      Court convened May 17, 1694
JOHN DUDLY, having married ELIZABETH, the daughter of Mr. ERASMUS WITHERS deceased, brought Suit against JOHN CURTIS for the payment of seventy two pounds two shillings and 10 shillings sterling money, six thousand four hundred and fifty four pounds of tobacco, twenty six head of cattle and a third part of eleven horses and mares, due for his proportion (in his said quality) of the said Mr. WITHERS' Estate, and whereas the said CURTIS (who married FRANCES, the relict of the said WITHERS) produced a conveyance under the hand of the said WITHERS dated in the year 1674 obliging himself (in consideration of the Estate of one JOHN HIXON in land and other commodities to him accruing, made over to the said WITHERS) to pay the said HIXON five and twenty pounds per annum during life, which said sum duly proportioned, in all probability, would surmount the value of the said Mr. WITHERS' Estate, it is therefore ordered upon the said CURTIS' motion the said action abate.
