HENRY WILLIS, Executor therein named, was proved by the Oaths of ANTHONY RHODES, JOHN GORDON, ELIZABETH GORDON and WILLIAM BOOTH, the witnesses thereto, and the said Executor having taken the Oath as the Law directs and entered into Bond with JOHN WALLER & JOHN MERCER Gent. his Securitys, Certificate in due form is granted him for obtaining Letters of Probate; Ordered that THOMAS HILL, JOHN GORDON, JAMES SLEET and RICHARD TUTT, or any two of them (being first sworn before a Majestrate of this County) do appraised all the said ROBERT SPOTSWOOD Gent. deced Estate as shall be shown and produced to them by the said Executor and make report of their proceedings to the next Court

Ex. wife, Mary Spotswood, John Robinson, Esq., Col. Bernard Moore; Col. John Champe; Mr. Edmund Pendleton; Mr. Roger Dixon; Mr. Nicholas Seward. Leg. wife, Mary, use of mansion house, and my coach and six, with coachman and postilion and household goods, etc.; to my daughter Ann, £1,000 sterling; to my daughter Mary £1,000 sterling, in compliance with the authority given me in the will of my deced. father, Alexander Spotswood, Esq. Whereas my father, by his last will, did give to his son, Robert Spotswood £3,000 sterling,—to his daughter Anna Catherina £2,000 sterling, and to his daughter Dorothea £2,000 sterling, to be raised by the sale or mortgage of his lands, and I finding it necessary, in order to raise the said fortunes, to sell divers parcels of land, among the rest I sold and conveyed to Col. John Thornton, 7 tracts containing in the whole 9,048 acres, and afterwards I purchased the said 7 tracts of land of the said Col. John Thornton, I give the said 9,048 acres of land to my son, John Spotswood, also to him that tract of land which I bought of Ambrose Grayson, also all my part of the estate in England which will descend to me and my cousin, John Benger after the death of my mother and her three sisters. To my son, Alexander Spotswood to inherit the property left to Mary Spotswood at her death, or second marriage.
Codicil to the aforegoing, dated May 6, 1756, with the same witnesses as to the will, directs that all his children be maintained and educated out of the growing rents and profits of his estate, until they arrive at the age of twenty-one years, or day of marriage. Whereas by lease and release dated 5 and 6 March 1724, settlement made upon marriage of Alexander Spotswood with the sd Butler Spotswood, and made between the Honble Alexander Spotswood, late his Majesty's Lieutenant Governor of the Colony and Dominion of Virginia in North America, but then in the Parish of St. Martin's in the Fields, in the County of Middlesex, Esqr., of the first part. Richard Brayne of the Parish of St. Margaret's, Westminister, Esqr. and Robert Cary of the City of London, Merchant, of the second part. Butler Brayne, fourth and youngest daughter of the sd Richard Brayne and Anne, his wife, of the third part.
The sd release mentioning that whereas the sd marriage by the Grace of God shortly to be had and solemnized between Alexander Spotswood and Butler Brayne .. for charging of the lands and heriditaments .. in consideration of .. intended marriage, and also of the sum of ten shillings of lawfull money of Great Britain by Richard Brayne and Robert Cary to him .. Alexander Spotswood, paid before the sealing and delivery of the release, and divers other good causes .. Alexander Spotswood especially moveing, he .. did grant unto Richard Brayne and Robt. Cary .. land containing 15,000 acres, formerly in counties of Essex and King and Queen, but now in county of Spotsylvania, and in Dominion of Virginia in North America .. bounded as in sd deed mentioned .. together with all houses .. tract of land commonly called the Iron Mine Land .. all profits .. To have and to hold said Iron Mine Land to be released in .. beneficial manner .. as intended by his then Majesty's Letters of Patent dated 20 Feb 1719 to Robert Beverley and Thomas Jones .. unto Richard Brayne and Robert Cary .. forever nevertheless .. with payment to Butler Brayne in case intended marriage takes effect .. Butler Brayne survives Alexander Spotswood. her intended husband, and during her natural life full recompense and satisfaction of all dower rights in these lands. Yearly sun of five hundred pounds of British money from out of the said premises, at most usual feasts of the year .. (that is to say) The Annunciation of the Blessed Virgin Mary, the Feast of St. John the Baptist, the Feast of St. Michael the Archangel and the Birth of our Lord and Saviour Jesus Christ, by even and equal portions .. the first payment therein to begin first of the Feast next ensueing the Decease of Alexander Spotswood and all such payments to be .. enjoyed .. free of all and any taxes. If any amount of Five Hundred pounds be unpaid thirty days after, Butler Brayne .. might have Ten pounds for every 20 days wherein be behind and unpaid, and afterwards to be forfeited and lost. From time to time the annuity ought to be paid to hands of John Thompson and Butler, his wife.
Whereas Alexander Spotswood, on the 7th day of July 1740, departed this life, and whereas afterwards a marriage was intended to be solemnized by John Thompson and Butler Spotswood, she .. intending to convey .. a moiety or one half of annuity of yearly sum of Five Hundred pounds to her children begotten her by Alexander Spotswood, sign in writeing 8 Nov 1742, witnessed by John Thompson, her intended husband, declaring that out of very great love .. son, John Spotswood .. to have one half of her Fortune ... Two Hundred Fifty pounds Sterling a year, from that day, 8 Nov 1742, but with the reserve that Fifty pounds of it be paid yearly on Negroes for her son, Robert Spotswood .. that the Negroes purchased be imployed in her son, John Spotswood's, estate, in order to enable him to bring up, educate and maintain her son, Robert Spotswood, in a Hansome Manner. If son, Robert, lives to be 18 years, then such slaves remaining on estate purchased in this manner to be delivered unto him with their increase.
Whereas afterwards on the 9th Nov 1742, the marriage between John Thompson and Butler Spotswood did take effect and was solemnized .. Now this Indenture .. for perfect conveying the moiety of 1/2 of the aforesaid .. of the yearly sum of five hundred pounds Sterling .. in such manner as mentioned for natural love .. Butler Thompson unto her children; John Spotswood, Robert Spotswood, Anna Catharina Spotswood, Dorathea Spotswood, for sum of Ten shillings, by Robert Rose and Elliott Benger to John Thompson and Butler, his wife, for divers reasons, they especially moveing .. grant unto Robt. Rose and Elliott Benger, a moiety or amount of yearly Rents of five hundred pounds for 15,000 acres of Iron Mine Lands. (Indenture mentioned from 9 Nov 1742.) To have and to hold .. charge of Five Hundred pounds .. for life to Butler Thompson to interest .. as the sd John Thompson and Butler, his wife, receive such annuities .. that Robert Rose and Elliott Benger and the survivor of them .. one half of said annuity .. one fifth of the said moiety for John Spotswood until Robert Spotswood comes to the age of 18 years .. assign 1/5 .. to Anna Catharina Spotswood and Dorathea Spotswood .. and lastly agreed by all parties .. is that Robert Rose and Elliott Benger (Trustees named) .. their survivors shall sustain management thereof touching or concerning the within .. have interchangeably signed their names.
