      IN THE NAME OF GOD Amen. I JOHN ELLETT of South Farnham Pish. in ye County of Essex being very sick & weak butt of perfect sence &, memory doe make this my last Will & Testament in maner & form following. this First day of July 1698. First I give & bequeath my Soul unto Almighty God hoping for pardon of all my sins through the only meritts of my blessed Lord & Savour Jesus Christ all ye last Day; my body I give unto my Mother, ye Earth, to be desentllye & Christianly interred by my Exr. or Exec. hereafter named shall think fitt & my worlly estatt wch: God hath lent me after my just debts & funerall charges are sattisfyed I give in maner following:
      21y , I give unto my loving Wife, EALES ELLETT, my Plantacon & all my land that I am now possessed wth: all or any ways belongs to me during my sd: Wifes life wthoutt ye lett or molestation of any pr:son whatsoever & after my sd Wifes departure oust of this life then ye sd land to be my Daugher, JOANE ELLETTs, during her life & after her decease ye sd land to be my two Daughters, EALES ELLETT & FRA: ELLETT, to be equally devided both for goodness & qntity, to them & their heirs for ever
      3dly I give unto my Daughter, ELIZABETH PAINE, one Cow yeareling with all her increase for ever to her & her heres for ever & for all ye rest of my worly estate I give unto my aforesd. Loving Wife for to be all her own disposal! as she shall think fitte & I doe appoynt & ordaine my Loving Wife my whole & sole Executorix of this my last Will & Testament & this to cuts of all former Wills Deeds & Giftes whatsoever As Witnesseth my hand & seale ye day & year above written

      KNOW ALL MEN by these presents that wee ALICE ELLETT, JNO: BROOKE & RICH: HUTCHINS of ye County of Essex are held & firmly bound unto JNO: CATLETT Gent., Presedent of ye sd County Court in ye summ of Twenty thousand pounds of tobo: we bind our selves wittness our hands & seales this 10th day of July 1700
      The Condition of this obligacon is that if ye above bound ALICE ELLETT who in Court held for Essex County ye daye & year abovesd, obtained a Probate of ye last Will of JNO: ELLITT deced shall at all times hereafter p:form & satisfie all such Legats. as therein expressed & wt:soever ye Law enjoyns in such cases Then ye above obligacon to be void othewise to stand in full force

      THIS INDENTURE made the 17th day of January in the yeare of our Lord 1687/8 and in the second yeare of the Reigne of our Sovereigne Lord James the second &c. Between TOBIAS MICHELBURROW of MIDDLESEX COUNTY, Plantr., of the one part and JOHN ELLIOTT of Rappa: County, Plantr., of the other part Witnesseth that the sd TOBIAS MICHELBURROW for and in consideracon of Two English men Servants and One thousand pounds of good sound sweet sensed tobacco and caske to him already paid hath sold unto JOHN ELLIOTT his heires forever that One hundred acers of land being in Farnham Parish in Rappa. County of the South side of Rappa: River which sd land is conteyned within the severall bounds and distances following, that is to say, Beginning at a decayed marked red Oake standing upon the side of a bank of Rappa: River, thence running through part of an old field joyning on the land of WM. BOWLER along a line of marked trees into the Woods to the POPLAR NECK SWAMP and so up the sd Swamp its severall courses and up a branch of the same to a Plantacon belonging to THO: PAYNE joyning to the sd Plantacon alonge the edge of the cleared ground to a line of marked trees dividing the said Three hundred acers of land from the land of Majr: HENRY SMYTH deced, thence alonge the sd line to a large marked Oake on the branch of Rappa: River side to the first mentined Place and was granted to the sd TOBIAS MICHELBURROW and his heires forever by THO: PAYNE by his Deed Indented (blank) day of (blank) 168(blank) together with all houses orchards woods cleared ground and appurtinances whatsoever to the sd premisses belonging to be held as fully and amply as the same is granted to the sd TOBIAS MICHELBURROW by the sd THOS: PAYNE To have and to hold to the sd JOHN: ELLIOTT his heires forever and sd TOBIAS MICHELBURROW at any time at the request and charges in the Law of sd JNO. ELLIOTT make or cause to be made unto the sd JNO. ELLIOTT further and other lawfull assurances in the Law for the further better assuring of the sd land as by sd JOHN ELLIOTT his heirs or their Councell learned in the Law shall be reasonably required In Witness whereof the sd Parties have sett their hands and seales the day and yeare above written. This Deed was signed sealed and executed the 31st day of March 1688

      KNOW ALL MEN by these presents that I RICHARD HUTCHINS of South Farnham Parish in Essex County in Virga: doe hereby oblige me & my heirs to permitt & suffer Mr. EDWARD ADCOCK and his heirs &c. to have a free passage through ye land I purchased of THOMAS PAYNE leading to ye River; with ye same priviledge & way he formerly enjoyed, And also am further obliged together with my heires &c., so to manage ye affairs of ye sd THOMAS PAYNEs obligacon to find his Father in Law, JOHN ELLET, Timber off ye land I have purchased for ye use of ye sd ELLETs Plantacon & that ye sd THOMAS PAYNE or his heirs shall aver receive any damage, but be fully & absolutely saved harmless and indemnified for or by reason of any such obligacon or covenant he made tohis said Father in Lawl; I ye sd RICHARD HUTCHINS and my heirs being liable to exempt & free ye sd THOMAS PAYNE & his heirs &c. from all molestations he or they may sustaine upon ye penalty of paying all such charges as may be occasioned to him or them thereby, As Witness my hand & seale this 4th day of February 1694
