THE THIRTY THIRD YEAR OF THE REIGN OF OUR SOVEREIGN LORD GEORGE
THE SECOND BY THE GRACE OF GOD OF GREAT BRITAIN FRANCE & IRELAND
KING DEFENDER OF THE FAITH ETC.
Aminidab Seekright by GEORGE JOHNSTON his Attorney came &brought into the said
Court a certain Bill against Absolem Dreadnought in custody etc of a plea of Trespass &
Ejectment of farm and there are pledges of Prosecuting to with john Doe & Richard Roe
which Bill follows in these words Vizt. Fairfax County to wit Aminidab Seekright complains
asainst Absalom Dreadnought in Custody etc of a plea etc. for that that Whereas
a certain JOHN CARLYll on the ( ) day of ( ) in the year of our Lord one thousand seven
hundred and fifty nine at the parish of Truro and County aforesaid had demised granted
and to farm letten unto the aforesaid Aminidab one messuage Tenement & Plantation
situate lying & being on the main run of GREAT HUNTING CREEK in the parish of Truro
and County of Prince William (now Fairfax) containing Thirty acres be it more or less
To Have & To Hold the Messuage Tenement and plantation aforesaid Aminidab & his assigns
from the ( ) day of ( ) then Last past to the full end &Term of Seven years from
thence next ensuing & fully to be Compleat & ended by Virtue of which said Demise he
the said Aminidab entered the messuage Tenement and plantation aforesaid and was
thereof possessed until the said Absalom to wit on the ( ) day of ( ) in the year of our
Lord one thousand seven hundred and sixty with force and arms entered into the
Messuage tenement and plantation aforesaid in &, upon the possession of him the said
Aminidab & ejected & amoved him the said Aminidab from his farm aforesaid his said
Term therein being not yet ended and hath held & yet doth hold him out of the possession
thereof and then & there did other wrongs to him asainst the peace of our Lord the
now King wherefore the said Aminidab sayth that he is injured and hath damage to the
value of Fifty pounds thereu pon he brings his suit.
Sir I am informed that you are in possession or claim title to the premises in this
Declaration of Ejectment mentioned or to some part thereof and I being sued as casual
ejector in this action & having no claim or Title to the premises do advise you to appear
the neIt Court to be held for the County of FairfaI by some attorney of that Court and
then &. there by a rule of Court to cause yourself to be made a Defendant in my stead
otherwise I shall suffer a judgment to be entered against me &you will be turned out of
possession
To Mr. JOHN PLUMMER I am yours Tenant in possession of the premises Absm, Dreadnoughl
And the same day came JOHN WEST JUNR. Esquire Sheriff of the said County and returned
that he had delivered a copy of the above Declaration & endorsement to JOHN
PLUMMER Tenant in possession of the premises and thereupon JOHN MINOR an infant
under the age of twenty one years by JEMIMA MINOR his Guardian came there into the
said Court and prayed to be admitted Defendant in the room of the said Absolem
Dreadnought whereupon it ordered by the Court with the consent of the attorney and
Guardian that the said JOHN MINOR be admitted defendant instead of the now defendant
Absolem Dreadnought who will Immediately appear &. Receive a Declaration &. plead
thereto the General Issue and at the trial thereupon to be had the said JOHN MINOR will
appear by his Guardian and confess lease entry &. actual elpulsion &. wilJ insist only
upon the title on the trial or that in Default thereof Judgment shalJ be entered against
the Defendant Absolem Dreadnought the casual ejector but further prosecution is to be
stayed against him until! the said JOHN MINOR shall make default in any of the premises
and by the like consent it is further ordered by the Court that the said JOHN MINOR
shal! take no Advantage against the plaintiff for his not prosecuting upon the Trial if
occasioned by such default but that the said JOHN MINOR will pay the plaintiff his costs
thereupon to be taxed and it is further ordered that the lessor of the plaintiff be
chargeable with the paiment of costs of the Defendant to be wed or adjudged by the
Court
And the said JOHN MINOR by JEMIMA MINOR his Guardian comes &. Defends the force
&. Injury when etc. &. says that he is not thereof guilty and of this he puts himself upon
the Country and the said Plaintiff in like manner therefore it is commanded the sheriff
that he cause to come here on the third Tuesday in March nen twelve free & Lawful!
men by whom the truth of the matter may be the better bown and who are not related
either to the Plan tiff or the said Defendant to recognize and make a Jury of the Country
between the said parties of the plea aforesaid because as well the said plaintiff as the
said Defendant, have submitted themselves to the Jury the same day is given to the
parties there etc. The following deeds which shew the plaintiffs title were produced
Vilt.
Memo. that this 9th day of May 1757 JOHN CARLYLE & JOHN DALTON made a tender of
one hhd. Toba. Vi. 1007 to Mrs. JEMIMA MINOR Guardian of JOHN MINOR in order for her
to renew the Lease as within specified ..
