Memorandum that the special petition of John Eversfield of PG, Gent, preferred to the Justices of Page Court on Jun 29, 1736, is as follows - To Messrs Robert Bradly, Walter Brooke, William Beanes, and Hyde Hoxton of PG, Gentlemen, greeting. Whereas John Eversfield of PG, seized of 3 tracts of land contiguous to one another, lying in PG, called Hackhomheath, Sewalls Addition, & Drury Lane, did, last Jun 22, prefer his petition to our County Court held at Upper Marlborough Town in Page before Leonard Hollyday, Gent, & his associates, for commission to examine witnesses to prove and perpetuate the memory of the bounds of sd tracts of land, know that we have given you (not being any way related to the petitioner or any contiguous proprietor nor interested in sd land) authority to examine all witnesses which shall be nominated by you by the afd petitioner or other concerned person as to their knowledge of the bounds of the tracts of land afd. Signed Jun 25, 1736 - A Contee, Clk. Oct 21, 1736.

Walter Brooke & Hyde Hoxton, Gent, qualified themselves before Thos Clagett. On the 4th Tuesday of Aug, [1736], Brooke and Hoxton return to the Page Court Justices as follows: we met on the lands afd on Dec 24, and examined John Miller, Wm Beanes, Caleb Norris, Charles Drury, Thomas Brooke, & on Feb 7, examined Caleb Norris & Wm Beanes, & on Jan 3, examined Leonard Piles, & John Boone. Signed - Walt: Brooke, Hyde Hoxton. Dec 24, 1736.

John Miller, aged about 68, says that about 4 or 5 years ago he was summoned to prove the bounds of Major Sewalls land & that where now stands a bounded stone marked IE1736, was where the bounded tree of sd Sewalls land formerly stood, and the reason which induced him so to understand was that he lived sometime near it & heard Mr. Roger Brooke say that the red oak was a bounded tree of Major Sewall's land, and at the time sd Brooke told him so, the tree was dead, which tree this deponent knew 7 years before. Signed - John Miller.

William Beanes, aged about 53, says that about 3 or 4 years ago, he was appointed commissioner to prove the bounds of Hackthomeheath & the witnesses summoned were Messrs John Miller & Jno Boone, who deposed that where now stands a bounded stone, marked as above in Jno Miller's deposition, was deemed to be a bounded tree of the afd land, and a bounded tree of Brook - F- . Signed - W Beanes. Dec 24, 1736.

The afd Mr. Beanes decares that a white oak near a small branch which falls into Brooke Cr was swom by Caleb Norris to be a bounded tree of Major Sewalls land (called Hacthomeheath). Signed - WBeanes Page 86. Dec 24, 1736.

Caleb Norris, aged about 61 years, concerning the white oak in Mr. Beane's deposition, about 37 years ago, he heard Laurince Russell & Willm Conley, being at the afd tree, say that this was a bounded tree of Major Sewalls land. Signed - Caleb (CN his mark) Norris. Dec 24, 1736.

Charles Drury, aged about 60, concerning the white oak mentioned in Mr. Beane's deposition, says that he has been told by sundry persons that the sd white oak is the 2nd bounded tree of Hackhorneheath & the 1st bounded tree of Drury Lane. He further says that a knotty, double-bodied bounded hickory standing on the side of a hill, about 20 paces from the road where now is fixed a stone marked I to be a line tree of Drury Lane and was told him by Charles Boteler that it was one of the bounded trees of his land. Signed - Charles Drury. Dec 24, 1736.

Mr. Thos Brooke, aged about 53, concerning his knowledge of the bounds of Sewalls Addition, says that about 15 years ago, he was desired by Mrs. Elizabeth Major to ride with her son to see the bounded tree of her land & at her request, this deponent came with her son to a bounded white oak on a hill near the mouth of a Spring Branch, which oak, was told him by her sd son, was a bounded tree of his mother's land, purchased by Philip Lee, Esq, at which white oak there is now fixed a stone marked 1. Signed - Thos Brooke. Dec 24, 1736.

Mr. William Beanes, aged about 53 years, concerning his knowledge of the bounds of Sewalls Addition, says that he has been told by Caleb Norris that the bounded white oak in Mr. Brooke's deposition, is a bounded tree of Major Sewalls land. At the same time this deponent says he knows nothing of a bounded red oak standing in an Indian field deemed to be the 3rd bounded tree of Hackthornheath. Signed - WBeanes. Dec 24, 1736.

Caleb Norris, aged about 61 years, concerning his knowledge of the bounds of Sewalls Addition, says that he has been told that the afd white oak described in Mr. Brooke's deposition, is a bounded tree of Major Sewall's land of Balls Good Luck, of Hides land called Cuckholds Nest, & of the land of Roger Brooke Sr, now in the possession of Philip Lee, Esq, and at the same time, this deponent says he knows nothing of the afd bounded red oak. Signed - Caleb (CN his mark) Norris. Page 87. Feb 7, 1736/37.

Sd Caleb Norris, being sworn near the entrance of the woods on the right hand of the Road that leads to Mount Calvert on the side of a hill near Charles Botelers, says that he never knew of any bounded tree of the Locust Thickett, or any other tree that stood in that place, and that this deponent never showed Charles Carroll, Jno Eversfield, & Robert Warnsley, any such place. Signed - Caleb (CN his mark) Norris. Feb 7, 1736/37.

Caleb Norris, being sworn at the place described in Leonard Pile's deposition, says that some years past, he saw a sp_ oak standing on a knoll in an Indian field, but does not now remember the particular, nor was he ever told that it was a bounded tree, and he says he never showed the afd place to Messrs Charles Carroll, Jno Eversfield, & Robert Warnsley, or told them that the bounded tree of Craycrofts Right stood in the place above described. Signed - Caleb (CN his mark) Norris. Feb 7, 1736/7.

The deposition of Mr. Wm Beanes, aged about 53 years, says that a hickory stump on a hill side near an old field was a bounded tree of Craicrofts Right, as he has been informed by his brother, Christopher Beanes and Francis Piles. Signed WBeanes. Jan 3, 1736/37. Leonard Piles, aged about 34 years, being sworn at a stooping hickory on a hillside near Sarah Twogood's plantation, says that he has heard his father say, thereabouts stood a hickory, the 2nd bounded tree of this deponent's land & it was the 3rd bound tree of Craycrofts Right. Signed - Leonard Piles. Jan 3, 1736.

John Boone, aged about 58 years, being examined concerning the bounds of Hackthornheath, says that a certain white oak near an old road on the brink of a hill, was always esteemed as a bound tree of Major Sewalls land, and that Wm Connly told him it was a bound tree of the land of the afd tree standing bear a small branch where now is a stone marked 1. Signed - John Boone. Jan 3, 1736.

Sd John Boone, being examined about the bounds of Hacthomeheath, says that a certain mulberry stump on the brink of a hill where now is fixed a stone marked I on the SE side, on the NW IE1736, formerly stood a bounded tree of Major Sewalls land and of two other tracts of land of Roger Brookes, as this deponent was informed by James Brooke, who at the same time told him that his father, Roger Brooke's people, fell sd bounded oak, at the stump of which oak, sd James Brooke planted an oak sapling & bounded the same with several notches at the instance of Major Nicholas Sewall, and this deponent saw the same sapling standing several years afterwards. Signed - John Boone. Page 88. Jan 3, 1736/7.

Leonard Piles, aged about 34 years, being swom concerning the bounds of a tract of land called Craycrofts Right, says that about 26 years ago, his father showed him a bounded tree and told him it was a bounded tree of Cicells land. Some time last summer, this deponent was riding over the afd land with Robert Warnsley, who showed this deponent a place where a bounded tree stood, being in a valley at the edge of an Indian field near a small black gum, and told this deponent that Caleb Norris showed him, Jno Eversfield, & Charles Carroll the same place, and told him that the bounded tree afd stood there. This deponent further says that he has often heard his father say that the afd bounded tree stood on the same side of the hill & has been told since by his brother, Francis Piles, that his father went with him and showed him the afd bounded tree and told him that it stood below an Indian field and near the Great Branch. Signed - Leonard Piles. Jan 3, 1736/7.

Sd Leonard Piles, being swom at a dead hickory standing on a little hillside about 70 yards within the woods from Mr. Beanes plantation, says that he has been showed the afd tree by his father, who several times told him it was a comer tree of Craycrofts Right and that the line from that tree carried them to another hickory, a 2nd bounded tree of his father's, now in possession of this deponent, called Croome. Signed - Leonard Piles. Recorded Aug 31, 1739.

1744-1753 Charles County, Maryland Land Records; Liber Z#2 [TLC]; Page 190. At the request of the Revd John Eversfield, the following deed was recorded on Nov 27, 1747.
Oct 31, 1747 from John Howard of CC, planter, to The Revd John Eversfield, Rector of St Paul's Parish in Prince Georges County, Clerk. Said John Howard, by a deed dated today, conveyed to sd Eversfield, a parcel of land, being part of a tract called Brooke Chance, lying in Prince Georges County, and bounded by Brooke Cr, a tract of land taken up by Thomas Brooke, Esq, deceased called the Vineyard, Mattapony Main Run which falls into Brooke Cr, Mattapony Main Run which goes up by the plantation where John Howard decd lately dwelt, containing about 208 acres, in consideration of 40 £sterling & 5000 lbs tobacco. But the land being by the Honor Th Brooke, Esq, entailed on Thomas Howard and the heirs of his body and others, whereby it became unalienable to vacate, which sd Thomas Howard & Rebecca Howard, 2 of the tenants tail, had by fine & recovery the entail cut off, and thence conveyed it to Charles Craycroft, and Craycroft conveyed it to Thomas Howard & sd Thomas Howard conveyed it to sd John Howard. But sd Eversfield not being satisfied with the manner of docking the entail & fearing that some of the heirs in tail may hereafter start lawsuits against him for the recovery of ad land, insisted on as well as covenanted and agreed with the sd John Howard for anquivaten land security for the warranting and defending of the right and title of the land in fee simple to him forever. Now this deed witnesses that John Howard, for 40 £sterling and 5000 lbs tobacco to be paid in the deed afd, and for securing to Eversfield an equivalent satisfaction in land in case he should be ousted from the part of a tract called Brook Chance afd, has granted to John Eversfield, all that part or parcel of land, being part of a tract of land called the Three Brothers, now in the possession of sd John Howard, situated in CC on or near a Cr on Potomack River called Batchellors Cr, bounded by William Stevens Howard's part of the tract called the Three Brothers afd, containing 125 acres. If John Howard shall peaceably enjoy the tract of land called the Three Brothers, and now in sd Howard's possession until Evensfield be legally deprived of the parcel that is part of a tract called Brooke Chance sold him by sd John Howard, then it may be lawful for Evensfield to enter upon and enjoy that part of land being part of a tract called the Three Brothers, now in sd Howards possession, provided further that if sd John Howard at any time hereafter gets the entail of Brooke Chance cut off by an Act of Assembly of Maryland, that then Eversfield shall release this deed and John Howard agrees with Eversfield that if Eversfield is ousted, John Howard will give Eversfield possession of that part of a tract called The Three Brothers, now in sd Howard's possession, & will warrant the same to sd Eversfield. Signed - John Howard. Wit - Richard Keene, John Contee. Keene and Contee are Prince Georges County JPs.

Whereas John Eversfield, Jr. by his petition to our agents for management of land affairs on February 18, 1733 obtained out of our land office a special warrant to resurvey two continguous tracts vizt; "Single Gore" originally granted to Thomas Brooke on September 27, 1680 for 70 acres under new rent; and the "Double Gore" originally granted to William Conely on October 10, 1708 for 37 acres under new rent. In pursuance of which a warrant a resurvey was made and a certificate returned, the whole containing 206 acres, 99 acres whereof was said to be surplus included for which the petitioner paid and satisfied unto Daniel Dulaney, esq, our then agent and the sum of 12 pounds, 16 shillings and 3 pence half penny sterling being as well for the arrearages of rent from the time of the original grant and renamed to "Eversfield Map of Italy". Since the obtaining of which grant he had discovered some errors in the resurvey, that it did no contain the quantity of lands specified.
