      Know all Men by these Presents that we John Hamper, Harmon Fishback, Brian Connely, George Gent and Joseph Marten are held and firmly bound unto Francis Awbrey the first Justice in the Commission of Peace for Prince William County for and in behalf and to the sole use and behoof of the Justices of the said County and their successors in the sum of two hundred pounds to be paid to the said Francis Awbrey his Executors Administrators and Assigns. To which payment well and truly to be made we bind ourselves and every of us our and every of our heirs, executors and administrators jointly and severally firmly by these presents. Sealed with our seals dated this nineteenth day of March 1734.
      The Condition of this Obligation is such that if the above bound John Hamper and Harmon Fishback executors of the Last Will and Testament of John Fishback deceased do make or cause to be made a true and perfect Inventory of all and singular the Goods, Chattels, and Credits of the said Deceased, which have, or shall come to the Hands, Possession, or Knowledge of the said John Hamper & Harmon Fishback or into the hands or possession of any other person or persons for them and the same so made, do exhibit into the County Court of Prince William at such time as they shall be thereunto required by the said Court; and the same Goods, Chattels and Credits, and all other the Goods, Chattels, and Credits of the said Deceased, which at any time shall come to the hands, possession, or knowledge of the said John Hamper and Harmon Fishback or into the hands and possession of any other person or persons for them do well and truly administer according to Law; And further do make a just and true account of their Actings and Doings therein, when thereto required by the said Court; and also shall well and truly pay and deliver all the legacies contained and specified in the said Testament, as far as the said Goods, Chattels and Credits, will thereunto extend, and the Law shall charge: Then this Obligation to be void and of none Effect, else to remain in full force and Virtue.

      THIS INDENTURE TRIPARTITE made the Seventh day of February in the Nineteenth year of the reign of our Sovereign Lord KING GEORGE the Second and in the year of our Lord one thousand seven hundred and forty five Between HERMAN FISHBACK of Hamilton in the County of Prince William Planter of the first part, PETER HITT of the same place Planter of the Second part and MARY NAE of the same place Widow of the third part Whereas a MARRIAGE is intended by the grace of God to be shortly had between the said HERMAN FISHBACK and MARY NAE And Whereas it is agreed between the said HERMAN FISHBACK and MARY NAE that the Lands & tenements herein after mentioned shall be settled and conveyed to such several uses & purposes as are herein after declared
      Now This Indenture Witnesseth that for and in consideration of the intended MARRIAGE and also of the sum of Ten shillings current money of Virginia to him the said HERMAN FISHBACK in hand paid by said PETER HITT the Receipt is hereby acknowledged and for divers other good causes he the said HERMAN FISHBACK hath granted unto the said PETER HITT and to his heirs and assigns forever all that parcel of land containing One hundred acres together with all houses and appurtenances thereunto belonging whereon the said HERMAN FISHBACK now liveth and also all that parcel of land containing One hundred acres adjoining to the land of JOHN RECTOR & TILMAN WEAVER which said tracts of land with the appurtenances are in the Parish and County aforesaid in a certain place called the GERMAN TOWN To Have and To Hold the said tracts of land unto PETER HITT his heirs and assigns for ever To the use and behoof of such person or persons and for such estates without any conditions without power of revocation and new appointment in such manner as said HERMAN FISHBACK by any Deeds Writing under his hand and Seal and attested by three or more credible witnesses or by his Last Will and Testament or any writing purporting to be his last Will and Testament under his hand and Seal and attested as aforesaid shall from time to time appoint and as the Estate so to be appointed (if any shall be) and in the mean time until such appointment and in default thereto To the use and behoof of the aforesaid PETER HITT and his heirs during the joint lives of the said HERMAN FISHBACK and said MARY NAE his intended Wife /provided the said intended marriage shall take effect and from and immediately after the determination of that estate to the only proper use and behoof of him the said HERMAN FISHBACK his heirs and assigns absolutely & for ever. In Witness whereof all the said parties to these present Indentures have set their hands and Seals in presence of JOSEPH MARTIN HERMANNS FISHBACK
