      WHEREAS WILLIAM DAVIS of the County of Rappa and Parrish of Farnham did purchase a certain parcell of land of one WILLIAM EVES and the said WILLIAM EVES of one JOHN DEYOUNG as by the severall Deeds of Sale by records of the abovesd County Court will appear and since that time by Deed of Copartnership is wholly in the right of the said WILLIAM DAVIS and one ROBERT WALKER and Whereas the said JOHN DEYOUNG was another and thereby the title of the said land by the said DAVIS and WALKER suspected to rest on me THOMAS FRESHWATER severall reasons to themselves best known they doe suspect now Know ye first I the said THOMAS FRESHWATER doc oblige myself my heirs administrators that the sd DAVIS and WALKER shall
      at all times hereafter quietly hold and enjoy the abovesd land and every part thereof to them their heirs without the trouble of me the said THOS. DAVIS as also for and in consideration of another tract of land in Exchange by sd WM. DAVIS assured unto sd THO: LEWIS and his heirs wherewith sd THOMAS LEWIS doth hereby acknowledge have granted unto WM. Between THOMAS FRESHWATER of Rappa in the Dominion of Virginia of one part and WILLIAM DAVIS of Parish and County aforesd., Plantr., on the other part Wittnesseth that JOHN FRESHWATER for the full sum of Twenty thousand pounds of Tobb: and merchantable in good order paid by sd WILLIAM DAVIS have given and sold unto WILLIAM DAVIS his heirs and assigns One thousand acres of land and lying and being in the FOREST between POTOMACK & RAPPA RIVERs part in Rappa. County and part in WESTMORELAND COUNTY being part of a Patent given to RICHD. WEBLEY, ROBT. DAVIS and THOMAS FRESHWATER fallen to sd THOMAS who survived the sd WEBLY and DAVIS so that the right of sd Patent being Seven thousand two hundred Seventy & one acres dated the 24th day of August 1664 did vest in & fall to the sd FRESHWATER in Survivorship the sd One thousand acres of land begining at a red Oake tree of another parcell of land sold out of the Patent to Colo. SHOARES then S. W. along the line of sd SHOARES to a Stake by a Hickory corner tree W. along another line of sd SHORES to a Stake by a Hickory tree then N. along another of sd SHOARES to a red Oake sd line then S. W. to a red Oake corner tree standing by the side of the MARSHEY SWAMP on the Westward branch of TOTASKEY then up the water courses the sd Swamp with its severall courses to the begining corner tree and also all houses orchards gardings and enclosures together with all profitts unto sd One thousand acres of land as also all the rights To have and to hold sd One thousand acres of land and all the premises and every rights unto the sd WM. RIVER it being part of a Tract of Land belonging to Majr: JOHN WEIRE beginning at three trees (vizt) a red, a white & spanish Oake twenty perches distant from a Stake in a WHITE MARSH and extending thence alonge a line of marked trees belonging to WILLIAM DAVIS, West Southerly to a corner tree of WM: DAVIS standing in a deep valley, thence South East to a small white Oake standing in a great branch, thence East Northerly to a Hickory tree in the line of the maine Divident, thence Westerly to the first menconed station; conteyning & layed out for One hundred acres of land be it more or less with all its rights together with all houses buildings barnes stables orchards gardens yards back sides meadows woods & appurtenances whatsoever to sd land belonging; To have & to hold the said land & all the pr:mises unto the said JAMES SHIPPIE his heirs & assignes forever, And that the said JAMES SHIPPIE his heirs & assignes shall by force of these pr:sents at all times forever hereafter lawfully hold the said land and all the before granted pr:mises & kept harmless by the sd ELIZA.
