      - Rappahannock County Court 7th of November 1688
      - JOHN WATERS brought his action in this Court against RICHARD WILTON as Marrying the Executrx, of ROSOMUND JACOB and declares that the sd JACOB at the time of his decease stood justly indebted to him the sum of Six pounds Ten shillings in mony upon Account bearing date the 8th: day of 9ber 1685 and proved by the Oath of the Plt., in this Court. The Deft. sayes that by the 4th Act of Assembly held at JAMES CITY the 25th day of April! Ano 1679 no accounts are pleadable against the Estate of a deceased person except proved by the Oath of one witness more besides the Creditor, But it appearing to this Court that the sd Debt was contracted within one year before the death of the sd JACOB, the Court granted Judgmt. to the sd JOHN WATERS against the Estate of the sd ROSOMUND JACOB for Six pounds ten shillings in mony to be pd. wth: cost of suit als exe., from which Judgment the Deft. appealed for a rehearing of the matter to the Honble Councell on the 4th day of the next Genll. Court

      p.343 KNOW ALL MEN by these presents that I JOHN WATERS of South Farnham Parish & County of Essex, Planter, for ye consideration of Five thousand pounds of sweet scented tobacco & casque to me in hand paid by PHILLIP PARR of ye aforesd County, Gent., do by these presents grant and set over unto him ye sd PHILLIP PARR all my right claime & interest of a Plantation and parcell of land lyeing & being on ye South side of PISCADDAWAY CREEKE in GLOVERS NECK in South Farnham Parish & County of Essex, being part or parcell of a tract of land formerly granted by Patent by SR. WILIAM BEVERLEY Knt., to Mr. THOMAS PATTISON, since conveyed to MR. JOHN WATERS SENR., & conveyed by ye sd JOHN WATERS SENR. to GEORGE BROOKES and since by the sd GEORGE BROOKS given unto JOHN WATERS JUNR., by his last Will & Testament, bounding as followeth: Begining at ye Northermost corner of JOHN SAVAGE back of me being a red Oake standing on ye North side of ye sd BROOKS SPRING BRANCH runing thence South West to a Stake by two marked red Oakes & thence South East to a marked Hickory corner tree of JOHN WEBSTERs land, thence North East along ye sd WEBSTERs line to a stake between a red Oake & white Oake standing in ye aforesd. SAVAGEs line, & thence North West along ye sd SAVAGEs line to ye first mentioned red Oake, the place it first began containeing by estimation Two hundred acres: To have & to hold ye sd Plantation & Land to him ye sd PHILLIP PARR his heirs & assigns for ever with all profitts belonging in as large manner as it was granted by the Right Honourable ye Governr: Ingageing my selfe my heirs that he sd PHILLIP PARR his heirs shall possess & enjoy every part & parcell thereof of ye aforesd. tract of land peaceably & quietly without molestation or disturbance of any persons whatsoever, that shall or may lay any just claime thereunto with warranty from all persons, And to acknowledge this my act and deed in Court being at any time thereunto required.
