      CHRISTOPHER GARLINGTON Planter Lessee of ROB'T JONES Gent. & SARAH his wife brought suite ag't GEORGE BERRATT Marriner of a plea wherefore he by force and Armes Three hundred Acres of Land the Plantation houses Orchards Gardens and other appurtenances thereon in Wiccocomoco Which the said ROBERT and SARAH to the said CHRISTOPHER did demise to the said CHRISTOPHER for a Terme not Yett past the said Deft did Enter and him from this the Prts farme did Ei;ect and other harmes Doe to his the Pits greate Dam'age and against the publick Peace etc. And Whereupon the Plt by RICHARD HAYNIE his Attorney Complaines That Whereas the said ROB'T and SARAH his wife the fifth day of August An'o 1699 on the said Land Did Demise to the Plt the Tenem[en]ts afores'd with the Appurtenances situate on the South side of Greate Wicocomoco River in Wiccocomoco Al[ia]s Lee Parish in this County bounded North North East upon Vulcans Creeke and the said River To have and to Occupy to him or his Assignes from the said fifth day of August last past to the end of Two Yeares then next following By Virtue of which Demise the Plt in the said Tenem't and Appurtenances did Enter & was thereof possessed Notwithstanding such possession GEORGE BERRATT afterwards the said fifth day of Aug't by force and Armes etc. the said Tenem'ts with the appurtenances which the aforesaid ROBERT and SARAH his wife to the said Plt in forme afores'd demised for the said Terme not Yett past did Enter and him from his farme afores'd did Eject and other harmes to him did doe to his great Dam'age etc. & against the peace etc. which the Plit sayeth is to his Damage to the Vallue of twenty thousands pounds of Tobacco and Casq' & thereupon brings suite and prayes Order that the said BERRATT be off the said Land Ejected Expelled and amoved & grant him his Matj'es Writt of Haber Facias possessionem to the Sheriffee him Com'anding to possesse the Plt with the said Land and appurtenances And Grant him Judgement for his said Dam'ages w'th Costs &c And the Deft conies into Court and by SYMON ROBINS his Attorney defends the force and Injury when etc. And for plea saith that the Writt & Count or Declaracion Varyes One from the other the One being for a Trespasse on three hundred Acres of Land the plantac'on houses Orchards Gardens & other appurtenances thereon and the Declarac'on is for Trespasse upon Tenem'ts with the appurtenances only wherefore the Acc'on ought to abate Secondly by the Law in all Actions of Trespasse in Ejectm't the Count and Declarac'on ought perticulerly to Express the Land houses Gardens etc. to be Trespassed upon as they are Expressed in the Lease and if any Variac'on the Declaration is Vicious as this is Thirdly the PI't ought to sett forth in his Declarac'on the Direct Number of houses Orchards gardens etc. (that is) upon how many of each sort the Deft trespassed upon and not by uncertaine General) Termes Wherefore the Declarac'on is Vicious fourthly the Plt in all his Declarac'on doth not as much as p[re]tend that ROBERT JONES and SARAH his wife his Lessors have any Right or title to the said Land and premisses in Question w'th [sic] he ought to have done of all which he Craves Judgm't The Court adjudge the said Declarac'on good Notwithstanding the Def'ts said Exceptions And Whereupon the Deft for further Plea saith that the pl't by Virtue of the p[re]tended or Signed Lease in the Declarac'on Expressed had noe Right to enter into and uppon the Lands & p[re]misses thereby Leased to him by ROBERT JONES Gent. and SARAH his wife they haveing noe Legall Right Title or power to make such Lease to the Plt & therefore the Plt his Acc'on ought not to have or maintaine against the Defts et inde ponit se super Legim & Prayes Judgm't Whereupon the Plt to justifie the Title of the Lessors to the said Land Produced the last Will and Testam't of ANDREW PETTIGREW dec'ed who devised it to his Wife ISSABELLA PETTIGREW & her heires forever and further saith that the said ISSABELLA dying THOMAS SALSBURY her Grandson & heire to the said Lands alsoe dying since his said Grandmother Did by Will Devise to his wife SARAH SALSBURY (the New wife of the s'd ROB'T JONES) his whole Estate both personall and real! & that before his Decease imediately after the death of his said Grandmother he brought suit ag't the Deft then in possession thereof but dyed before the said suite determined & then in this Court depended at the time of his Death. And the Deft further saith that the Plt hath noe right by Virtue of the Will of PETTIGREW but that the said Will is Void for want of Due Probate it being proved before a Single Magistrate and further if he had right by Vertue thereof Yett he never entered into possession of the said Land and had not only a meer Right and not Diviseable therefore The Court haveing Consid[e]r'd the p[re]misses Adjudge the said SALSBURYes Title to be good by Vertue of the Will of PETTIGREW as heire to his said Grandmother And that the said ROBERT JONES and SARAH his wife had right to Lease the said Land to the PI't by Virtue of the Will of the said SALSBURY And Whereupon a Jury Impannelled and sworne to that purpose who (viz't) PHILL' SHAPLEIGH, HENRY DAWSON, JOHN HAYNIE, ANTHONY HAYNES, RICHARD CUNDIFFE, JAMES GAYNER, RICHARD HEWS, RICHARD TULLOS, RICHARD FLYNT, PHILL' BUSSELL, HENRY FRANKLIN & DAVID SPENCE went out to Enquire into the Damage Who brought in their Verdict Wee of the Jury Doe find for the pl't Two hundred pounds of Tobacco Damage PH[ILLIP] SHAPLEIGH [foreman] Upon which Verdict upon the Plits Moc'on Judgm't is granted him ag't the s'd GEO BERRATT and Ordered the said BERRATT pay the said sum'e of Two hundred pounds of Tobacco unto the said GARLINGTON Lessee of the said ROB'T JONES & SARAH his wife with Costs al's Ex'o.
      from which Order the said Deft GEO. BERRATT Appeales to a heareing before his Excellency the Gov'r and the Honorable Councell of State the first day of the next Gen'll Court which is granted he giving Caution to prosecute his said Appeale.

      Whereas GEORGE BERRATT & ESTER his wife Exec'x of THOMAS HICKMAN dec'ed were returned Non est Invent' at the said suite of JAMES WESTCOMB for the sum'e of Six hundred pounds of Tobacco an attachm't is Awarded the said WESTCOMB ag't the said BERRATT & his wife Exec'x as afores'd for the said sum'e and Costs returnable to the next Court

      Whereas GEORGE BERRATT was bound over to the Court on the Compl't of PHILLIP NORCUTT in a bond of Twenty thousand pounds of Tobacco dated the 18th of July 1699 to his Matesty, his heires & Successors with Condic'on that if the said GEORGE should appeare at this Court to Answ' what shall be Objected against him for killing a Heifer of the Compl'ts and the said BERATT appeareing & alsoe the said NORCUTT the matter of fact was putt to a Jury who (viz't) HENRY DAWSON, WILLIAM HILL, JAMES OLDHAM, JOHN WEBB, THOMAS DAVIS CHARLES VOLLEN, CLAUDE TULLOS, JOHN LAURENCE, JOHN TRIMLETT, JOHN DAVIS, CLEMENT ARLEDGE, and RICHARD HEWS who bring in their Verdict as foil (viz't) Wee of the Jury doe find for the Deft HENRY DAWSON [Foreman] Upon which Verdict the said BERRATT is Acquitted.
