      In the action upon the Case between THOMAS CROUCHER, Plt and THOMAS MOUNTAGUE, JUNR. and GRACE bis Wife, Administratrix of JOHN MICKLEBURROUGH, deced. Defis. the Defts. put in their Plea and the Plt joyned the issue and by consent of the partys it is put to Court for tryall and on consideration of the arguements of the partys and the Evidences together with the Plt. makeing Oath that he agreed with JOHN MICKLEBURROUGH in his life time to be paid in tobacco for his worke at the rate of seventy five pounds of tobacco and caske.       In a Writt of Dower brought by BARTHOLOMEW YATES and SARAH his Wife, who was the Wife of TOBIAS MICKLEBURROUGH, deced., Demandts. and OLIVER SEGAR, Guardian of the Lands and hereditaments of JOHN MICKLEBURROUGH, Respondt. for the one third part of six hundred sixty two acres ofland with the appurtenances in this County as being the Dowry of said SARAH of the Endowment of TOBIAS MICKLEBURROUGH in times past, her Husband, the Respondt appeared and made Objection; at the Demandts.'s motion it is ordered ye Sheriff of this County some time between this and next Court put the Demand ts. in possession of ye one third part of ye aforesaid six hundred and sixty two acres ofland with the appurtenances and it is further ordered he make report of his proceedings thereupon to next Court to which the said Writt is continued

      YATES &c. v SEGAR Judgmt. In the Writt of Dower brought by BARTHOLOMEW YATES and SARAH his Wife, who was the Wife of TOBIAS MICKLEBURROUGH, deced., Demandts. and OLIVER SEGAR, Guardian of the Lands and hereditaments of JOHN MICKLEBURROUGH, Respondt., for the one third part of six hundred sixty two acres ofland with the appurtenances in this County as being the Dowery of said SARAH of ye Endowment of TOBIAS MICKLEBURROUGH in times past, her Husband, wherein the Order oflast Court was that ye Sheriff of this County should put ye Demandts's in possession of one third part of ye six hundred sixty two acres of land with appurtenances and report his proceedings thereupon to this Court and the Sheriff haveing made the following report [to witt] Middlesex County Set. By virtue of an Order of the County Court bearing date the 3d day of November 1707 to me drected, on the 28th day of the said month I gave full seizen and possession of the third part of the lands of TOBIAS MICKLEBURROUGH with their appurtenances to ye Demandts.in the Order nominated, to wit, two hundred acres of land commonly called and known by the names of NICHOLL's FOLLY, bounded as followeth; Beginning at a red Oake in BENFORD's line and running South East one hundred forty poles to a Hickory on a Hill over a small Branch, thence North East two hundred twenty nine poles to a Hickory in Mr. ROBERT PRICE's line, thence North West one hundred forty poles to a red Oake comer of GRACE LEWIS's land, thence North East two hundred twenty nine poles to the place it began and twenty one acres part of a Patent granted to THOMAS PATTISON dated ye 2d day of June 1657 and by said PATTISON conveyed to JOHN BEWFORD by Deed dated ye 17th day of September 1659 and by JOHN BEWFORD sold and conveyed to MOSES BUFFRY by Deed and by MOSES BUFFRY conveyed to EDMUND MICKLEBURROGH by Deed dated the 16th of February 1664 to be held by the Demandts. in ye name of ye Dower of ye said SARAH to her of right belonging from the Lands of TOBIAS MICKLEBURROUGH as specified according to said Order.
      WILLIAM JONES, Sub Sheriff, M. C.," The Respondt being called and not appearing at the Demandts.'s motion ye Report is admitted to Record and Judgment thereupon granted them by default for ye said lands and it is ordered that ye Demandts. hold and peaceably enjoy the same in ye name of ye Dower of ye said SARAH to her of Right belonging from ye lands of ye said TOBIAS according to ye meets and bounds in the Report mentioned dureing the life of ye said SARAH
