      THIS INDENTURE made this seaventh day of June in ye eleaventh yeare of the reigne of or; Sovr: lady Anne by the grace of God of Great Brittaine France & Ireland &c., and in ye yeare of or: Lord one thousand seven hundred & twelve; Between JOHN MULLIS of the Pish: of Xt. Church in County of Lancastr:, Planter, and Elizth: his Wife of the one part and ELIZTH: WHALEY, late Widdow of JAMES STREIGHTON, for the use of JAMES STREIGHTON the eldest Son of JAMES STREIGHTON, deceased, of the other part; Wittnesseth that ye sd. JNO: MULLIS and ELIZTH: his Wife for the sume of Five shills: to them in hand paid by the said ELIZTH: WHALEY (?) for the use of the sd. JAMES STREIGHTON his heires & assignes all that our tract of land being in County aforesd> & Pish of St. Mary White Chapple Two hundred acres or thereabouts it being the moyetie of Four hundred acres formerly granted to WM: MITCHELL by WM: THATCHER of the County aforesd., deced, and since the said land was sold by JOHN EDWARDS of the sd. JOHN MULLIS AND SHE NOT P:SONALLY appeareing to acknowledge the sd. Deed, the sd. JNO:MULLIS & ELIZTH: his Wife for the more pAfect assureing the sd. Land unto the sd. ELIZATH; WHALEY for the use of the sd. JAMES STREIGHTON, now in his minority, and to his heires & assignes for ever hath passed the Deed of Confirmacon of the lands aforesd. wth: all houses orchards gardens fences profitts and comodities and all & singular othr the p:misses as the sd. JON: MULLIS & ELIZATH: his Wife have in themselves before the passing of any Deed of bargaine and sale for the same: To have and to hold the sd. Two hundred acres of land & p:misses unto the sd. ELIZTH: WHALEY to the use of the said JAMES STREIGHTON the eldest son of the sd. James deced., and to his heires for ever; And the sd. JOHN MULLIS and ELIZTH; his Wife for themselves their heires doe agree wth: the sd. ELIZTH:WHALEY to the use of the said JAMES STREIGHTON his heires & assignes that they hath good right to see the before menconed land to the uses aforesd. and allsoe for the use of the sd. ELIZTH: dureing the minority of the sd. JAMES, and the said JAMES after he isof full age and his heires or assignes shall for ever occupye the before menconed land wth:out the claime of any persons claimeing undr. them and the same for ever will warrant & defend from the claimes of all persons.
