Memo of the will of Robert Doyne taken by Richard Boughton and intended to be drawn into a will; 20 Jul 1689;
To wife Anne Doyne, extx., lifetime interest in plantation where I now live;
to son Wharton Doyne the land at Goose Creek when he comes of age;
wife to have timber from gate to Craxston's Quarter;
to dau. Sarah Doyne, Saturday's Works of 600 acres at Piscataway;
to daus. Verlinda and Elinor, 600 acres apiece of land last surveyed by Mr. Hutchinson;
to son William Doyne, 1,000 acres of land in Baltimore Co. called Constant Friendship and 14,000 or 16,000 acres of land in Somerset Co.;
to dau. Mary Doyne land at Zachia, two tracts called Lyons Denn and Fendall's Delight; if there be unborn child..-to have Carry [Carrick] Fergus at head of Broad Creeke joining Sarah;
estate to be in custody of extx. until children come of age;

9 Jan 1702; Indenture from Samuell Taylor of PGCo. and Verlinda his wife, one of the daus of Robert Doyne, Gent, to William Hutchinson of PGCo., merchant; at the time of his death, Robert owned diverse tracts and parcels of land, in particular 2 tracts; one containing 550 acres granted him by patent 9 June 1676 called "Rotterdam"; the other adjoining same on the lower side called "IndianTowne" of 600 acres conveyed to him on 11 March 1685 by William Whittington, Gent of Accomack County, Virginia, now of Somerset Co MD.; Robert Died intestate and his children were, Wharton, William, Sarah, Virlinda, Ellinor, and Mary; estate descended to Wharton as eldest son; William inherited this land at the death of Wharton; William d. intestate and Virlinda who m. In Volume I, Page 161 and Volume I, Revised, Page 155, the fate of the first three children of Robert Doyne was omitted. The following land record in Charles County shows these children were deceased by 1714:
8 Mar 1714; Indenture from Nicholas Dorson [Dawson] of Prince George's County, planter, and Mary his wife, one of the daughters of Robert Doyne, Gent., decd, to James Stoddert of Prince George's Co.; Robert Doyne, at the time of his decease, was seized of diverse tracts of land particularly a parcel on Nanjemy Creek called Rotterdam of 550 acres patented 9 Jun 1676; adjoining tract called Indian Town conveyed by William Whittington then of Accomack County, Virginia, now of Somerset County, Maryland, dated 11 Mar 1685; Robert Doyne died intestate and his 6 children were Wharton Doyne, William Doyne, Sarah, Virlinda, Elinor and Mary Doyne; from Wharton Doyne eldest son and heir, who died in infancy (that is to say not yet 21), to his brother William Doyne, who also died in infancy; Elinor d. 1705; Mary, wife of Nicholas Dawson, inherited 1/3 of the lands; this indenture for 2,500# tobacco; Rotterdam of 550 acres and Nanjemy Indian Town of 600 acres; /s/ Nicho. An Act declareing what Estate Gabriel Parker and Anne his wife, John Abbington and Mary his wife, William Hutcheson, and William Pile and Elizabeth his wife have in the Lands Severally devised to them by William Hutcheson Gentleman dec'd.
Whereas Gabriel Parker and Anne his wife John Abbington and Mary his wife William Hutcheson, William Pile and Elizabeth his wife by their humble petition to his Excellency the Governeur and the Upper and lower houses of this Present General Assembly have Set forth that William Hutcheson late of Prince George's County Gentleman decd by his last will and Testament bearing date the thirteenth day of December Anno Dni Seventeen hundred and Eight devised Severall tracts and Parcells of Land to these Petitioners in manner as follows
I give and devise to my daughter Anne Hutcheson and her heirs for Ever the Land Piscataway fforrest about Seven hundred Acres As Also the Land "Sangwhare" three hundred and ffifty Acres And the Part of "Jesmund" I bought of Mark Hampton about two hundred and twenty Acres And my Part of "friendship" fifty Acres And All that Part of "Hazzard' from the Main Road to Piscataway Creek where the Store House Stands as also thirty five Acres of Land Called "Littleworth" and the Land Called "Strife" lying upon Mattawoman in Partnership with Thomas Addison Estimate Eight hundred Acres the whole my Part four hundred (the which said Anne Hutcheson is Since Intermarried with Gabriel Parker One of the aforesaid Petitioners)

Also one of the Aforesaid Petitioners And further the aforesaid Petitioners haveing Also Set forth in their Petition that in the next Succeeding Paragraph of the afore recited will the Deceased William Hutcheson haveing by his said will Settled upon his Son John All his Estate lying in North Brittain made a Provision to Barr his Said son John from haveing Any Interest in Any of his Aforementioned Lands whilst any of his Children to whom they are Devised were living.
The Tenour of which Paragraph follows in these words. And my will is that if any of my three Daughters die without lawfull Issue that the lands hereby given them or to my son William if he Die without Issue shall be Equally Divided Among the three Surviving, And if two dye to the Other two living And if three Dye All to the Other And that my Son John have no Interest in Any of my Lands in Maryland Except they all four dye without Issue I mean Such Lands as are herein devised as by the said will Reference being
thereto had may more fully and at Large Appear And the Petitioners likewise in their Said Petition haveing set forth that they have been Advised that the before recited Paragraph of the deceaseds will may be Understood to Amount to an Entaile upon All the Lands devised as above to the Petitioners which they verily believe was never so Intended by the deceased which they Alledge in their said Petition may be very well gathered from the severall devises themselves to the Petitioners being all to them and their heirs for Ever And not Only so but it being Contrary to the Bent and Inclination of the Deceased's Mind the Intailing of any Lands which he has frequently Expressed in words when in Conversation with his friends And forasmuch as the said Gabriel Parker and Anne his wife John Abbington and Mary his wife William Hutcheson William Pile and Elizabeth his wife have made their Several Allegations mentioned as aforesaid Sufficiently Appear to this Generall Assembly by Undoubted Testimony And that as the said Petitioners by their Said Petition have Prayed An Act may Pass for their releif in the Premises aforesaid It is humbly Prayed that it may be Enacted and Declared And be it Enacted and Declared by the Right Honourable the Lord Proprietor by and with the Advice and Consent of his Lordships Governeur and the Upper and lower Houses of Assembly and the Authority of the Same That the said Gabriel Parker and Anne his wife John Abbington & Mary his wife William Hutcheson, William Pile and Elizabeth his wife have and may by Vertue of this Act hold & Enjoy the Same Estate in All those Lands severally devised to them by the said deceased William Hutcheson by the four several recited paragraphs of his will in as full and Ample manner to All Intents and Purposes as they might or Could have done if that before recited paragraph in the said will Barring his son John from haveing any Interest in Any of his Lands in Maryland devised as aforesaid had never been made and Inserted therein Any thing in the said Paragraph that may Seem to the Contrary in Anywise notwithstanding Saving to his Lordship the Lord Proprietor and all Bodies politick and Corporate and all Others not mentioned in this Act their Several and respective Rights.
