Berryman to Jones Indenture & Platt
This indenture made the third day of March 1798 between John Berryman the first part and Jekyll Jones of the second part. Witnesseth that John Berryman in consideration of five shillings in hand has sold to Jekyll Jones all that tract of land lying in the County of Westmoreland containing 136 acres and 23 poles which said tract is more described by a plat made on the 19th day of October 1796 by John Steward, surveyor of Westmoreland County for Messrs. Jekyll Jones and Skelton Jones hereto annexed as a part of these presents. In witness whereof the said John Berryman has hereunto set his hand and seal the day and date within written.

Westmoreland County, to wit; at the mutual request of Messrs. Jekyll Jones and Skelton Jones I have surveyed the above figure of land lying in the Parish of Washington and County aforesaid and bounded as follows, vizt; beginning near Potomac River at the mouth of a lane near a cedar stump at “A” and extending thence South 45° West 168 pole along the said lane between this and the land of Mr. Newton Berryman, to another cedar stump corner to the said Berryman and in the line of Mr. Christopher Edrington at “B”, thence down the lane between this and the land of the said Edrington, South 7° 15 minutes East 63 pole near to the corner of the said Edrington’s fence at a sweet gum at “C”, thence due South 64.5 pole to an ancient marked black gum corner to the said Edrington at “D” thence South 61° 30 minutes West 86 poles to a small sweet gum and white Oak stump standing in a large hole and said to be corner to the land of McCarty now Lee’s at “E”, thence South 31° 30 minutes East 87 pole to a stake supposed to be near the ancient corner of Col. Andrew Monroe and Mr. Robert Lovell now Mr. John Monroe’s alias Lee and Berryman at “F”, thence North 33° 30 minutes East 199 poles to an ancient marked red oak now prostrate said to be corner to said Monroe alias Lee’s at “G, thence along the fence and ditch between this and the said Monroe’s alias Lee’s land North 29° East 154 pole to a catalpas tree near the riverside at “H”, thence up the meanders of the said River to the beginning at “A”. Then this request to define what quantity of land was included within the said Newton’s fence (in order to make a straight line between this and the said Newton’s land) which belongs to his brother John Berryman when the cleared land was equally divided between them agreeable to their fathers will which I have done as appears by the black and dotted line and road and letters “abP” and containing 4 acres, 3 rods in 19 poles. Then was requested to divide the cleared land from the woodland which I have done as appears by the road in the letters “CD” and find 108 acres, one rod and six pole of cleared land and 65 acres 3 rods 36 pole of woodland as appears by the plat above. Then was requested to divide the woodland by laying off 4 acres, three rod and 19 poles (the quantity of cleared land found within the said Newton’s fence) more than half to the southeast which I have done by beginning four pole from the corner at “G” towards “F”, as at “C” and running thence North 52° West 18 poles, thence North 83° 30 minutes West 18 pole to a cedar near the road at “c” as appears by the dotted line “ef”, running South 32° 30 minutes West making 37 acres three rod and 17 pole of woodland and 108 acres one rod and six pole of cleared land including in the whole of John Berryman’s alias Mr. G. Corbin’s part 146 acres and 23 poles. [Platt notes Irish Neck road and General Henry Lee’s land adjacent along line “GH”].
At a Superior Court held at Fredericksburg for the District composed of the counties of Spotsylvania, Caroline, King George, Stafford, Orange, Culpeper and Madison on Monday, October 8, 1798, this indenture referred land lying in the County of Westmoreland and John Berryman of the first part and Jekyll Jones of the second part was proved by the oath of Fontaine Murray, George French and Gilson Berryman three of the witnesses thereto and ordered to be certified to the said County Court of Westmoreland.

At a court held for Westmoreland County the 23rd day of September 1800 this indenture for land together with the plat annexed from John Berryman of the one part and Jekyll Jones of the other part presented to the court and it appearing that the said he had been legally proved in the District Court of Fredericksburg is here ordered to be recorded.
