      Westmoreland County, Virginia Will Book page 124-125. Stephen Bailey made his Will in Westmoreland County, as follows: In the name of God Amen. I Stephen Bailey of the parish of Cople, being sick and weak in body, but of sound and perfect memory do make, constitute and appoint this my last Will and Testament in manner and form following, Imprimis I commit my soul to God, that gave it hoping through the Merits and Satisfaction only of my dear Lord and Savior Jesus Christ to obtain the forgiveness of my sins anda blessed resurrection to everlasting life, and my body to be buried at the discression of my Executors hereafter named and as for what worldly estate, the Lord hath been pleased to Lend me I give and bequeath as followeth, after my Debts and Funeral paid,
      Item. I give unto my son John Bailey all that tract of land in the forrest by estimation fifty acres, be it more or less with all houses fences and appurtenances thereunto belonging to him and his heirs forever.
      Item. I give unto my son William Bailey all that tract of land where on I now live with all houses, orchards, and appurtenances thereto belonging, to him and his heirs males of his body begotten forever, and for want of such heirs males then it is my will that the said Land and all the appurtenances , be and remain to my son John Baily and his heirs males forever.
      Item. I give unto Anne Smith my daughter, one small Iron Pot and a wearever panne and my gray mare, branded S.B. to her and her heirs forever.
      Item. I give unto Anne Bailey daughter of Stephen Bailey, deceased, one heifer called Doll, and all her female increase, the said heifer to be and remain in the hands of John Bailey and delviered with all the female increase to the said Anne at 16 years of age or day of marriage which first happens and the male increase to John Bailey for his trouble; but in case the said Anne die before the said Time, then the said Heifer and Increase to be divided among John Bailey's children.
      Item: I give unto Mary Walker daughter of William Walker deceased one heifer named Moll and all her increase to her and her heirs or assigns forever to be delivered to her immediately after my death.
      Item. I give unto my daughter Mary Smith one shilling.
      Item. I give unto my son John Bailey, Anne Smith and William Bailey all the residue of my personal Estate whatsover, to be equally divided amongst them at their own discression immediately after my decease, Lastly I make constitute and appoint my loving sons John Bailey and William Bailey Exors. of this my last Will and Testament.
      In witness whereof this my last will and Testament. In Witness whereof I have hereunto sett my hand and seal the 8th day of December 1696. Sealed and published in presence of us Stephen Baly (Seal) Henry Rosse Samll Damanville Thomas Bee. Westmoreland set.
      At a court held for the county the 23 day of February 1697. The Last Will and Testament of Stephen Baily proved by the Oath of the witnesses threto subscribed and a probate there of granted to John Bailey and William Bailey the Executors therine named, and or to be Recorded. Recorded Deed Book No 2 at page 129.

      DW 8-228, 2/5/1733/4, 2/26/1733/4. JOHN BAILEY, THE ELDER of Cople Parish to Son JAMES BAILEY Gift 5s 50 acres in the forest of Cople between the Yeocomico and Nominy, ? . . . On Jan. 10, 1679, Searle rightly relinquished all his right title and interest in the 50 acres to THOMAS MOORE and MARGARET his wife by deed bearing date Feb. 5, 1683, who conveyed theland to MILES GOREHAM and SUSANNAH his wife, which by their endorsement on the back of thedeed September 13, 1684 did convey and make to STEPHEN BAILEY the fifty acres of land whichpassed under STEPHEN BAILEY’s will of 1697.

      "Page l22-122a 23 April 1672. William Walker Senior of Westmoreland County, planter, unto Stephen Bailye of same, planter. For a valuable consideration. 133 acres in or about Yeoomicoe Neck, bounding south east upon the River of Yeocomicoe. southerly upon the land of Robert Bennett, northerly upon the land of Richard Tedwell and northwest upon another tract of land of Walker's which 133 acres bounds alsoe upon the land which Stephen doth now live upon and doth divide the land of Stephen from one tract which Walker was this yeare about to seate, which said land is part of a greater tract given by William Walker, deceased, unto William Walker, now the Elder, he now having a younger brother called alsoe by the said name William Walker Junior, but the sonn of another wife, which said William Walker, deceased, had who now is wife unto the said Stephen.
      Likewise William Senior doth relinquish all right to a tract of land which his father did give unto his brother William Walker Junior, being 239 acres, unto William Walker.

      This is from Dorman's abstract of Westmoreland deeds. It was found in a book of lost deeds which are not recorded in Westmoreland. There is a gap in the deeds there from 1671-1691. The younger brother, William noted in the deed owned the life estate property, about 239 acres tot he east of this tract.

To Robert Sparrow of Westmoreland "100 acres in Cople Parish, part of a patent granted to William Walker, late of this county, deceased, and by the last will and testament bequeathed to WILLIAM WALKER his son who sold 100 acres to Samuel Earle" who sold to Thomas Duran whose will passed it to Ball. "[B]OUNDEN BY LAND OF WILLIAM BAYLY being part of the said patent, on the land of Robert Bennett and William Garland and on the head of Blyses' Creek . . ."
