TALIAFERRO was appointed Guardian to his Bro. & Sistr CHARLES & KATHERINE TALIAFERRO & was further ordered by ye Court at ye same time to possess himself wth wt of Coll, CADWALR. JONES his Estate hee could come at on behalfe of ye sd Orphants in pursuance of which sd Ordr beareing date ye 2 of March 1686/7 ye sd Robert Taliaferro did possess himself of one youn ge Negro named Frank a Carpenlr. & Cooper & aftr to witt ye 8th of March followinge ye sd Coll. JONES did by Deed of Assignment undr_ his hand assignd ye sd things together with ye sd Negro Franck soe seized & possessed by the said ROBT. TALIAFERRO aforsd in Right of ye Children and WHEREAS I JOHN BATTAILE marryd KATHERINE TALIAFERRO one of ye Orphans abovesd made humble suite to ye sd Court of RAPPA. to be possessed with ye Estate of my sd Wife in ye hands of sd ROBERT TALIAFERRO Guardian as aforesd at which sd Court being ye 1st of June 1687 ye Court did ordr me ye sd JOHN BATTAILE possession as aforsd of one moytie of ye sd Estate soe seized by ROBERT TALIAFERRO as aforesd & made over to him by COLL. JONES aforesd part of which sd Estate to win. ye above named Negroe Frank ye sd ROBT. TALIAFERRO did publickly in open Court relinquish to me & made over to me & gave me full authority to possess my selfe wth him in right of my Wife aforesaid which sd Negro Frank I have by these presents sold unto WM. FITZHUGH his heires for ever for ye full vallue of Nine Thousand pounds of Merchantable Tobo & Caske And I doe by these presents for my selfe my heires to & wth ye sd WM. FITZHUGH to Warrant & defend sd Negro Frank from ye clame of ye COLL. CADWALDR JONES. his heires or assigner, or from FRANCKY, JOHN, ROBERT, CHARLES & RICH TALIAFERFtO or any or either of them their heires & assigns in ye penall sume of Eibhteene thousand pounds of Who.       To one Negro called Frank, To one Indian, To one Negro girle 12 months old, To 2 old Negroes Frank and James; To 3 indifferent feather beds and furniture; To 10 cows, To 2 two yeare old at 12 S., To 5 yearlings, To 20 sheep, To 50 lb. Pewter at 8d,, To 1 pair Cart wheels, To 1 iron pott and two pare pott hooks, To brass kettle, To one Couch, To 12 old chairs, To one old Mare, To one old horse, Total 98..07....04.
      KNOW ALL MEN by these presents that I Lt. Coll: CADWALADER JONES have bargained sold and delivered unto Mr. ROBT: TALIAFERRO his heires and assignes the abovesd goods and chattles with their En crease wch : said goods and chattles I do warrnt from the claimes of any persons unto the sd Mr. ROBT. TALIAFERRO or his order In Witness whereof I have sett my hand this 8th of March 1686/7

      - This day CHARLES & CATHERINE TALIAFERRO in open Court made choise of their Brother, Mr. ROBERT TALIAFERRO, for their Guardian upon wch: the Court have ordered that the sd ROBERT TALIAFERRO take into his possession & custody all & singular the sd Orphans Estate and give Bond with good & sufficient securitie to the next Court for this County to Indemnifie the sd Court from and be accountable to the sd Orphans for the sd Estate when thereto lawfully required

      - Whereas JOHN BATTAILE who lately marryed CATHEREINE, one of the Daughters of Mr. ROBERT TALIAFERRO deced, made humble suit to this court to be possessed with all & singular the Estate of his said Wife in the hands of ROBT. TALIAFERRO her Guardian. The Court have thereupon ordered that Mr. GEORGE HASLEWOOD & Mr. JNO, CATLETT some time between this Court and next Court held for this County, do meet at the house of the sd ROBT. TALIAFERRO & that then & there they equally devide all & every the Estate of the sd CATHERINE & CHARLES TALIAFERRO, her Brother, now in the hands of the sd ROBERT, And after such devision made & after such that the sd JOHN BATTAILE be forthwith vested in right of the sd CATHERINE his Wife with one halfe part of the sd Estate in specie as it was received by the sd ROBERT from Colnll.       THIS INDENTURE made the 28th day of September in yeare of our Lord 1689 between JOHN BATTAILE of the one part and ROBERT THOMAS of other part Witnesseth that JOHN BATTAILE for Four thousand pounds of good sound sweet seated Tobb: and caske to him in hand paid by sd THOMAS whereof sd JOHN BATTAILE doth hereby grant and confirm unto ROBERT THOMAS One hundred & twenty six acres & half of land scituate and being in County of Rappa. on South side of the River and in the Freshes thereof begining on the Northwest side of CEDAR CREEK at the top of the Point being low ground and extending by the River side North West to two small scrubby Oakes, thence South West crossing over a great bite of the sd Creek and over the MANE ROAD to a Hickory by a small branch, thence S. E. to a Spanish Oake, thence W. crossing the said Creeke to the first menconed Station and all houses buildings gardens fences trees and all other the premises and all right of him said JOHN BATTAILE and CATHERINE his Wife To have and to hold said land for so many acres of land as aforesd with all and singular appertenances to the same belonging unto said ROBERT THOMAS and his heirs free and cleave from all former sales and all other demands and incumbrances whatsoever the quitrents henceforth to be due to his Maties only excepted by the said JOHN BATTAILE and that said JOHN BATTAILE and CATHERINE his Wife will at any time acknowledge in open Court either to be held at the County Court or at the Genii.
