      I, Thomas Barnes of CC, hereby release Pryor Smallwood and Richd Hodgson, both of CC, from any acts or actions or causes of actions that might arise upon their being securities upon a testamentary bond for the due administration of the estate of Thomas Plunkett, decd, the subscriber being a legatee of the decd.       Thomas Barnes, by his petition, sets forth that he is seized of a tract of land in CC on the south side of Mattawoman main Swamp, called Middletons Kindness, the bounds whereof being something uncertain and impaired, he prays the Court to appoint Commissioners to examine witnesses and take their depositions to prove and perpetuate the bounds of sd land. Ordered that Commission issue to Saml Hanson, Richard Gambra, William Eilbeck, and Edward Brawner, Gent, to examine witnesses concerning the premises.

      Pursuant to the order of last Aug CC Court, Commission issued to examine witnesses touching the bounds of a tract of land called Middletons Kindness, in the possession of Thomas Barnes, as follows - To Samuel Hanson, William Eilbeck, Edward Brawner, and Richard Gambra of CC, Gent, (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land). Thomas Barnes, seized of a tract of land called Middletons Kindness, in CC on the south side of Mattawoman Main Swamp, did, on Aug 11 in the 27th year of our Dominion, prefer his petition in writing to CC Court before Robert Hanson, Gent, and his Associates, CC Justices, for Commission to examine witnesses to prove and perpetuate the memory of the bounds of sd tract of land.

      And now here, William Eilbeck and Edward Brawner, return the Commission afd with the following certificate and depositions, viz -
      Oct 26, 1741. We certify that we have executed the within Commission, as may appear by the depositions thereunto annexed. Signed - Will Eilbeck, Edwd (T his mark) Brawner.
      We met at Thomas Barns' Quarter on Oct 15, 1741, according to appointment, and being carried from thence into the woods to a locust, and several other trees, being duly qualified, we proceeded to take the following depositions, viz -

      John Garner Jr, age about 49, declares that about 20 years ago, John Coffer Sr, decd, told this deponent that this locust that we are now at, being now fallen down, was a bounded tree of a tract of land belonging to Thomas Plunket and Francis Coffer, and further says that John Coffer Jr, decd, to the best of his remembrance, has been with him at the above mentioned locust and told him it was a bound tree of the afd land, and further says that about 15-16 years ago, at the request of Francis Coffer, part owner of sd land, this deponent was brought in company with John Clements Sr and several others to a large hickory which we are now at, standing about 80 yards distant from some apple trees where Thomas Plunket formerly lived, and sd John Clements, who came there at the request of sd Francis Coffer to show the sd Coffer the dividing line of the afd land between the sd Francis Coffer and Henry Barnes, the sd Barnes then held Plunket's part of sd land and the afd Clemence showed the above mentioned hickory for a dividing line between sd Francis Coffer and sd Barnes, and from the sd hickory carried them to a white oak then standing but is now cut down, it being about 100 yards from the now dwelling house of John Garner Jr, and the afd Clemence showed this to be the dividing line from the sd hickory to the sd white oak between the sd Francis Coffer and Henry Barnes.

      Henry Coffer, age about 37, declares that about 20 years ago, being along with his father, John Coffer, getting a timber tree, the stump of sd timber tree being about 50-60 yards from the locust mentioned in John Garner's deposition, that the sd John Coffer showed this deponent a locust tree, and to the best of his remembrance, fairly bounded on 2 sides for a bound tree of Plunket's lands, and believes the locust mentioned in John Garner's deposition to be the tree or stood very near that place, and further says he heard his father say it stood within his father's line, and further says that about 15-16 years ago, at the request of Francis Coffer, who was part owner of sd land as he understood by sd Coffer, and John Clemence Sr, this deponent, was in company with sd Francis Coffer, John Clemence Sr, and John Garner Jr and others, and the sd John Clemence Sr showed the hickory which we are now at, being the hickory mentioned in John Garner's deposition; also the white oak mentioned by John Garner to be the division between sd Francis Coffer and Henry Barnes referring to John Garner's deposition.

      Then adjourned until Oct 26 and met at the above mentioned place and took the following deposition, viz -
      Benjamin Gardiner, age about 38, declares that to the best of his remembrance, near 20 years ago, Francis Coffer came out of Virginia to get John Clements Sr to show him the bounds of a tract of land which sd John Clements had some time before sold to Thomas Plunket and the afd Coffer, and says that the afd Clemence brought the sd Coffer and this deponent with several others in company into the place we are now at, or to the best of his remembrance, within 10-15 yards of this place, and told them that there stood a black oak or swamp oak, but he does not perfectly remember which, but that the sd Clemence told them that it was a bound tree of the above mentioned land, but he does not remember whether he told them it was the first bound tree of the sd land or not, and further says he carried them to the hickory we are now at, being the hickory mentioned in John Garner's and Henry Coffer's depositions, and told them that from sd hickory to the white oak mentioned in the afd depositions, was the dividing line between Francis Coffer and Plunket, and when at the before mentioned hickory, Francis Coffer cut a large hickory switch to whip the sd deponent, and either did hit him with it or tried to hit him, and told him to remember the sd hickory was a dividing tree between the sd Coffer and Plunket, and further says he understood by them that at that time, the south end of sd land from sd hickory was Plunket's, and the north end, Coffer's.
