      Tyrrell Knight an orphant who was by order of this Court placed with John Butler, deceased, and his widdow and executrix desiringe to be releast from the trust of the orphant, the Court order that John Jones shall have the tutorage of Knight and trust of his estate. And Capt. Jno. Lord and Mr. Wm. Bridges doe assume with Jones in the summ of 20,000 pounds of tobacco for the true performance of the trust.

      Sarah Butler's husband John Butler was in his lifetime legally possest of the person and estate of Tyrrell Knight, orphant, by order of this Court' and at the last' Court upon a mistake Tyrrell Knight was by order of this Court removed from the tutorage of the petitioner to John Jones. Your petitioner is ready to continew the security already given by her husband or to give such new security as the Court shall accept and performe such orders as the Court shall please to thinke requisite for the advantage of the orphant. She humbly prays that Tyrrell Knight with his estate may be continewed in her gardianshipp as formerly in her husband's time, about which petition the justices in opinion were devided soe that nothinge could be ordered.

      Upon'petition of Mrs. Sarah Butler the last will, of John Butler is proved by John Jones, Elizabeth Pope and Charles Baldridge and administiiation of the estate with the will annext comitted to Sarah Butler, the relict and executrix of John. It is further ordered that on 2 August next John Questenbury, Alexandr Gallant and John Jones take a true inventory of the estate of John Butler and apprayse the same. John Jones and Alexandr. Webster doe assume with Sarah Butler in 30,000 pounds of. tobacco for the true performance of the contents of the will.

      528. JOHN JONES of Westmoreland County complaineth against GEORGE KING of this County for that he the said George King on or about the 16th of January last past did take up and ride a horse of your Petrs without the licence leave or consent of your Petr for his so doeing and the said horse hath soe abused that he is not Serviceable to your Petr whereby he is damnified and hath damage to the value of Four thousand pounds of Tobacco Wherefore he bath brought his action against George King .. George King by RICHARD GIBSON his attorney came into Court and pleaded to the declaration laid against him not guilty and for Tryal puts himself upon the Country and the Plt likewise. Therefore tis ordered that the Jury Enquire the Fact. Capt. WILLIAM DOWNING, AUGUSTINE KNEATON, WILLIAM PERKINS, WILLIAM TODD, WILLM. HAMBLETON, WILLIAM SMITH, JAMES MONKE, JOHN CARR, THOMAS MOSS, GEORGE LYLES, SIGISMUND MASSEY, PATRICK HUMES which said Jurors Elected Tryed and Sworne doe say upon their Oaths we find for the Defendant noe cause of action. Therefore tis ordered Judgment be entered on the Verdict of the Jury that the said John Jones shall be nonsuited and shall pay unto the said George King fifty pounds of Tobacco with all costs als Execution. Ordered George King pay the Jury 72 pounds Tobacco. Ordered that George King shall make present payment unto JOHN BREWTON, WILLIAM COCKE and JOHN JACKSON Eighty pounds of Tobacco apeace for their attendance in Court Two daies

      Unless Mary Jones executrix of John Jones have Manwareing Jones at the next Court and show good cause to the contrary the Court will committ the guardianshipp and trust of his estate to Mr. Stephen Manwareing.
      John Jones son and orphant of John Jones praying that Stephen Manwareing his grandfather may bee appointed his guardian, the same is accordingly admitted.
