Between LUKE THORNTON of Rappa: County of the one part & JOHN STEWART [Stuart] of the other part Witnesseth that the said JOHN STEWART for himself his heires for a good and valluable consideration reced and to be reced sell unto the sd LUKE THORNTON his heires forever one moyety or halfe part of a certain Devidend or parcell of land being in Rappa: County and on the Eastermost side of RAPPA: CREEKE, bounding on the land of JOHN PAXTON being part of a Devidend of land belonging to Col WM. LOYD conteyning Three hundred acres being bounded as p Bill of Sale from the sd LOYDE unto JOHN ESSEX bearing date the 3d day of May 1671 more at large doth appeare and from BRIDGETT ESSEX, Wife and Attorney to the sd JOHN ESSEX, sold & made over unto JOHN ONEALEY by Assignment to one moyety or halfe part as aforesaid being One hundred & forty acres and made over unto JAMES STEWART deced, to whom I the sd JOHN STEWART am the true and lawful heire being now of full age To have and to hold the sd moyety or halfe part of the prmisses aforesd, from me the sd JOHN STEWART unto the aforesd.       THIS INDENTURE made the second day of February in the ninth year of the Reigne of our Sovereign Lady Anne by the grace of God of Great Brittain France and Ireland, Queen defender of the faith &c,, and in the year of our Lord one thousand seven hundred and teen. Between WILLIAM STUART of the Pish. of NORTH FARNHAM in County of Richmond in Colony of Virginia, Planter, of one part and JOHN SMITH of the Pish, of SITTENBURNE in County of Richmond of other part; Witnesseth that WILLIAM STUART for the sum of Five shillings of lawful! money of England to him in hand paid by JOHN SMITH by these presents doth bargaine and sell unto JOHN SMITH and assigns all that plantation and tract of land lying in the Pish. of SITTENBURNE and County aforesaid containing One hundred thirty and three acres and an half of land, part of a Patent for Two thousand acres of land granted to HENRY FLEET and by him lapsed, and since granted to WALTER GRAINGER. and by him sold to Collo. JOHN WALKER, who gave the moyety or half part of said Two thousand acres of land to his Daughter, ESTHER, who afterwards intermarryed with JOHN PEIRCE, who together wth: the said ESTHER, sold said One hundred thirty and three acres and an half of land to MORGAN WILLIAMS, who leaving no heirs nor making legal' disposition thereof by Will, the said One hundred and thirty three acres and an half of land did escheat to the Proprietors of the Northern Neck of Virginia and CATHERINE WHITE, the Widow of the sd MORGAN WILLIAMS moving that her right of the said land might be granted unto her Son. the said WILLIAM STUART, the same was thereupon by the Proprietors by their deed dated the twenty fifth day of January one thousand seven hundred and five granted to said WILLIAM STUART and is bounded, Beginning at a marked red Oak stanCREEKE a little above the Bridge and extending from thence North eighty eight degrees West one hundred and eighty one poles to a white Oak, thence South two degrees West one hundred and tenn poles, thence running along a dividing line made by Mr. EDWIN CONWAY between this land and the land of said WILLIAM STUART to the aforesaid RUN or CREEKE, thence up the said Run or Creek its several! courses or meanders to the place where it first began, To have and to hold the plantation and trct of land with all houses orchards profitts and appurtenances to the same belonging unto said JOHN SMITH his heirs dureing the full terme of one whole year paying unto WILLIAM STUART or his assigns the rent of one pepper Corn on the feast day of St. Michael! the Archangel! only if demanded to the intent that JOHN SMITH may be in the actually possessed of the Premises and thereby better enabled to accept a release thereof to him in fee freehold and inheritance; In Witness whereof the parties to these presents have hereunto inter changeably sett their hands & seals the day and year first above written
