      James Russell, born about 1690, a "Mallatto belonging to Mr. Notley Rozier," petitioned the Charles County court for his freedom on 13 March 1721, setting forth that he was the son of a white woman and had reached the age of thirty-one [Court Records K-2:236]. The Prince George's County court called him a "Malatto Man" on 26 August 1729 when it ordered that he take his three children who were with John Pritchett into his own care [Court Record 1729-30, 136].

      CC, Oct 27, 1735. The deposition of William Whitter of CC, aged about 57 years, declares that about 26-27 years since, being present at the surveying of Col. John Contee's land at Portobacco, this deponent heard Nicho: Cooper declare that a marked white oak standing by a marsh side on the east side of Portobacco Creek near a small branch, was the beginning tree of the divisional line between Mr. Rozer and Mr. Chandler, and is the tree whereon he now lays his hand, and that the Surveyor ran a line from it.       The deposition of Ralph Shaw of CC, aged about 50 years, declares that about 8-9 years since, Mr. William Chandler, then possessor of Chandlers Hope, told this deponent that the oak mentioned in Wm Witter's deposition, was the dividing tree between his land and Mr. Alex'r Contee's, which he understood was formerly Mr. Rozer's.       The afd Ralph Shaw, at a bounded hickory standing in a valley near a Stony Branch, further declares that 20 odd years ago, this deponent thinks that Geo: Goodrick, decd, told him that when Colo. Contee ran out his land, the surveyor ran to a bounded hickory, the dividing tree between the sd Contee and Mr. Chandler, which was afterwards shown this deponent and is the tree whereon he now lays his hand.
      CC, Oct 27, 1735. The deposition of Francis Ware, aged about 40 years, declares that for this 10-12 years past, this deponent has understood the hickory mentioned in the deposition of Ralph Shaw, to be one of the dividing trees between Mr. Contee & Mr. Chandler. Signed - Francis Ware.

      Indenture made September 28, 176{9}; between Henry Rozer, Gentleman of one part and John Peerce, planter of the other part. Whereas Notley Rozer, late of PGCo, Esq. deceased made public proposals of and did set up a lottery commonly called 'Rozer's 2000 Pound Lottery', the prices whereof consisting among other things of sundry tracts or parcels of land and whereas to avoid any obstruction to the drawing of the said lottery by the death of the said Notley and that the adventurers therein might on such accident have the full benefit of such prices as they should be entitled to by the said lottery the said Notley did by his criticite [codicil] duly examined and the next to his last will and testament bearing date on or about the 6th day of April 1727 authorize and request Col.
