On 1 Jul 1708, the 400 acre tract Notely Hall [sic] was surveyed for Henry WHARTON, "beg: at the mouth of a creek commonly called Bramly Cr & on the north side of said Cr and by the side of Wiccocomoe River." An added note by the rent taker states "Rent at 5% by his Ldps particular order & is part of St. Clements Manor." A deed from Thomas GERRARD to his son Justinian in 1662 further describes the location of this land, which was first divided from St. Clements, then resurveyed to include it again after GERRARD'S death: "Begining at Myawickes Creekes mouth and soe runinge upon the lyne of Mr Roberts SLYES Land or Plantacon called Bushwood unto the utmost extent of the said mannr of the one side, and by the River of Wickocomaco of the other side up to Bramly Creekes mouth and soe up the said Creeke and up the branch thereof to a marked white oake with nine notches which boundeth the Land of Thomas NOTLEY and from the said tree runing upon a direct line North-East unto the utmost Extent if the aforesd mannr into the woods Containing by Estimacon five hundred acres..." I, Henry Wharton of St Mary's County, Gent, have received this present day, of Jonathan Forward of the City of London, merchant, 562 £18 shillings and 11 pence current money of England due to me from sd Forward for the mortgage of all that tract of land called Rices Mannor alias Lewis' Neck, lying in CC, now in the custody of sd Henry Wharton. To have and to hold, the afd tract of land to sd Jonathan Forward, which sd Henry formerly mortgaged to John Hyde for 562 £18 shillings and 11 pence, and I do confess by the payment of the afd sum, all my interest in the sd tract of land is absolutely extinguished, and that sd Jonathan Forward is thereof seized. May 18 & 19, 1729 from William Loney, attorney of Jonathan Forward of the City of London, merchant, and Henry Wharton of St Mary's County, Gent, to John Tayloe of Richmond County, Virginia, for 600 £lawful money of Great Britain, all that tract of land in CC commonly called Rices Mannor alias Lewis' Neck, formerly patented by William Lewis, and for want of heirs of sd Lewis, afterwards escheated and patented by Jesse Wharton, from whom it descended to his eldest son, who, dying an infant, the same descended to the sd Henry Wharton, party to these presents, as heir at law to his sd brother, and by sd Henry Wharton was mortgaged by deed dated Dec 6, 1704 to John Hyde of London, merchant, which mortgage was, by deed dated Dec 17, 1714, assigned and transferred by sd John Hyde to sd Jonathan Forward, and by deed dated Mar 30, 1716, the whole remainder and reversion of in fee of the sd premises was, by sd Henry Wharton, granted to sd Forward, and now renew and duly executed by deed dated yesterday, by means of which sd descents and mean [mesne?] conveyances, a good and absolute estate in fee simple of sd land is now lawfully vested in sd Jonathan Forward (excepting out of the present lease 40 acres (part of the tract of land hereby granted to sd John Tayloe) sold by sd Henry Wharton to Thomas King, shipwright, and is adjoining to the beginning corner tree of Lewis' Neck between Nanjemy Cr and a little Cr that almost encloses the land). Oct 17, 1729 from Jonothan Forward of the City of London, merchant, to John Tayloe of Richmond County, Virginia, Gent, for 600 £of lawful money of Great Britain, all that tract of land in CC, commonly called Rices Mannor alias Lewis' Neck, formerly patented by William Lewis, and for want of heirs of sd Lewis, afterwards escheated and patented by Jesse Wharton, from whom it descended to his eldest son who, dying as an infant, the same descended to Henry Wharton as heir at law to his sd brother, and by sd Henry Wharton was mortgaged by deed dated Dec 6, 1704 to John Hyde of London, merchant, which sd mortgage was, by deed dated Dec 17, 1714, and also by one other deed dated Oct 15 instant, assigned and transferred by sd John Hyde unto sd Jonathan Forward, and the whole remainder and reversion in fee of sd premises was, by sd Henry Wharton, the mortgagor, by deed dated Mar 13, 1716, and also by one other deed lately by him made and executed in Maryland, conveyed to sd Jonathan Forward, by means of which sd descents and mean [mesne?] conveyances, a good and absolute estate of inheritance in fee simple to the Mannor or Neck of land, is now lawfully vested in sd Jonathan Forward (excepting out of this present grant 40 acres, part of the premises formerly conveyed by sd Henry Wharton to Thomas King, ship carpenter, which sd 40 acres adjoining to the beginning corner tree of Lewis Neck between Nanjamie Cr and a little Cr that almost encloses -the sd land). At the request of John Tayloe of Virginia, Gent, the following deed was recorded May 22, 1730.
Oct 15, 1729 from John Hyde of London, merchant, to Jonothan Forward of London, merchant. Henry Wharton of CC, Gent, by deed dated Dec 6, 1704, for 562 £18 shillings and 11 pence of lawful money of England, sold to sd John Hyde all that tract of land called Rices Mannor alias Lewis' Neck, lying in CC, under proviso, nevertheless, to be void on sd Henry Wharton's repayment of the sum of 562 £18 shillings and 11 pence with interest. Sd sum of 562 £18 shillings and 11 pence was not paid, by means whereof, sd lands became legally vested in sd Jno Hyde. Sd recited deed of mortgage was afterwards recorded in the proper court in Maryland. Sd John Hyde, by deed dated about Dec 17, 1714, sold to sd Jonathan Forward, for 470 £and for other considerations, all of the messuages, lands, and hereditaments, by any deeds, mortgages, or any other instruments, conveyed to sd John Hyde by sd Henry Wharton. In the last mentioned deed there was a covenant from John Hyde to Jonathan Forward for John Hyde's making further assurance of the same premises. The last recited deed was designed to convey to Jonathan Forward the premises by the 1st recited deed mortgaged by Henry Wharton to John Hyde. But the 1st recited deed not being at the time of executing of sd last recited deed, in the possession of John Hyde, but remaining in Maryland, the date and contents thereof could not be sufficiently ascertained, and therefore Jonathan Forward, having obtained a copy of the 1st deed from the office where the same was recorded, has applied to sd John Hyde to convey sd premises in a more certain manner. Now this deed witnesses that John Hyde, for 470 £money of Great Britain and for 5 shillings, conveys all the sd tract of land and all other premises by the 1st recited indenture released by Henry Wharton to John Hyde, sd last recited deed dated about Dec 17, 1714 only excepted. Jun 15 & 16, 1731 from Henry Wharton of St Mary's County, Gentleman, and Jane, his wife, to John Parnham Jr of CC, merchant, and Jane, his wife, for 5 shillings. A treaty of marriage being lately on foot between as John Parnham and Jane Wharton, daughter of sd Henry Wharton and Jane, his wife. Sd Henry Wharton, in consideration that sd marriage should take effect and be solemnized by articles of agreement dated Nov 8, 1728, agree with sd John Parnham that he, sd Henry Wharton, soon after the solemnization thereof would, by some deed, convey to sd John Parnham and Jane, his wife, as part of the marriage portion of sd Jane, a moiety or half part of a certain tract of land then in the actual possession of sd Henry Wharton lying near Budds Cr in CC, being part of a tract of land called Baltemores Gift, adjoining a tract of land called Sarum. The parcel of land before granted is bounded by a Great Marsh called Piles Marsh, containing and laid out for about 181.5 acres, together with all the marsh lying between sd land and Wicocomoco [Wicomico] River. Sd marriage did take place, and was soon after the expending of the articles had and solemnized. Now this deed witnesses that sd Henry Wharton and Jane, his wife, for and in consideration of sd marriage and of the natural love they have for the sd daughter, and in pursuance of the articles and for 10 shillings and for divers other good causes, they release to sd Jno Parnham and lane, his wife, all that parcel of land described above, for the use and behoof of sd John Parnham and Jane, his wife, and the heirs of her body lawfully begotten, and in default of such heirs, remainder to Francis Wharton, son of sd Henry Wharton. Know that a treaty of marriage being lately on'_foot between John Barnham Jr of CC, merchant, and Jane_Wharton, the daughter of Henry Wharton of St Mary's County, pent, sd Henry Wharton did, by articles of agreement dated Nov 8, 1728, covenant with sd John Parnham that in case sd intended marriage should take effect, that sd Henry Wharton would convey to sd John Parnham (as part of the marriage portion which he intended to give his sd daughter), 8 Negroes, namely, Ignatius, Margaret, Monica, John, Jonathan, Little' Bess, Jesse, and Pegg. Sd marriage did take effect. Now know that sd Henry Wharton, for and in consideration of sd marriage and for the natural love he has"for his sd daughter Jane, grants sd John Parnham, the above named Negro slaves, together with their increase.
