Mr. JOHN SMITH SENR. & by his Pettn: setts forth for that, that is to say, the Plt. hath a good right and tvtle of in and to two hundred & fifty acres of Land. part of five hundred & fifty acres, granted to JOHN CURTIS, the Plts. Father, by Pattent dated in the yeare 1661 scituate in this County on which said Land, the said JOHN SMITH SENR. hath entred on ye 7th day of Decembr: last & him. the Plt., did stopp and hinder from sur- veying & laying out the same and divers other trespasses & enormityes hath committed thereon & continues to doe to the Plts. damage fifty pounds Sterling for which said summe he hath brat: his suit and prays judgment with cost &c., To which the Deft. appearing pleaded not guilty.       - JOHN CURTIS and FRANCES his Wife, Administratrs: of ERASMUS WITHERS, deced., Plts. in an action of the Case against CHARLES REEVES, Execr. of GEORGE REEVES he being Admr. of FRANCIS REEVES, deced., Deft., declareing as followeth: For that (that is to say) the said FRANCIS REEVES in his life time by his Deed indented & sealed beareing date the 3d day of October 1670, for and in consideration of Seaventy pounds Sterling money paid by ERASMUS WITHERS to whome the Plaintiffes are Admrs. give grant bargaine alien sell enfeoffe & confirme unto ye said ERASMUS WITHERS his heires and assignes for ever, a certain tract devident or parcell of land lying on the East & North East side of the GREAT BEAVER DAMS containing Two hundred and seaventy acres & bounded as in the said Deed is at large expressed & sett down and did further by his said Deed covenant that he the said ERASMUS WITHERS his heires and assignes for ever should hold the said Land according to the bounds in the said Deed sett down & expressed against him the said FRANCIS his heires &c., & all & every person & persons whatsoever lawfully claimeing ye same or any part or parcell thereof & that he would warrant and for ever defend them and every of them therein; Notwithstanding, which upon a suit brought to the Generali Court by ROBERT SMITH. Esqr ., in his life time against the Plaintiffe it was found by a Jury of the Vicinage & the Surveyor appoynted that there were Eighty five acres wanting of the said Land conveyed as aforesaid on the said FRANCIS REEVES unto the said ERASMUS WITHERS so much being taken away out of the bounds mentioned in the said FRANCIS REEVES sd. Deed by an Elder Grant which the said Jury vallued at 20 lb. Sterling & accordingly made there report upon which Report afterwards RALPH WORMELEY,Esqr., & Coll. JOHN ARMESTEAD, Execrs. of Mr. ROBERT SMITH, Exer. of the said ROBERT SMITH obtained Judgment at the Genll. Court asp there Order ye 19th day of Octobr: l6(torn)9 will appeare against these Plaintiffs for twenty pounds Sterling with all cost in regard the said ERASMUS WITHERS had sold ye land wch: he bought of the said FRANCIS REEVES according to the bounds mentioned in the said REEVES his Deed of Saile & there wanted (torn) five acres therefore aforesaid; Whereupon the Plaintiffe( (torn) say that in as much as the said FRANCIS REEVES by Deed did sell more land by eighty five acres then he had tytle unto & that he hath not defended ye said ERASMUS WITHERS & his heires &c. against lawfull claimes to any part of ye said Lands conveyed by his said Deed according to the Covenants fully expressed therein; these Plts. have been inforced to pay the aforesaid Judgment of the Generall Court for twenty pounds Sterling & cost which cost amount unto three thousand three hundred forty & two pounds of tobacco and are farther damaged Ten pounds Sterling, And therefore they bring suit & pray Judgment against the said Defendant for the said summe of Twenty pounds Sterling, the said summe of three thousand three hundred forty & two pounds of tobacco and the said
      damages wth: cost of suit &c. And Mr. JOHN SMITH having at the last Courtentred into Recognizance in the summe of One hundred pounds Sterling to the Pla.ntiffs with condition that if the said CHARLES REEVES by him selfe or his la.wfull Attorney should appeare at this Court and answer the said suit and pay and sattisfie what should appeare to be due, that then the said Recognizance to be voyd or else to stand in force and the said CHARLES REEVES not now appea.reing by him selfe or lawfull Attorney, Judgment is therefore granted to the said JOHN CURTIS and FRANCES his Wife, Administrs. of ERASMUS WITHERS, deced., against the said JOHN SMITH as aforesaid for the sum.me of Sterling money and tobacco the same appeareing due wth: cost of suit

      Whereas Mr. WILLIAM JONES and Mr. JOHN EUSTACE brought their accounts to this Court against Mr. JOHN CURTIS who married the Administratrix of Mr. ERASMUS WITHERS late deceased, and prayed that whereas they became bound with the said Administratrix to be accountable for the Estate of the said Mr. WITHERS they might be released from their said bond (the said Mr. CURTIS giving in other Security) or have the full of the said Estate in their hands in order to secure themselves, the said CURTIS being returned on the docket by a note left, an attachment is awarded the said JONES and EUSTACE against the said Estate returned to the next Court.

      THIS INDENTURE made the Seventh day of June 1710 Between JOHN CURTIS of Parish of Wicocomico in County of NORTHUMBERLAND Planter of one part and RALPH WORMELEY of Parish of Christ Church in County of Middx. Gent. Witnesseth that whereas said John Curtis only Surviveing Brother and next of kin unto ELIZABETH HAZELLWOOD deced Daughter and Heir of ABRAHAM MOON late.of ye County of LANCASTER deced made the claime of right unto the escheat of Fourteen hundred acres of land in County of Lancaster (now Middlesex) first granted unto the said Abraham Moon and THOMAS GRIFFIN by a certain Patent or Deed of Grant dated the 16th of September 1651 and supposed to be contained within the bounds of one certaine Patent or Deed of Grant for Seventeen hundred acres of land in Parish of Christ Church in the County of Middx first granted unto Abraham Moone deced by Patent dated the last day of March 1653, which said Seventeen hundred acres of land by virtue of an Inquisition taken on the 7th day of May 1697 before R1CHD. JOHNSON Esqr. then Escheator for the aforesaid County of Middlesex was found to escheat unto his Majty. and was granted unto RALPH WORMELEY Esqr. deced Father unto the aforesaid Ralph Wormeley party to these presents by Patent dated the 15th of October 1698 as by said Patents remaining upon records of the Generall Court of this Dominion NOW KNOW YEE that I the said John Curtis for sum of one hundred and twenty pounds Steil, hath released unto Ralph Wormeley (in his full and peaceable possession being) and to his heires forever all the right claime and demand whatsoever which said John Curtis now hath in the before recited Patent for Fourteen hundred acres of land also all his right and demand which he now hath in the before recited Patent for Seventeen hundred acres of land . Escheated and granted as also all the right and demand which he the said John Curtis now hath or may have to any lands whatsoever in County of Middlesex now claymed by Ralph Wormeley
