      - Rappahannock County Court 8th of January 1690/1
      - ROBERT PAYNE brought his action in this Court against RICHARD SHIPWAY SENR. and declares that EPHRODITUS LAWSON deced, Grandfather to the Plt., did in his life time stand seized in his Demesne as of fee of in & to a certaine tract of land situate and being in Rappa: County on the South side thereof conteyning Two thousand acres wch: sd Land came & descended to ELIZABETH PAYNE, Mother of the Plt. and Daughter and sole lheire of the sd EPHRODITUS LAWSON, And so to the Plt. as Son & heire to the sd ELIZABETH; And further sheweth that the sd RICHARD SHIPWAY hath unlawfully entered in and upon the prmises and doth wrongfully keep & withold from him, the Plt., his free hold & Inheritacne, And therefore prayed that their Majties. Writt of habere fatias seizeinam might be awarded to the Sheriff to put him, the sd ROBERT PAYNE, into peaceable possession of the sd land wth: appurtinances. The Deft. sayes that he cannot plead to the Plts. declaracon for want of Certainty, for that the Plt: in dereigning his Title doth not sett forth that the sd ELIZABETH PAYNE, Daughter and sole heire of the sd EPHRODITUS LAWSON & Mother to the Plt., was every seised of the Prmises. And further sayes that it is a Rule in Law that whosoever claime an Inheritance must claime from the person imediately last seized wch: the Plt. in his Declaracon doth not; which plea this Court having over ruled and for as much as by Patent bearing date the 22d day of May Ano. 1650 granted to the sd EPHRODITUS LAWSON for Two thousand acres of land situate & being on Rappa: River on the South side thereof, beginning at a marked white Oak standing on the lowermost point of a great ISLAND and running for length S:S:W: 320 poles cross a Creek called LAWSONS CREEK and for breadth from the sd menconed white Oake one thousand Poles by or nigh on the Main River side taking in the Marsh land that fronteth in before the sd Land unto a marked red Oake standing by the Edge of the high ground side to the Maine River and so running againe for length S:S:W: 320 poles including the sd Quantitie. It evidently appeared to the Court that the sd EPIPHRODITUS LAWSON was lawfully seized of the land aforesd. nd for as much as the sd ROBERT PAYNE hath duly proved himselfe lawfull heire to the sd ELIZABETH, who was Daughter and sole heire to the sd EPHRODITUS , the Court have ordered that their Majties: Writt of habere fatias seizeinam be directed to the High Sheriff of this County or his Deputie to put the sd ROBERT PAYNE in quiet peaceable possession and seizen of the sd Land with the appurtinances, And that the Deft. pay all cost of suit
