      NOW ALL MEN by these pr:sents that wee FRA: GOULDMAN, EDWD, GOULDMAN, JNO: PARKER & WM. AYRES of ye County of Essex are firmly bound unto JNO. CATLETT Gent., Presedent of ye sd County Court in ye sum of One hundred pounds Sterling we bind ourselves this 17th day of May 1700
      The Condition of this obligacon is that if FRA: GOULDMAN & EDWD. GOULDMAN, Admrs. of all & singular ye goods & credits of ROBT: GOULDMAN deced do make a true Inventory of all ye chattells & credits of ye sd deced & ye same so made do exhibit to ye next Court for ye County of Essex & make oath thereto & further do make a true & just acct. of their Administration when lawfully required & all ye rest pay unto such p:sons as ye sd Court shall appoint, Then this obligacon to be void otherwise to remain in full force

      IN THE NAME OF GOD Amen, I THOMAS GOULDMAN being sick and weak of body but of sound & perfect memory blessed & praised be Almighty God for ye same do make & ordain this my last Will and Testament in manner & forme following,
      First and principally I comend my Soul to Almighty God my Creatr: that gave it assuredly believing that I shall receive full pardon & remission of all my sines and to be saved by ye precious death & merits of my blessed Saviour & Redeemer Christ Jesus, and my body to ye earth from whence it was taken to be buried in such decent & Christian manner as to my Exex, hereafter named shall be thought meet & convenient, And as for such worldly goods that it hath pleased God to lend me I bequeath dispose of & give in manner & forme following;
      First, I give & bequeath my Land unto my Child that my Wife is now with Child of and to ye heirs of its body lawfully begotten, but if it shall please God that my said Child die without such heirs, then I give ye said Land to my Brother, ROBT. GOULDMAN, & to ye heirs of his Body lawful! begotten and for want of such heirs to ye next succeeding heirs of the name of GOULDMAN; And it is my will that my sd: Land after my death be in ye possession of my sd. Brother, ROBT. GOULDMAN, until! my Child abovesd. comes to age
      Item. I give to my Brother, ROBT. GOULDMAN, one Servant boy named Patrick, one feather bed & furniture now at my Mothers, Mrs. ALICE FORBESSes, and one suit of clothes with plate buttons, a caster haft, a pr. of legg bootes, twelve shillings to buy a Ring & all ye goods at my Mothers, ye Molasses excepted.
      Item. I give unto my dear Mother, Mrs. ALICE FORBESS twenty shillings to buy a Ring;
      Item. I give unto my Brother, EDWARD GOULDMAN, one Servant man named Kelly, & twelve shillings to buy a Ring;
      As for ye rest of ye Estate wch: it hath pleased God to bless me with all in this life I give & bequeath to be equally divided between my beloved Wife, DOROTHY GOULDMAN, & my Child or Children that my sd. Wife now is with child off;
      And of this my last Will & Testamt. I make my beloved Wife, DOROTHY GOULDMAN, and my loveing Brother, FRANCIS GOULDMAN, Exers. desireing Mr. THO: GREGSON that he will see this my last Will & Testamt. truely p:formed; & I do hereby utterly disallow revoke & annul all & every other former Testamt. Wills Legacies bequests &Exers, by me in any wise heretofore named willed & bequeathed ratifieing & confirming this & none other to be my last Will & Testamt., In Witness whereof I have hereunto set my hand & seale this Twenty second day of May in ye year of our Lord one thousand six hundred ninety & eight

      - FRA: GOULDMAN & EDWD. GOULDMAN, Admrs. of ROBT. GOULDMAN deced, complaines agt. PETER RANSONE & DOROTHY his Wife, Exrx. of THO: GOULDMAN deced. in a plea on ye Case for that whereas the sd THO: GOULDMAN in and by his Last Will & Testamt. bearing date ye 2d, day of May 1698, did amongst other things give & bequeath unto ye sd ROBT. GOULDMAN, one Servt. boy named Patrick, one feather bed and furniture, a sute of cloathes with Plate buttons, a Caster haft, a pair of leg boots, twelve shillings to buy a Ring & all ye goods at his Mothers, ye Molasses excepted, in these express woras following:
      item I give unto my Brother, ROBT, GOULDMAN, one Servt, boy named Patrick, one feather bed & furniture now at my Mothers, Mrs. ALICE FORBES, ye suit of cloathes wth: plate buttons, a caster hatt, a pair of leg boots, twelve shillings to buy him a ring, and all ye goods at my sd Mothers ye Molasses excepted all in ye sd last Will & Testamt duely prov'd in this Court & here in Court ready to be produced amongst diverse other things therein contained as more at large appears; Yet ye sd PETER RANSONE & DOROTHY his Wife, not regarding ye sd Last Will & Testamt. of the sd THO: GOULDMAN nor the true intent & meaning of ye same do altogether refuse to deliver the sd Servant boy and the other things abovemen coned to be bequeathed by ye sd THO: GOULDMAN to ye sd ROBT. GOULDMAN unto ye sd Plts., altho the sd Plts. by their admcon. granted by this Worpll. Court into ye Estate of ye sd ROBT. GOULDMAN became legally intituled unto ye above menconced Legacy given to ye sd ROBT. GOULDMAN by ye sd THO: GOULDMAN, Wherefore ye Pits, say they are damnified Five thousand pounds of tobo: for which they have directed this suite & pray Judgmt, together with ye abovesd, Legacy & cost of suite,, To wch; ye Defts, by WM, JONES their Attorney appear & pray oyer of ye Lres. of Admcon. under the hand and settle of ye Ordinary wth:out produceing which cause be ye Plts. cannot maintains their accon &of this pray the Courts Judgmt,, wch: is over ruled by ye Court for yt: ye Pits, have an Ordr, of this Court dated ye 12th day of April 1700 whereby they have admcon, granted them to ye Estate of ye sd ROBT. GOULDMAN deced, ordr: they conceived to be sufficient in Law for them to maintaine this Attach: & therefore pray as in their Declaracon; Whereupon ye Defts. by their sd Attorney in plea of abatement to ye justifying of Plts. Declaracon say that they haveing brought an accon of case & not declared in ye detinuet as ought to be, ye accon ought to abate & of this they pray ye Courts Judgmt., to which ye Plts. by THO: GREGSON, their Attorney, reply that in as much as they have declared that ye Defts. have altogether refused ye delivery of ye p:mises in question such refusall is a detainer in Law and therefore pray as in their Declaracon which Plea of abatement further say that in accordance with Comon Law lies not for a Legacy as ye Plts. have sett forth in their Declaracon but if ye same be due as alleadged by ye Plts. is sueably in the Court of Chancery & not at ye Comon Law & of this they pray ye Courts Judgmt., which plea is likewise overruled by Court; Wherefore the Defts. by their said Attorney for plea sayeth that the Legacy in the Plts, declaracon set forth was by order of the Court inventoryed & appraised as ye Estate of THO: GOULDMAN, ye Deft. & that ye Defts. are answerable to ye sd Inventory & if the Pit, should recover ye particulars in their Declaracon set forth ye Defts. will be twice punished for one &ye same things which the Law doth not allow of and of this they pray ye Courts Judgmt., to which the Plts, by their Attorney for replicatory say that the Courts ordering of ye Inventory & appraismt. of ye sd Estate is noe barr in Law to ye Plts, & therefore pray as in their Declaracon, which is so adjudged by ye Court and ye Defts, plea overruled, It is ordered that Jury enquire of ye damages (by name THOMAS RAMSEY, JNO. BRAISIER, WILLIAM WILLIAMS, THO; MUNDAY, EDMD. PAGETT, JAS: SPENCE, WILLIAM ARVIN, JOHN GRAVES, JOHN WILLIAMS, ROBT, HALSEY, JNO. BUTLER & RICHARD GOOD) who being first sworne vent forth & brought in this following verdict, Wee of the Jury doe find damage for ye Plts, 3000 pounds of tobo, which verdict is ordered to be recorded. Judgmt, is granted to ye Plts. agst. ye Defts. for ye sd 3000 pounds of tobo damage together with the sd Legacy to be paid with cost of suit als Exo., Now ye Defts. by their Attorney for plea an arrest of Judgmt, for that. the Plts. no right in Law have to ye Legacy sett forth in the Declaracon for that ROBT. GOULDMAN, ye Legatee of THO: GOULDMAN, was never possest of the sd Legacy & therefore ye Legacy reverts & becomes due to ye Defts., Exrs. &c. In Answr: to which the Plts, by their Attorney say that notwithstanding ye Legatee was never possessed wth: ye sd Legacy, ye Plts. have good right thereto which sd plea in arrest of Judgmt. is likewise over ruled by ye Court. Whereupon ye Defts. by their Attorney pray an appeale from ye sd Judgmt. to ye (faded) next Genll. COurt for a heareing before his Excellency ye Governr: & Councill, which is granted giveing security according to Law and by the Courts order (at the request of the Plts. & Defts. by their sd Attorneys) ye several pleas &c. aforesd. are recorded
