Charles County Land Records 1775-1782; Liber V#3; Page 490. Aug 21, 1780 from John Woodward of Montgomery County and Mary, his wife, who is daughter and heir at law to Joshua Guibert, late of St. Mary's County, decd, to John Ratcliff of Fairfax County, Virginia, and William Edie and Elizabeth, his wife, of Virginia. Whereas sd John Woodward and Mary, his wife, have been informed that a deed has been discovered on record, made by Thomas Wicherly, formerly of CC, to the sd Joshua Guibert, purporting to be a deed to convey to the sd Joshua Guibert, all that tract of land in CC called Tower Hill, containing about 166 acres, and we, sd John Woodward and Mary, his wife, being well satisfied that there was no consideration paid by sd Joshua Guibert to sd Thomas Wicherly for the land afd, and being certain that the sd deed was never intended between the parties afd as a deed of absolute conveyance, but that the same was done and made by the by sd Thomas Wicherly to sd Joshua Guibert as his trustee, for reasons then known to the parties, and it was never intended that sd Joshua Guibert should have the land to his own use, and we, sd John and Mary Woodward, wanting the heirs of sd Thomas Wicherly to not be deprived of their right in sd land or legal remedy, therefore that sd deed and the true intention thereof be executed, now this deed witnesses that sd John Woodward and Mary, his wife, for 5 shillings to them paid by sd John Ratcliff, William Edie, and Elizabeth, his wife, sell to sd John Ratcliff and William and Elizabeth Edie, sd tract of land called Tower Hill, lying in CC. Signed - John (@ his mark) Woodward, Mary (X her mark) Woodward. Wit - Peter Pearce, William (X his mark) Harp, Ignatius (w his mark) McFarthing. Acknowledged before Saml W.
