The Condicon of this obligacon is such that if ye above bound JOHN WATERS, Son of JOHN WATERS, and Admr. of ye Estate of JOHN WATERS deced, do make or cause to be made a true & perfect Inventory of all & singular ye goods chattells & creditts of ye sd deced which have or shall come to ye hands or possession of him ye sd JOHN WATERS or into ye hands of any other persons for him & ye same so made to exhibit to ye next Court to be held for ye sd County of Essex and make oath thereto, & well & truely administer on ye sd Estate according to Law & give a true & just account of his administration when he shall be thereunto lawfully required, & all ye rest & residue of ye sd goods chattels & credits which shall be found remaineing upon account of ye Administration, ye same being first examined & allowed of by ye sd Court shall deliver and pay unto such person & persons respectively as ye Court pursuant to Law shall appoint, then ye above obligation to be void, otherwise to stand & remaine of full force power & vertue

KNOW ALL MEN by these prsents that I JOHN WATERS of the County of Rappae. in Virginia, Planter, have for a valuable consideration in hand received sold unto THOMAS GREENE his heires or assignes Two hundred acre of land being in the County aforesaid and on the South East side of PISCATICON CREEK, it being part of a Devident wch was granted to Mr: THOMAS PATTISON bearing date the twelfth day of June in the yeare one thouand Six hundred sixty and nine, and by the aforesaid PATTISON convayed to Mr; RICHARD GLOVER and by the said GLOVER convayed to me and hnunded beginning at a great branch a little below the lower GOING OVER of KILLMANS BEAVER DAMS and soc bounding betweene the aforesaid branch and BEAVERDAME
until! the aforesaid quantity of Two hundred acres be satisfyed but if it justly appeare that any part of the aforesaid land should appertyne to WM. YOUNG of PISCATICON then to begin where he ends and run up along by the aforesd BEAVERDAMS till the afore: said quantity of Two hundred acres be fully satisfyed; To have hold & enjoy the land withal! rights and priviledges to him the aforesaid THOMAS GREENE his heires or assignes from clayme of me my heires or any person whatsoever, and to acknowledge the same in open Court when the said GREENE shall think fit; And Likewise my Wives right to; And Likewise to give livery & semen of the aforesaid land; To all wch I bind my selfe my heires As Witness or: hands this 5th of March 1678

THIS INDENTURE made the first. day of December Ano Dom 1686 and in the second yeare of the Reign of our Sovereigne Lord James the second &c. Between JOHN WATERS the Elder of the Parish of Farnham in the County of Rappa: Gent., of one part and JOHN WEBSTER of the Parish and County aforesd. of the other part Witnesseth that the sd JOHN WATERS for the full quantity of Five thousand pounds of good and well condicioned tobacco in caske to him in hand well paid hath granted unto the said JOHN WEBSTER his heires three hundred acres of land part of Pattent first granted to Mr. THO: PATISON dated November (67) and conveyed from the sd PATISON to RICHARD GLOVER Febr. (69) and from the sd RICHARD GLOVER to the sd JOHN WATERS being in the aforesd. County of Rappa: being the upper part of the whole Dividend bounded as followeth (vizt) Beginning at a Gum sump and Hickory standing on the West side of a Swamp of PISCATON CREEKE called the BEAVER DAM SWAMP being the uppermost corner of the sd Land and running thence N alonge the sd old reputed line till we cross THO. BROWNE BRANCH to a corner red oake thence according to the express words of the sd Pattent upon the sd Branch N. 1 to another corner red Oake standing next the head of the sd Branch where it devides itself into a Forke, thence N. to a marked red Oake on a levell on the North side the PATH, thence W. to another corner thence W. to a Hickory, thence W: to a stake standing between a marked red Oake and a white Oake, thence East to a small Branch thence N E to a marked Oake standing on the aforesaid BEAVER DAM SWAMP just below the mouth of the sd BROWNS BRANCH, thence up along the severall courses of the sd Swamp South West to the first mencioned place it began And also all profits and appertenances belonging unto the sd Three hundred acres of land with all the right and interest To have and to hold unto the said JOHN WEBSTER his heires and assignes forever subject nevertheless to the quit rents which henceforth shall grow due to be paid and the sd JOHN WEBSTER may peacefully enjoy the same without the trouble of the sd JOHN WATERS his heires or any other persons whatsoever and shall acknowledge at any time within the space of seven years from the date hereof any other Deeds for the better and more sure settling the abovesd land hereby granted unto the sd JOHN WEBSTER his heirs forever In Witness whereof the said JOHN WATERS hath set his hand and seale

County his heires Three hundred acres of land being in the aforesd, County and on the South side of PISCATON CREEK it being part of a tract of land which I bought of one RICHARD GLOVER of this County, it being in part of payment and in consideration of the sd COVINGTONs being my securitie for One hundred Seventeen pounds Sterling or thereabouts and Six hundred pounds of Tobb: which was by a Judgmt: passed against the said COVINGTON in the Genll. Court last past as my securitie. To have hold and enjoy the aforesaid land from me my heires unto the aforesd. COVINGTON his heirs warranting the sd land to be free from all manner of Sales whatsoever or from the claime of all persons that my lay any right or interest to any part thereof. KNOW ALL MEN by these presents that I JOHN WATERS of County of Rappa in Virginia. Plantr., for divers causes more especially for One thousand pounds of swt. sented Tobb, & caske have by these presnts sold unto JOHN WEBSTER his heirs and assigns two parcells of land being in the aforesd County and bounded upon EVAN DAVIS, JOHN COLLIVOWE and sd JOHN WEBSTER being by computation twelve acres of land and the other parcell of land being in aforesd County bounding upon JOHN LAVAG [Savage?] and so to RILSMANS BEAVER being a point or two of land by computation Eight acres of land which land I the abovesd JOHN WATERS do by these presents warrant the aforesd land to the aforesd JOHN WEBSTER his heirs or assigns from the right & interest of me my heirs and from the claim of all persons that shall lay any interest to any parcell of the two aforesd parcells of land and likewise do oblige myself to acknowledge the aforesd sale in open Court when thereunto called. - JNO. WATERS complaineth that Mr: WM: JOHNSON of this County did in Ano: (blank) Contract & agree with ye Complt. to teach WM. TUNSTALL, Nephew to ye sd JOHNSON to write a leagable hand & to give him his dyet & lodging dureing his teaching in consideracon of which the said JOHNSON was to pay the Complaint: Nine hundred pounds of sweet sented tobacco & casque as by an Obligacon under the said JOHNSONs hand hath appear'd before this Court; Now so it is the Complt. did dureing the time of the said TUNSTALLs abode at the COURT HOUSE teach & instruct him in soe much that ye ComPlt. brought the sd TUNSTALL to write a Legable hand as he is ready to produce & make appear; but ye Complt. was willing to teach him better but the sd JOHNSON takes his Nephew away from the ComPlt. & refuseth to make him satisfaction; Wherefore he hath brought his accon against ye sd JOHNSON and craves Order for ye aforesd Tobacco with cost of suit; which sd WATERS being at a COURT HOUSE held for this County ye 9th: day of March caLl'd to prosecute his sd accon but being sick, ye Court at his request by Letter referr'd the matter to this Court, who not appearing now, this court have upon the Defendts. mocon dismist th same

WATERS SENR. complaineth against HENRY PICKET of this County shewing that he the Complt. did bring an accon of Defamacon against ye sd PICKETT at this Court upon wch: ye Jury & this court awarded ye Complt. Two thousand five hundred pounds of tobo: from which Judgmt. the Defendt. appealed; Now so it is ye Defendt. sought to ye Complt. for a Composition & accordingly it was agreed upon yt: ye Defendt. should pay unto ye Complt. Two thousand two hundred pounds of sweet seated tobo: & cask; accordingly the Defendt. gave ye Complt. his obligacon wherein was specified in full on all debts dues & demands whatsoever, but so it is after ye Complts. departure out of this Country, ye Defendt. haveing obtained two nonsuits against ye Complt., before ye passing of ye aforesd. Obligacon contrary to honesty and agreemt: takes ye aforesd. ANNE WATERS of St. Sepulchres, London, widow. Will 29 September 1697; proved 4 July 1700. Son John Waters, who for divers years past hath been gone to Virginia, 5S and no more. Son Samuel Waters, and Margaret his wife, 10s apiece. Daughter Elizabeth Overton, now in Virginia, 10s, and William her husband, 10s. Son-in-law Mr. William Goodwin, 10s. for a ring. Brother-in-law Caleb Milieu, 10s. Son Thomas Waters, residuary legatee, and he the sole Executor.

[ John Waters, the son, settled, first, in Gloucester county, Va., and afterwards in Old Rappahannock. On Sep. 26, 1683, he had a patent for 140 acres in Kingston parish, in the former county, and a year or two later one for 500 acres, which included the first patent. On October 25, 1688, a patent was issued to " Mr. Robert Yard," and " Mr. John Waters," for 900 acres on the south side of the Rappahannock river, which had been formerly granted to Epaphroditus Lawson, had become the property of Robert Paine as marrying Lawson's daughter, and been deserted by Paine.
In 1684, John Waters, together with his horse, having been impressed along with a number of others, by order of Colonel John Stone, to bring down corn and lumber belonging to the Rappahannock Indians, from their fort to the river side, was paid for nine days' service.
In the years 1684, 1685, &c., John Waters appears in the records of Rappahannock in connection with various business transactions. On October 2, 1684, " Mr. John Waters " and " Mr. Samuel Perry " bound themselves in the sum of 30,000 pounds of tobacco to William Lake, to deliver the estate of Thomas Harper to the court or its order. December 3, 1681, certificate was granted to Mr. John Waters for 730 acres of land for the importation of fifteen persons, himself among the number. December 2, 1685, Mr. John Waters was granted administration on the estate of Samuel Dudley, clerk, who died intestate. In 1685-6, he was attorney for Captain John Purvis, a merchant-captain, who was long in the Virginia and London trade.

Several deeds made by him are in the records of old Rappahannock:
I. John Waters, of Rappahannock county, Va., planter. November 2, 1682, conveying to John Savage 200 acres on the south side of Piscation [Piscataway] creek, Rappahannock county, which was purchased by said Waters of William Thornton and Richard Glover;
2. John Waters, of Rappahannock county., April 7, 1686, to John Savage, of Kingston parish, Gloucester, 200 acres in Rappahannock, part of the land purchased of Thornton and Glover;
3. John Waters, of Rappahannock county, gent , and Arabella, his wife, August 5, 1686, conveying 200 acres to George Brooks, being part of the land purchased of Thornton and Glover. October 1692, a power of attorney from Mr. John Waters to Mr. James Baughan was recorded, and on December 12, 1693, John Waters brought suit against Henry Picket for improper seizure by the latter of certain goods of Waters, while Waters was out of the country. It appears from the records that John Waters was too sick to appear at court during the summer of 1694, and probably died intestate during the fall of that year. On March 11 1694 [5], a quietus was granted to Mr. Henry Williamson, administrator of John Waters, deceased, in regard to a debt to the estate of Christopher Robinson, and on December 10, 1695, John Waters, administrator of John Waters, deceased, returned an inventory.
