      Pursuant to an order of Essex Couty made the 19th day of ffebry 1733 We the Subscribers have settled the accts. of the Estate of Mr. ROBT. JONES decd and set apart Mr. ANTHO. GARNETT and ELIZA. his Wife ye petitioners their one third part of the negroes and also a part Mrs. ELIZA, JONES Admix, her one third of the negroes for his wife right of dower and deliver them to each party and have likewise delivered the petitioners their one third part of the personal estate. April' 13th 1734.

      THE CONDION of this above obliga. is such that if ye above bound GEORGE. STUBBLEFIELD Guardian of SARAH JONES do & shall well and truly pay or cause to be paid unto the said Orphan all such Estate & Estates as now are or hereafter shall come to ye hands of ye sd GEORGE as soon as the sd Orphan shall attain lawfull age or when thereunto required by the Justices of the peace for the County of Essex as also to save & keep harmless the said Justices from all trouble that shall or may arise about the sd Estate then this Obligation to be void & of none effect else to be and remain in full force power & virtue

      THIS INDENTURE made the Sixteenth day of November in the year of our Lord one thousand seven hundred and forty two Between JOHN ELLIOTT of County of WESTMORELAND and SARAH his Wife one of the Daughters of ROBT. JONES late of the County of Essex deceas'd of one part and JAMES GARNETT of County of Essex of other part Whereas the said ROBERT JONES in his life time and at the time of his death was seiz'd in his Demesne in the Several lands herein after mentioned (that is to say) of one Certain parcel of Land containing two hundred acres being in the County of Essex adjoining to the land of JOHN ROWZEE, JOEL HALBERT and DANIEL SMITH deced wth a WATER GRIST MILL thereon standing and being which said tract of land was purchased of and from LODOWICK ROWZEE deced by the said ROBT. JONES and of one other tract of land Whereon Capt. SALVATOR MUSCOE lived at the time of his death and also adjoining to and upon the LITTLE OCCUPATION CREEK on the South side thereof and so on the land formerly belonging to JOHN MILLS wch said tract of land contains three hundred and seventy acres And Whereas the said ROBT. JONES died and left Issue only two Daughters (to wit) ELIZABETH and SARAH and without making any Disposition of the premises lands and tenements thereof Whereas and by which means the said lands of said ROBERT aforesaid is descended and come unto the said ELIZA. & SARAH his two Daughters aforesaid and Whereas the said JAMES GARNETT hath purchased of ANTHO: GARNETT and ELIZABETH his Wife one of the Daughters of said ROBERT JONES deced all the portion of her the said ELIZABETH to the lands Now This Indenture Witnesseth that for a Division of all the said Lands and MILL hereditaments and premises between the said parties in Severalty to them and their heirs it is hereby agreed between the said parties to these presents (that is to say) that the said JOHN ELLIOTT and SARAH his Wife and the heirs of the said SARAH shall have all that tract of land containing two hundred acres adjoining on the land of said JOHN ROWZEE, JOEL HALBERT and DANIEL SMITH with the WATER GRIST MILL thereon being and beforementioned and all profits whatsoever for the full share and portion of the said SARAH And that said JAMES GARNETT and his heirs shall have all and Singular other the lands herein before recited and not before Limitted and assigned unto said JOHN ELLIOTT and SARAH his Wife, To Have and To Hold unto said JOHN ELLIOTT and SARAH his Wife and heirs of said SARAH for ever To Have and To Hold unto the said JAMES GARNETT his heirs and assigns forever In Witness whereof the said Parties have set their hands and seals in presence of

ANN in the County of Essex, deceased, do for diverse good causes us thereunto moving but more especially for the summ of Thirty pounds current money to us in hand paid have Released and forever Quit claimed unto TABITHA MUSCOE and JANE MUSCOE, Spinster, both Daughters and Legatees of SALVATOR MUSCOE, late of ST. ANNs Parish in Essex County, Gent., deceased, in their full and peaceable possession and to their heirs in fee tail forever as the same is given and bequeathed to them the said TABITHA and JANE by the last Will and Testament of their said late Father, SALVATOR MUSCOE, deced., as by the Record thereof will appear, all such Estate interest and demand that we the said JOHN and SARAH had, now have or ought to have in or to the one half of a Tract or parcel of Land containing Three hundred and eighty acres being in the aforesaid Parish of ST. ANN and County of Essex formerly purchased by the aforesaid ROBERT JONES of WILLIAM MOSS & RICHARD MOSS as by their Deeds recorded among the Records of Essex County will appear, but now in the possession of them the said TABITHA and JANE by virtue of the last Will and Testament of their said deced. Father, SALVATORE MUSCOE, who purchased the said Land from JOHN MOSS, Brother of them the said WILLIAM and RICHARD MOSS, and also of JAMES GARNETT, who purchased the one half of the said Land of ANTHONY GARNETT and ELIZABETH his Wife, Eldest Daughter of the aforesaid ROBERT JONES, as by the said Deeds among the Records of the said County of Essex will appear; To have and to hold all the Estate right that we the said JOHN and SARAH had or now have in the one half of the aforesaid Tract of Land unto them the said TABITHA and JANE and their heirs in fee tail according to the last Will and Testament of their aforesaid Father, SALVATORE MUSCOE, deced., forever so that neither we the said JOHN and SARAH nor our heirs or any other persons for us will by any ways or means hereafter have claim to the premises.       THIS INDENTURE made this 21st day of July in year of our Lord one thousand seven hundred and Forty seven Between JOHN ELIOTT of County of WESTMORELAND in Colony of Virginia and SARAH his Wife, late SARAH JONES, Daughter of ROBERT JONES, late of Essex County deced., of one part and JAMES GARNETT of Colony and County aforesaid of other part; Witnesseth that JOHN ELIOTT and SARAH his Wife for the sum of two hundred & fifty pounds current money of Virginia to him in hand paid, by these presents doth bargain and sell unto JAMES GARNETT his heirs all that tract of land lying in County of Essex on South side OCCUPATION RUN which formerly belonged to ROBT. JONES, Late of said County deced., which tract of land said ROBERT JONES purchased of LODWICK ROWZEE deced., containing by estimation One hundred and Eighty acres more or less with a WATER GRIST MILL thereon standing or ad-joyning,which did likewise belong to said ROBT. JONES, with one acre of Land on North side the Run which the said MILL now stands on and all that other tract of land which JOHN ELIOTT purchased of JAMES JACKSON being Eight acres, which formerly belonged to DANIEL SMITH, late of ye County aforesaid deced., adjoyning to the aforesaid tract where the said MILL stands withall its rights members and appurtenances together with all houses tobacco houses orchards profitts and appurtenances thereof belonging To have and to hold the parsell of land and appurtenances unto JAMES GARNETT his heirs paying the rent and performing the sevices which shall become due and payable for the premises unto our Sovereign Lord the King his heirs; And JOHN ELIOTT and SARAH his Wife for themselves and their heirs unto JAMES GARNETT his heirs shall warrant and forever defend by these presents; In Witness whereof the parties first above named to these present Indentures interchangably their hands and seals have set the day and year first above written
