      TO ALL CHRISTIAN PEOPLE Be it Remembered & kept in perpetual! memory that Whereas RICHARD KEMP & ELIANOR his Wife being possessed in ffee of a tract of land formerly granted by Pattant unto HUGH MEAD the said Richard & his Wife did by one Deed of Gift (Recorded in Essex Court) give unto MARY & KATHAREINE ALEYN the said Elianors two daughters, all the said tract of land containing 200 acres Now Know Ye that the said Mary now Wife of MARTIN NALLE & her said Husband & the said Katharine now Wife of JAMES SAMS all of the Parish of South farnham in the County of Essex by these presents do by one Consent agree & oblige themselves to servere the joynt Tennanty and by Equally dividing the land the said Devision line mining S 5 degrees E from a red oak by a Swamp between RICHARD GATEWOOD & this tract to a red oak in the East line to which agreement we oblige ourselves our heirs & Either of them firmly by these presents as Witness our hands & Seals this Fifteenth day

      THIS INDENTURE made the 17th and 18th day of April 1734 Between JOHN NALLE of the County of SPOTSILVANIA and Parish of St. Marks of one part and THOMAS BURKE of the County of Essex and Parrish of Southfarnham of other part Witnesseth that sd John Nalle for sum of Forty two pounds Currt. money of Virg& hath granted unto said Thomas Burke and to his heirs land in Parrish of Southfarnham in County of Essex containing One hundred and sixty five acres (Warranty) One hundred and fifty five acres whereof (being part of a tract of Three hundred acres) purchased by MARY NALLE of RICHARD KEMP as by his deed bearing date ye 5th day of June 1705 and other ten acres being that divident of land that was given by Will to sd John Nalle by his Father MARTIN NALLE deceas'd being part of divident purchased by the sd Martin Nalle of JAMES BOUGHAN deceas'd all which premises are in ye actual possession of him the sd Thomas Burke by virtue of Indenture of Bargain and Sale and of the Statute for transferring uses into possession To Have and to Hold all the sd tract of land (excepting a piece of forty foot square for a burying place where Martin Mille and

      John Nalle acknowledged this Lease & Release indented which on his motion is recorded KNOW ALL MEN by these presents that I John Nalle am bound to Thomas Burke in the sum of Eighty four pounds Currt. money of Virga. The Condition of the above obligation is such that the above bound John Nalle hath sold unto Thomas Burke a tract of land in aforesd County of Essex One hundred and sixty five acres, One hundred and fifty five acres whereof being part of a tract of Three hundred acres purchased by RICHARD KEMP of MIDDLESEX COUNTY & conveyed by the sd Kemp to MARY NALLE Mother to the sd John Nalle as by sd Richd. Kemps Deed dated the 5th of June 1705 and the other Ten acres being part of a Dividend purchased by Martin Nalle of James Boughan deced and bequeathed by the Last Will and Testament of his Father the sd Martin Nalle to sd John Nalle all which sd land in possession of Thomas Burke by Deeds of Lease and Release if Therefore the sd lands be clearly discharged from all other gifts, grants, leases, titles of dower and from all other titles from all incumbrances suffered by sd John Nalle or Mary his Wife or his heires (the quitrents that shall grow due to our Sovereign the King only excepted) that then this Obligation to be void or else to stand. In Witness whereof John Nalle hath hereunto set his hand and seal the 20th day of May 1734.
