      917. Ordered that EDWARD MANN shall make payment of the sum of eighty pounds of Tobacco unto JOHN WILLIAMS for his attendance two daies at Court in a suit depending between him and GEORGE LUKE with costs.

      928. EDWARD MANNE complains against GEORGE LUKE in plea of Trespass for that the said George Luke did on or about the 24th or 25th of July last past take up out of the wood in this County and within the jurisdiction of this Court a black mare branded in the near buttock with a figure of three being your petrs owne proper goods which mare George Luke did take up and ride to several places without your Petrs leave knowledge or consent since which time the plt could never find his mare tho having made diligent search and Enquiry .. and the Court doe accordingly order Therefore tis ordered that George Luke shall between this and the 20th of February deliver unto Edward Mann his mare or else pay him twelve hundred pounds of Tobacco with costs.

WHEREAS Major EDWARD GRIFFITH late of MULBERRY ISLANDE in ye Colony of Virgo. did by an Assignmt. under his hande and Seale dated ye 25th day of December 1662 grant unto mee for ever ye said FRANCIS DADE Sonne of Major FRANCIS DADE then decd one thousand acres of lande in County of WESTMORELANDE on ye upper side of MACHOHICK CREEKS or River & bounded Easterly upon POTOMACK RIVER Southerly upon MACHODICK BAY or Mouth of ye said River Northerly upon ye land of JOHN DODMAN Westerly upon land where ROBERT MAPLE some time lived upon ye main woods and three hundred and fifty acres ye other thereof boundin ge Southerly upon land of STEPHEN NORMAN Easterly upon aforesaid Six hundred and fifty acres Northerly and Westerly upon ye Maine Woods as pr Assign-mt. of a Pattent granted to said GRIFFITH under ye hande of FRANCIS MORYSON Esqr, then Governor and Capa_ Genii. of Virga. on ye 6th day of August 1662 as by said Pattent and ye Assignmt. beinge thereunto had will appear by vertue of wch I ye said FRANCIS DADE became seized in fee simple of ye one thousand acres of land.       This Sale of Laude was acknowledged by FRANCIS DADE to Capa. JOHN WITHERS in ye County Court of Stafford on ye 10th day of May 1692 and was then recorded I JOHN WITHERS of ye County of Stafford doe assign over all my right of this wthin mentioned Deed of Sale unto ROBERT MASSEY Son of ROBERT MASSEY late of ye afore-said County deced to him and his heires of his body in case of failure to DADE MASSEY ye heires of his body & in case of failure of them to BENJAMIN MASSEY le ye heires male of his body & in case of failure of them then to THOMAS MASSEY to him & his heires for ever. In Wittness whereof I have sett my hande and Seale this Eleventh day of May 1692.

      197. JOHN STORY Complains against EDWARD MANN in a plea of debt .. the sum two hundred and seventy five pounds of tobacco due per account .. And Edward Mann the deft came into Court in Propria Persona and discounted the sum of fifty pounds of Tobacco out of the sum Therefore tis ordered Edward Mann shall make present payment .. ballance

      198. WILLIAM BUCKNER humbly complaining sheweth that EDWARD MANN- of this County Viz et armis and contrary to the Peace of their Sovereign Majesties doth keep and detaine from your petr two hhds both of the plts proper goods and mark the Tobacco being legally paid to your petr by one DANIEL RICHMOND who lately lived with Edward Mann within this County and the Jurisdiction of this Court and afterwards the plt giving notes to the Seaman for the two hhds of Tobacco the said Man refuseth to deliver the same contrarie to Law or Justice and waiting two dales for the two hhds of Tobacco to the pits damage fifteen hundred pounds of tobacco with cask .. And Edward Manne the deft came into Court in Propria persona and for plea saith not guilty And the Court having considered the premises and a full debate of the matter had on both sides and William Buckner the pit fully proving to this Court that Edward man the deft cloth still withhold and detain the two hhds of Toba. Therefore tis ordered that Edward Man shall immediately deliver unto William Buckner the two hhds of Tobacco and that William Buckner shall make present payment of one hundred and sixty nine pounds of tobacco each paying his own costs.

      I JOHN STOREY complains against EDWARD MAN in plea of debt .. the sum two hundred and fifty pounds of Tobacco per account .. And Edward Man the deft comes in Court and for plea saith that he bath already obtained a nonsuit in this Court against the Plt in this very action and therefore moves to be satisfied and paid for the nonsuit according to Law before he comes to Tryal And ROBERT BRENT the attorney of the said Storey the plt did assume in Court to pay the said nonsuit for the plt to the deft according to Law And now forasmuch as it doth appear to this Court that Edward Man the deft stands justly indebted to John Storey the plt the sum two hundred pounds of Tobacco Therefore tis ordered Edward Man shall make present payment of said sum .. Mr. MATTHEW THOMPSON absent. Present Mr. EDWARD THOMASON.

      259. JOHN WITHERS Gent humbly complaining sheweth that the Plt did agree last sunset with JOHN STORY of this County and within the jurisdiction of this Court to build or set him up Three tonne of Cyder Cask for which the Plt was to pay the deft according to agreement and contract made with him and the said Story the deft did assume and promise before witness to the Plt to have nothing for the said Sider caske and to pay for the Sider so leaked out if that any of the caske leaked out any or the whole part of the said Cyder all which the pit is ready to aver and prove Now soe it is that John Story did set up the Three tun of Caske and the plt did fill up the Caske with Sider Expecting that they had been good and firm according to agreement but the most part of them proved unsound and leaky and did leak out the quantity of three or four hundred gallons of Cyder whereby the pit doth in fact say he is damnified and damage bath received to the value five thousand pounds of Tobacco and cask .. and John Story came into Court in propria persona and for plea saith not guilty and for Tryal puts himself upon the Countrey and the plt likewise Therefore tis ordered that the Jury Enquire the fact JONATHAN PARKER, Capt. WILLIAM DOWNING, THOMAS CHAPMAN, RICHARD MARTIN, JOHN COTTEN, JONATHAN MOTTERSHED, DAVID ANDERSON, ANDREW BARBEE, DANIEL BEACH, WILLIAM HARRIS, JAMES MAN, BENJAMIN NEWTON which said Jury fairly elected tryed and Sworn to say the Truth of the premises do say upon their oaths we find for the plt one thousand and eighty pounds of tobacco and caske and to forfeit his caskes so set up to the Plt Therefore tis ordered that Judgment shall he entered on the verdict of the Jury and that John Story shall make present payment of said sum to John Withers.
      Ordered John Withers shall pay unto the Jury seventy two pounds of Tobacco with costs .. Ordered that John Withers shall make present payment of one hundred and twenty pounds of Tobacco per peice to RICHARD HENWOOD and THOMAS WEEDON for their attendance at Court in suit depending between him and John Story with costs ..
