      TALIAFERRO, FRANCIS, Spotsylvania, d. Feb. 23, 1756, p. Mar. 7, 1758. Wit. James Tutt, John Waller; Humphrey Brooke, Richard Tutt, Junr. Ex. sons, Lawrence, Hay, Francis and John Taliaferro.
      Leg. daughter, Anne Hay Brooke, land and plantation in Spotsylvania, whereon she now lives, which I purchased of Thomas Turner, of King George County, Gentl. and Thomas Turner and Mary his wife, late of Spotsylvania;
      daughter Elizabeth Taliaferro, 1,000 acres of land in Orange County, formerly Spotsylvania, granted to me by my deced. brother, John Taliaferro, by patent dated Sept. 28, 1728;
      son, Lawrence Taliaferro, all my estate, both real and personal, in Caroline County, also 1,200 acres of land and two plantations in Orange County, it being one moiety of 2,400 acres taken up by my father, Lawrence Taliaferro, and my uncle, John Taliaferro, and adjoining the land where William Taliaferro now lives;
      son Hay Taliaferro, estate in King George County, and 2,000 acres of land in Orange County, 1,000 acres thereof purchased by my now deced. brother, John Taliaferro, of Richard and William Taliaferro, and the other 1,000 acres purchased by me of Thomas Smith;
      son Francis Taliaferro, land and plantation whereon I now live in Spotsylvania, and to hold the same according to the division made between me and my brother John Taliaferro, deced. also 1,000 acres of land in Orange County, it being one moiety of land which was patented by my brother John Taliaferro, deced. and divided between us;
      son, John Taliaferro, my land and plantation in Spotsylvania, whereon my brother, John Taliaferro lived, also 1,000 acres of land in Orange County, being the other moiety of the aforesaid mentioned 2,000 acres, and is that part whereon Nicholas Christopher lived; brother, William Taliaferro; Elizabeth and Anne Battaley, the two daughters of my friend Moseley Battaley.
      Codicil to the above dated Feb. 25, 1757, witnessed by Robert Jackson, John Catlett and Thomas Catlett, recites "the testator of this will hath disposed of some estate in his possession belonging to my brother William Taliaferro (which I claim as heir apparent to him) to several of my children, he the said William being found an idiot by a jury convened for that purpose summoned and sworn and their report recorded among the records of Spotsylvania Co. Court." (Page 343)

      iii. Hay Taliaferro was born 17 Mar 1739 in Orange County, Virginia., and died 1825. He married Lucy Mary Taliaferro, daughter of William Taliaferro Col. and Mary Battaile. She was born 13 Dec 1755.

      In the name of God Amen, HUMPHREY BROOKE being very sick and weak but of perfect sence and memory do contstitute and ordain this my last Will and Testament .. Imprimis I recommend my soul to almighty God .. my body to the Earth to be decently buried by my Executor hereafter named .. after the payment of my Just debts and Funeral expences I dispose thereof as followeth Yizt. Imprimis I give and bequeath unto my loving Brother RICHARD BROOKE and his heirs forever all my land in Culpeper County and all my other Estate both real and personal whereever it may be found to him and his heirs forever.
      Item my will is that my loving Brother Richard Brooke be my Executor of this my last Will and Testament. In witness whereof I have set my hand and seal this Eleventh day of May 1758. Presence: HAY TALIAFERRO, Humphrey Brooke

      This last Will and Testament of Humphrey Brooke Decd was exhibited to the Court by Richard Brooke the only Executor therein named and was partly proved by the oath of Hay Taliaferro one of the Witnesses thereto and ordered to be certified And at a Court continued and held for the same County on Friday the 18th day of March 1763 the said Will was fully proved by the oath of Elilzabeth Taliaferro a witness thereto and ordered to be recorded and on the motion of the said Executor Certificate is granted him for obtaining a Probat thereof in due form he having sworn
      to the same and given Bond and Security according to Law and it is ordered that Robert Brooke Gent. Brother and heir at law of the said Decedent be summoned to contest the validity of the said Will if to him seems expedient.

      HIS INDENTURE made this fifth day of November in the year of our Lord 1776 Between HAY TALIAFERRO of ORANGE and Colony of Virginia, Gent., and MARTHA his Wife of one part and JOHN TALIAFERRO of County of King George and Colony aforesaid of other part. Whereas FRANCIS TALIAFERRO, Gent.. deced., late of the County of SPOTSYLVANIA being in his life time and at the time of his death seised in his demense as of fee simple in a certain tract of land lying on RAPPAHANNOCK RIVER near MORTONS WAREHOUSE in the County of King George; and FRANCIS TALIAFERRO being of the said tract of land so as aforesaid seised did by his Last Will and Testament in Writing dated the xxv day of February in the year of our Lord MDCCLVII give and bequeath the tract of land unto said HAY TALIAFERRO in fee simple as by the said Last Will and Testament of Record in the Court of County of SPOTSYLVANIA may more fully appear; And Whereas HAY TALIAFERRO did also purchase to himself and his heirs in fee simple one tract of land containing by estimation one hundred acres situate in County of King George and commonly called by the name of HACKLEYS FERRY from a certain JUDITH HACKLEY. Widow and Executrix of the Last Will and Testament of JOHN HACKLEY, deceased. to wh ich said JUDITH power and authority to sell the land last above mentioned were given in and by the Last Will and Testament of JOHN HACKLEY but the Deeds of Lease and Release from said JUDITH unto said HAY bearing date the Lease the eighth day of June in the year of our Lord MDCCLXIII and the Release the ninth day of July in the same year being recorded by mistake in the Court of the County of CULPEPER, said HAY TALIAFERRO did procure a confirmation of his title in and to the last above mentioned tract of land from JAMES HACKLEY, Son and Heir at Law of the said JOHN HACKLEY by Deed bearing date the six day of June MDCLXXIV as in and by the same now of record in the Court of the County of King George may fully appear, NOW THIS INDENTURE WITNESSETH that HAY TALIAFERRO and MARTHA his Wife for sum of One thousand and five hundred pounds current money of Virginia by JOHN TALIAFERRU to HAY TALIAFERRO in hand paid. by these present Indenture do bargain and sell unto JOHN TALIAFERRO and his heirs the aforesaid tracts of land, viz, as well the tract of land devised by FRANCIS TALIAFERRO unto HAY TALIAFERRO as that tract of land purchased by said HAY of and from JUDITH HACKLEY together with all their rights members and appurtenances; To have and to hold the tracts of land unto JOHN TALIAFERRO and his heirs discharged and acquitted of all manner of Rents charges and incumbrances except the annual Quit Rents reserved and payable to the Lord Proprietor of the Northern Neck of Virginia, And HAY TALIAFERRO for the consideration herein before mentioned & his heirs the tracts of land unto JOHN TALIAFERRO his heirs shall warrant and will by these presents Indenture warrant and for ever defend; In Testimony whereof the said HAY TALIAFERRO and MARTHA his Wife have hereunto set their hands and affixed their seals the day and year first above written
