the free use of all Springs of Water in or uppon the sd plantation to him the sd JOHN WEIGHT his heires for ever and as touching and concerning the Residue of the sd land as yet not cleared the sd JNO. WEIGHT to hold and enjoy the moyety or his share thereof as Followeth ViZt, all that pcell of land Begining at a marked white (lake standing by the sunken ground neare the hogg house thence by a direct Lyne of stakes to the water slash and from thence to the Cornefield fence and along the sd Fence to a marked pocickry standing by a swamp side thence by a line of trees to a So. West lyne standing wth out the Calfe Pasture fence their to a great pocickry stump and from thence to the Po: white Oake where it begann and also one other pcell of land begining at a Red Oake standing uppon the lyne of marked trees Dividing the land of the sd JNO PROSSER and the Land of Mr. JNO. PAYNE SENR. thence So: E. 60 poles thence No: E. to the River and up the sd River to the land of the sd JOHN PAYNE and along the sd JOHN PAYNEs lyne to the sd marked red Oake where it Began and alsoe all that pcell of land begining uppo.n the GOLDEN VALE CREEKE next the land of ROGER RICHARDSON and runing along the sd ROGERs lynes according to the sevrll, courses of the same to the first No. West and alonge the sd lyne to a marked Gum and from the sd Gumm No: E. to a marked pocikry neare the Runn and Downe the Runn to another markt tree thence E, No. E. till it comes to the maine Creeke thence dowse the sd Creeke to the place where it begun according to a platt formerly drawne and surveyed by CAPT. ALEXR. FLEMING to the only use and behoofe of him the sd JOHN WEIGHT his heirs and assignes for Evermore wthout any the lett suit trouble evicion Denyall Molestacon or Incumbrance of him the sd JOHN PROSSER and the sd JOHN PROSSER doth hereby for himselfe his heirs covenant pmise grant and agree toand wth the sd JOHN WEIGHT his heires that he the sd JNO. WEIGHT his heires shall have from time to time and at all times hereafter equal! privilidge wth the sd JOHN PROSSER his heires of Range for Stock and hunting fishing and fowling wth outletts and inletts in all or any pte of the pmises and the sd JOHN PROSSER or his heires shall not sell any pte or pcell of the plantacon or housing whereon he now inhabiteth or any of the land by the River side until! the sd JNO. WEIGHT or his heirs shall first have had the refusal! thereof who shall alsoe be abated the Sixth pte of the price another will give for the same and the sd JOHN WEIGHT for him his heires doth covenant pmise grant and agree to and wth the sd JNO. PROSSER his heirs that he the sd JOHN WEIGHT his heires shall not bargaine or sell any pte or pcell of the plantacon or housing where he now inhabiteth or any of the Land by the River side until! the sd JNO. PROSSER or his heires shall have first had the refusall thereof who shall also be abated the sixth pte of what another will freely give for the same and lastly the sd JNO. PROSSER his heirs and Successors shall have Equall privilidge wth the sd JOHN WEIGHT and his heires of Range for stocks and hunting fishing and fowling wth outletts and inletts in all or any parte of the prmises together wth the use and Benefitt of all Springs of water of in or tothe same or any parte thereof belonging or in any wise apperteyning.
