Ex.d This Indenture made the twenty first Day of October
in the thirty fourth Year of the Dominion of the Right Honourable
Charles Absolute Lord and Proprietor of the Province of
Maryland and Avalon Lord Baron of Baltimore and in the
Year of our Lord God One Thousand seven hundred and forty
Eight Between Thomas Stoddert of Prince Georges
County in the Province of Maryland Gentleman of the One
Part and Thomas Marshall of the said County and
Province Gentleman on the Behalf and out of the
Natural Love and Affection which he hath for his Daughter
Mary Maccubbin Now the Wife of Zachariah
Maccubbin of Anne Arundel County Gentleman on the other Part
Witnesseth that the said Thomas Stoddert for and in Consideration
of the Sum of One hundred and Eighty four Pounds fourteen
Shillings Sterling Money to him in hand paid or Secured
to be Paid by the said Thomas Marshall on the Behalf of
of his Daughter Mary Maccubbin as afs.d at or before the
Sealing and Delivery of these Presents and for divers
other causes and Consideration him thereunto moving Hath
Given Granted Bargained Sold Aliened Enfeoffed and Confirmed
(and) and by these Presents Doth Clearly and Absolutely Give Grant
Bargain Sell Alien Enfeoff and Confirm unto the said Mary Maccubbin
Daughter of the afs.d Thomas Marshall and Wife of the afs.d
Zachariah Maccubbin and the Heirs of her Body Lawfully begotten for
Ever or in Default of such Issue to Thomas Hanson Marshall (son
to the afs.d Thomas Marshall) his Heirs and Assigns for Ever all
his Right Title Interest and Estate whatsoever ^in^ and to all that
Parcel of Land being part of a Tract of Land called Friendship
lying in Prince Georges County in the Province afs.d Beginning at the
End of a West line being Eighty Perches in length and the thirteenth
line of the afs.d Friendship and Running from thence North one
hundred and seventy six Perches West two hundred and Eighty Perches
South West Sixty four Perches South South East two hundred and
sixty Perches North thirty one Degrees East one hundred and thirty
five Perches then East to the Beginning Containing and laid out for
three hundred and Seventy one Acres more or less as also all that part
of a Tract of Land lying in the County and Province afs.d being part of a
Tract of Land called Pritchetts Purchase Beginning at the End of the
South Line of a Tract of Land called Huntington and Running thence
East One hundred and twenty four Perches South thirty one Degrees East
Ninety Perches West two hundred and twenty three Perches North
thirty Degrees and thirty Minutes East fifty six Perches South Eighty
one Degrees West sixty three Perches North Seventy one Degrees
West forty six Perches then North to the Beginning Containing and
laid out for Eighty one Acres and a half Acre more or less together
with all Messuages Tenements Dwelling Houses Barnes Stables
Gardens Orchards Out Houses Profits Commodities Advantages
and Appurtenances whatsoever to the same belonging or in any wise
appertaining and all Patents Deed Writings and Evidences
(touching) touching the same or any part thereof To have and to
hold the said Tracts or Parcells of Land and Premisses afs.d
with the Appurtenances unto the said Mary Maccubbin and the
Heirs of her Body Lawfully begotten and on Default of such
Heirs to Thomas Hanson Marshall his Heirs and Assigns for
Ever as in manner and form is before Expressed and the said Thomas
Stoddert doth for himself his Heirs Executors and Administrators
Covenant Promise and Agree to and with the afs.d Mary
Maccubbin and the Heirs of her Body Lawfully begotten and in
Default of such Issue to and with the afs.d Thomas Hanson
Marshall his Heirs and Assigns and every of them by these
Presents that the said Thomas Stoddert at the time of ^the^ Sealing
and Delivery of these Presents is Seized in his Demesne as
of fee of and in the before mentioned to be Bargained Premisses
with the Appurtenances of a good sure and Indefeazable
Estate of inheritance in it fee Simple free and discharged of
all Incumbrances whatsoever and is the sure and perfect
Owner of the said hereby Bargained Premisses with the
Appurtenances and hath in him full Power good Right and Lawfull
Interest and Authority to Grant Bargain Sell and Assign over
the same Premisses unto the said Mary Maccubbin and the
Heirs of her Body Lawfully begotten and in Default of such Issue
to Thomas Hanson Marshall his Heirs and Assigns for Ever in manner
afs.d and that the said Thomas Stoddert and his Heirs the same above
Bargained Premisses with the Appurtenances to the said Mary Maccubbin
and the Heirs of her Body Lawfully begotten and in
Default of such Issue to the said Thomas Hanson Marshall his
Heirs and Assigns for Ever shall and will Warrant and for Ever
Defend the said Parcells of Land and all other the Premisses with
their Appurtenances and every part and Parcell thereof against him
the said Thomas Stoddert his Heirs Exors and Adm.rs and all &
(every) every other Person whatsoever And that the said Thomas Stoddert
his Heirs Exors and Adm.rs shall and will from time to time and at all
times hereafter at the Reasonable Request and proper Cost and Charge
in the Law of him the said Thomas Marshall Mary Maccubbin or such
Heirs as above mentioned make do Execute or cause to be done Executed
and acknowledged all such other or further Act or Acts thing or things
Device or Devices Conveyance or Conveyances Requisite for the better
and more sure making over the said Lands and Premisses to the said
Mary Maccubbin and the Heirs of her Body Lawfully begotten
and in Default of such Heirs to Tho.s Hanson Marshall his Heirs &
Assigns for Ever as shall be Devised Advised or Required by the said
Thomas Marshall Mary Maccubbin the Heirs of her Body
Lawfully begotten or in Default of such Issue by the afs.d Thomas
Hanson Marshall his Heirs or Assigns or his or their Counsel
Learned in the Law In Witness whereof the said Thomas
Stoddert have hereunto set his Hand and Seal the Day and
Year above Written Thomas Stoddert Seal

On the Back of the aforegoing Deed was thus Endorsed
viz.t Prince Georges County fs Octo.r 21.st 1748 Came Thomas
Stoddert and Janett his Wife and acknowledged the Lands and
Premisses with the Appurtenances within this Indented Writing
mentioned Given Granted and Confirmed to be the Right Estate
of the within named Mary Maccubbin and Thomas Hanson
Marshall to the use and behoof and intent within mentioned
and declared and the said Janett being by us privately Examined
out of the Hearing of her said husband did Declare that
she made the within acknowledgment Willingly & Freely and
(without) without being Induced thereto by fear or threats or Ill Usage
of her said Husband or fear of his Displeasure

Charles County Land Record Book A#2, 1752-1756; Page (338). Deed of Gift. I, Thomas Marshall of CC, for the natural love I have for my grandson, Thomas McCubbin, son of my daughter, Mary McCubbin, late decd, and for divers other good causes, I give him the following Negroes {over and above 3 Negroes already given to him, (viz) Boy Ned, boy Sam commonly called Doctor, and girl Sue, as per deed of gift dated Oct 9, 1749, in the case of Thomas Marshall Jr. The afd Negroes are now in the possession of Zach:a McCubbin, father to the sd Thomas McCubbin. I further give my grandson, afd Thomas McCubbin, Negro boy Harry, girls Sarah Mary, & their increase. The Negroes are to be delivered to my sd grandson when he arrives at age 18; if he dies before age 18, the afd Negroes to be delivered to his brother, Zach:a McCubbin. If ad Thomas & Zachariah McCubbin (brothers) die before age 18 or without lawful issue of their body, then my son, Thomas Hanson Marshall to have the afd Negroes and their increase- Signed Jan 25, 1755 - Thos Marshall.
