Memorandum that on the special petition of Morris Miles of PG, planter, preferred to sd court on the 4th Tuesday of Mar, [1739] the court order, dated Apr 3, 1739, was as follows: to Jeremiah Belt, Benjamin Jacobs, John Lemarr, & Thomas Hilleary of PG, Gent, greeting. Morris Miles of PG, seized of a parcel of land in Charles County called St. Andrews, on the 4th Tuesday of last Mar, preferred his petition to our County Court held at Upper Marlborough Town before Leonard Hollyday, Gent, & his associates, to examine the witnesses to prove and perpetuate the memory of the bounds of sd tract of land. We have given you (not being related to the petitioner or any contiguous proprietor, nor interested in sd land) power to examine all witnesses concerning the bounds of the land afd. Signed Mar 30, 1739 - A Contee, CI Cur. On Sep 19, 1739, Messrs Jeremiah Belt, Benjamin Jacobs, John Lemar, and Thomas Hilleary, qualified themselves to execute the within commission. Benjamin Brassure, aged about 80 years, declares that he came to a certain white oak with his brother, Samll Brashure and Morris Miles, and his sd brother ran a line from sd white oak, and they both declared that sd white oak was the beginning tree of Saint Andrew. John Rydle, aged about 70 years declares that, living on a plantation of John Ray's, the sd John Ray showed him the afd white oak & told him not to clear any ground or cut any wood beyond this tree, for that it was the beginning tree of Saint Andrews. Page 109. Nov 26, 1739. Luke Bamard, aged about 55 years, says that his father bought of Colo Ninian Beall, part of a tract of land called St. Andrews, and further says that the deponent's father was the first buyer of sd land, and this deponent says that after his father's death, he, this deponent, enjoyed the sd land by his father's will, and his part laid out by Mr. Clerrit Hill from a bounded white oak at the foot of a hill near a little branch that runs into the Western branch facing a little marsh, which sd hill, this deponent said, was the beginning of sd land called St. Andrews. Nat'l Wickham, aged about 82 years says that he bought part of a tract of land called St. Andrews of Colo Ninian Beall, & that the sd Beal took this deponent the afd white oak, from which tree Wm Hutchison was ordered and began to lay out this deponent's part of St. Andrews, which sd Colo Beall told this deponent was the beginning tree of St. Andrews. Feb 21, 1742 from Francis Dorsett of PG, carpenter, to Major Jeremiah Belt of PG, Gent, for 27 £10 shillings, a tract of land called Plague Enough, being part of a tract called the Orphans Gift, containing about 40 acres. Also I gray horse branded T, and 2 cows and 2 yearlings and 12 hogs. If, however, sd Dorsett pays sd Belt by next Nov 10, the afd sum with legal interest, then this deed shall be void. Mar 29, 1743 from John Breshears (Brashears) Sr of PG, planter, to Major Jeremiah Belt of PG, Gent, for 16 £2 shillings and I penny sterling, a tract of land called Brashears Neck, lying in PG, bounded by a live oak standing on a point by a marsh on the Beavor Dam Branch of the Western branch and also the beginning tree of a tract of land called Hogg Harbour, containing and laid out for about 86 acres. If, however, sd Brashears, by next Nov 10, pays the sd Majr Jeremiah Belt the afd sum, with legal interest from today, then this present deed shall be void. Signed - John Braeshas, Jere Belt. November 28, 1750; Memorandum that on the special petition of the Basil Waring prefrerred to the justices of Prince George's County, Maryland on the 4th Tuesday in March in the 35th year of his Lordship commission the Right Hon. the Lord Proprietory Dominion ect., his said Lordship commission issued by order of the justices aforesaid out of the county aforesaid on the 6th day of April Anno Domine 1750. In these words following, Charles Absolute Lord and Proprietary of the Province of Maryland and Avalon Lord Baron of Baltimore Vizt; to Messrs James Beck, Richard Duckett and Jeremiah Belt, Jr., of PGCo gentleman, whereas the Basil Waring is seized of a parcel called "Hearts Delight" and preferred his petition in writing to our county court held at Upper Marlborough Town before Edward Sprigg gentleman and his associates then and still justices within our county to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Advertisement July 29, 1750; by virtue of a commission from Prince George's County court commissioning and empowering us the subscribers to examine evidences to prove and to perpetuate the memory of the bounds of a tract of land called "Hearts Delight" in possession of Mr. Basil Waring we therefore agreeable to acts of assembly in such cases made and provided do hereby give public notice that we intend to meet at the house of Mr. Basil Waring on Thursday the 23rd day of August next in order to execute the said commission. Thursday, August 23, 1750; We met at the house of Mr. Basil Waring and proceeded to an old standing tree standing at the head of a glade where Thomas Hileary aged about 43 years was sworn and declared that about 19 or 20 years years ago he was present at a white oak tree which he thinks to be this, when Water Evans declared upon oath before the commissioners that this tree was the beginning of a tract belonging to Richard Smith of Calvert County, Maryland the said Smith having then a commission to examine the bounds of his said land Messrs Jeremiah Belt, Richard Keene and John Beall being commissioners and further saith not.
At the same place, Major Jeremiah Belt aged near 52 years being sworn declared that 19 or 20 years ago being a commissioner to examine the bounds of a tract belonging to Richard Smith of Calvert County, Maryland, old Walter Evans being duly sworn at a white oak which he thinks to be this, declared that the said oak was the beginning tree of a tract of land in the possession of the said Smith and further saith not. Thursday, September 13, 1750; We met according to adjournment and the evidences not appearing we adjourned till Monday the 17th instant to meet at the same place.
Monday, September 17, 1750; We met at the white oak where Col. Edward Sprigg aged about 53 years was sworn and declared that upwards of 30 years ago he asked Philip Gittings if he knew the beginning tree of Mr. Darnall's land called "Prevention" and Gittings told him he did and should him this tree and this deponent further saith that about 26 years ago Thomas Booke having a commission to examine the bounds of these lands Charles Walker and Joseph Brown being sworn at this tree declared that some years before they were with Colonel Henry Darnall about purchasing a tract called "Prevention" and wanting to see the lands Colonel Henry Darnall desired them to go to Colonel Ninian Beall who shew them the trees which he did and brought them to this tree and told them it was the beginning tree of the said "Prevention" and further saith not.
