      Robert Middleton vs. Phillip Aherne as marrying Alice the reputed wife of Robert Jefferis. The plaintiff setts forth that hee as the atturny of Robert Jefferis is capacitated to looke into and preserve the estate of Robert Jefferis from waste or imbezelment, that Phillip Aherne pretends to have intermarried with Alice and that the estate is like to be consumed, and prayes that Aherne may enter into bond that such estate as is remaineing may not bee wasted until advice may be had from Robert Jefferis out of England. The defendant' by Arthur Spicer his atturny pleades hee ought to give no security. The Court referr the matter to the next Court to be more fully debated.

      Robert Middleton vs. Phillip Aherne. It was debated at the last Court whether the defendant should give in security for the estate of Robert Jefferis held by Phillip Aherne and Alice now reputed the wife of Phillip. The Court are unanimously of judgment and doe order that Phillip Aherne doe give in good security to Robert Middleton atturny of Robert Jefferis according to the contents of his petition which is untill he can have notice and advice from Robert Jefferis in England that noe waste or imbezelment be made. The Court will take such care for the preservation of the estate as may stand with equity

      Upon the petition of Thomas Walker and Mary his wife, daughter of Robt. Jefferys and Alice his wife, it is ordered that Alice, now the reputed widdow of Phillipp Ahern, doe appeare at the next Court and enter into bond with securities for the estate of Robt. Jefferys as it appeares to this Court by inventory of the same now presented in Court and according to a former order against Phillipp Aherne.

      By the consideration of his Majestie's justices at a former Court held for this County it was ordered that Alice Ahern should give security for the estate of Robt. Jeffereys in her custody as it appeared by an inventory thereof now produced in Court, which shee haveing failed to perform, it is ordered that unless Alice doe at the next Court enter into bond, the Sheriff to take Alice into his safe custody there to remain untill she comply.
      Mr. Henry Ross and Mr. Charles Ashton dissent from the above order.
