      KNOW ALL MEN by these p:sents that I FRANCES SMITH, the Wife of ROBERT SMITH doe of my own free will and proper accord relinquish all my right of Dower and Thirds att the Common Law to a certaine parcell of land sold by my Husband, the said ROBERT SMITH, unto WILLIAM DUFF, being one hundred acres of land as may appear by Deed for the same bearing even date with these p:sents; And doe make and apoint my loveing Freind, BENJAMIN GRUBS, my Attorney for mee and in my name to make acknowledgement in Richmond County Court of this my Relinquishment and for sue doing this shall bee his sofitient warrant or Power of Attorney, Wittness my hand and Seale this 129th day of November 1718

      THIS INDENTURE made the Twenty Eighth day of November in the Fifth year of the Reigne of our Soveraigne Lord King George by the grace of God of Great Brittaine France and Ireland, King, Defender of the faith &c., And in the year of our Lord one thousand seven hundred and Eighteen, Between ROBERT SMITH of Parish of Hanover in Richmond County, Planter, of one part and WILLIAM DUFF of Parish and County aforesaid, Taylor, of other part; Wittnesseth that ROBERT SMITH for summe of Five Shillins of good and lawfull money of England paid to him by WILLIAM DUFF by these p:sents doe bargaine and sell unto WILLIAM DUFF a certain percell of land containing One hundred acres being part of a Pattent granted unto PETER BUTLER by WILLIAM FITZHUGH and GEORGE BRENT, Proporietors of this Northern Neck of Virginia for Three hundred and fifty acres of land, which bargained and sould Hundred acres of land is situate in Parish of Hanover in County of Richmond and bounded, Begining att a marked red Oak, corner tree to this land, extending thence East and by North one hundred and sixty five poles, thence South one hundred poles, thence Westt and by South one hundred sixty five poles downe the Branch to the North & South line of said ROBERT SMITH, thence up the said Line North one hundred poles to the place whear itt first began, Together with all houses orchards and comodities belonging; To have and to hold the Hundred acres of land unto WILLIAM DUFF and his heirs dureing the terms of one whole year paying the Rent of one Ear of Indian Come on the Birth Day of Our Lord God next ensueing if lawfully demanded; To the end that by vertue of these presents and of the Statute for transfering uses into possession, said WILLIAM DUFF may bee in the acttuall possession of the p:misses and bee theirby the beter enabled to receive a release or any other conveyance of the freehold and Inheritance theirof; In Wittness whearof the parties aforesaid have to these p:sents interchangeably set their hands and Soales the day month and year first above wrightne

      KNOW ALL MEN by these presents that I ISAAC HITE for and on behalf of myself and all others the representatives of JOIST HITE deceased, who are interested in the Decree lately obtained in the Court of Appeal by HITE & others against the representatives of the late LORD FAIRFAX am held & firmly bound unto ANDREW McKOY for himself and the representatives of ROBERT McKOY deceased, who are interested in the Decree aforesaid, and to JOHN GREEN for himself and for the representatives of WILLIAM DUFF and ROBERT GREEN both deceased, who are interested in the decree aforesaid in the penal sum of Ten thousand pounds specie to which payment well and truly to be made to the said ANDREW McKOY and JOHN GREEN their heirs, I bind myself my heirs firmly by these presents this Fifteenth day of May 1786
      The Condition of the above obligation is such that whereas the said ISAAC HITE, ANDREW McKOY and JOHN GREEN and others claiming under the said JOIST HITE, ROBERT McKOY, WILLIAM DUFF and ROBERT GREEN deceased, have obtained a Decree in the Court of Appeals against the respresentatives of the late LORD FAIRFAX & other for the recovery of several considerable quantities of Land and for certain sums of money and the several rights and portions of the said parties so intended in the recovery by the said Decree are hereafter to be marked ascertained alloted & determined on doing which it is feared that some differances disputes or contentions may arise among themselves, And Whereas the said ISAAC BITE for himself and all claiming under the said JOIST HITE, the said ANDREW McKOY for himself and all claiming under the said ROBERT McKOY, and the said JOHN GREEN for himself and all claiming under the said WILLIAM DUFF and ROBERT GREEN, have agreed and severally undertaken to and with each other and for the persons whom they represent that in case any differences disputes or contentions shall arise touching or concerning the allotment or Division of the lands or monies so recovered by the Decree aforesaid between the parties aforesaid, that the same shall be submitted to the final arbitrament and award of EDMUND RANDOLPH and JOHN TAYLOR from time to time as any such differences disputes or contentions shall or may arise and that either part concerning it necessary for himself or those he represents, may at any time on giving six months notice of the time and place of so doing and of the points he means to lay before the said Arbitrators in writing proceed to get an award reparte in Case the non attendance of the others; And Whereas it is further agreed by & between the said parties to their obligations that if either the said EDMUND RANDOLPH or JOHN TAYLOR shall happen to depart this life before the business shall be compleated, JOHN MARSHALL, Attorney, shall be substituted in the place of the person so dying when award or awards from time to time in conjunction with the said Sur-visien of the said first named Arbitrators or the award or awards of any umpire or umpires to be clear by the said first named Arbitrators from time or the survisien of them and the said Arbitrators so substituted in the place of either of the said first named Arbitrators in case they should disagree; should be binding on all & every of the said parties of and concerning the division or alotment of all things to be gained or obtained under the Decree aforesaid. Now if the said ISAAC HITE and them for whom he undertakes shall from time to time and at all times hereafter abide by, fulfil and perform the award & awards made by the Arbitrators so chosen or any of them or their umpires of and concerning the monies or things recovered or to be gained or obtained by the Decree aforesaid according to the above recited agreement, Then this obligation to be void but otherwise to remain in full force and virtue
