Currently I don't know the parents of Clement Mattingly, b. 1808 and died
2/7/1865 (not 1867). Hilary descends from him via his first wife, Elizabeth M. Wheeler.

The following courtesy of Tom Jennings:

St. Mary's County Circuit Court (Equity Docket) 1862-1880, J.A.C.#2, p475- 485 (My abstract). 3/18/1865 John H. Mattingy filed a bill of complaint stating that his father Clement Mattingly died leaving among other lands, "Tro Hall" (Frog Hall) and "Bedlam Neck" containing 118 acres and " part Collinswood" of 50 acres and a tract purchased by him from John B. Raley and wife commonly called "Hatches Thicket" of 62 and 45/100th acres. Clement Mattingly by his will executed 2/2/1865 devised land to your orator, Martha Matilda Mattingly, and Zachariah Thomas Raley as tenants in common and a dower right to his widow, Emily Mattingy. Orator states it would be in the best interest of all parties to sell land and divide the proceeds. Zachariah Thomas Raley is a minor under age 21.

thirds and my funeral expenses and my debts taken out. Item- To daughter, Elizabeth Ann Morris, wife of J. W. Morris, that tract of land where they now reside, which I purchased from W. T. Hammett called "Collinswood" bounded by the elm forrest on the east and south and by the farm owned by D.R.P.Blakistone on the north, and by the land purchased by me from John B. Long on the west, containing 50 acres. At her death, land to descend to my 3 grandchildren, Mary Florence Morris, Wm. Thomas Morris, and Elizabeth L. Morris. Also devises $1,000 to Elizabeth Ann Morris and her decease to be divided between her present children now living. My executor shall not pay anything devised into the hands of her husband, J. W. Morris.

Item: I devise unto my son John Mattingly, daughter Martha Matilda
Mattingly, and grandson, Zachariah Thomas Raley residue of my property consisting of property purchased from W. T. Hammett (that was) not given to my daughter, Elizabeth Ann Morris, and that tract of land from John B. Long divided between the three.

Item: my personal estate divided between my son, John Mattingly, daughters Martha Matilda Mattingly and Elizabeth Ann Morris, and grandson, Zachariah Thomas Raley. My friend and neighbor, Richard Colton to be sole executor.

11/24/1865- Court decreed land to be sold and appoints James T. M. Raley as Trustee for the sale and on 2/20/1866 land sold to Daniel J. Payne for $4,050. On 2/21/1866 Emily Mattingly filed for her dower rights.
