      IN THE NAME OF GOD AMEN I JOHN RUTHERFORD of St, Anns Parish in Essex County do make and ordain this my last Will and Testament in manner following (Vizt) I give unto my Daughter MARGARET WORTHAM all my land joining to THOMAS THORP's land being devided from the land I live on by a line of marked trees begining below Mr. VIVIONs MILL at a white oak then runing West to a marked white oake standing near the Road then with a line of marked trees to the pond to her and her heirs forever. I give unto my loving Wife MARY RUTHERFORD all my land next to WILLIAM WORTHAM land begining at VIVIONs MILL SWAMP where the old road crossed the Swamp and runing thence with the road to a Spanish Oak thence South West to a Saplin then with a line of marked trees to the head of the pond then with the pond to WORTHAMs Corner tree (the same being the land I now live on) during her natural' life and after her decease, I give the same to my Son JAMES RUTHERFORD & his heirs forever, And in case my Wife should marry my will is that my Son JAMES RUTHERFORD shall have the hole & sole property in the sd land, and my Wife not to injoy any part thereof. My Will is that my Son ROBERT RUTHERFORD shall when he attains the age of Eighteen years have the Liberty of working five years on the sd Land with one hand besides himself without paying for the same. I give unto my Son JOHN RUTHERFORD all my land Between the land I have & given my Son JAMES RUTHERFORD and THOMAS THORPs land which he brought of NANCE to him and his heirs for Ever. Turn Over and my Will is that my Son ROBERT RUTHERFORD be for himself when he attains the age of Eighteen years, And I also give him one Negro boy named Harry to be then delivered to him. My Will is that my Wife MARY RUTHERFORD have all my personal! Estate of what Nature or kind soever with one Negro man named JEGGREE, And likewise appoint my Loving Wife MARY RUTHERFORD Exx. and WILLIAM WORTHAM & my Son JOHN RUTHERFORD Executors of this my Last Will and Testament. In Testimony whereof I have hereunto set my hand and seal this 15th day of Janry 1742

      This Last Will and Testamt. of JOHN RUTHERFORD decd being presented in Court by MARY RUTHERFORD the Executx. therein named was proved by the Oath of JEREMIAH MITCHELL and EDWARD ROWZEE Witnesses thereto and the Codicil to the sd Will was proved by the Oath of ROBERT BROOKING, WILLIAM WORTHAM and JOHN RUTHERFORD JUNR. Witnesses thereto and then the said Will was admitted to record And on the motion of the sd MARY and her performing what the Law in such cases requires a Certificate was granted her for obtaining a probate thereof in due form, And then WILLIAM WORTHAM and JOHN RUTHERFORD JUNR. the other Executors in the sd Will named came into Court and refused to take upon them the burthen of the Execution thereof

      Unto Ann my beloved wife the devident of land where I now live and my personable estate so long as she shall remain a widow.
      Unto my grandson Nickalis Copeland the devident of land where I live after my Wife's decease. If he should dye without heirs, then unto my granddaughter Mary Brown. If she should dye without heirs to return to my grandson Charles Atkinson.
      Unto my grand daughter Mary Brown one hundred and seventy acres of land adjoyning to the land of James Boulware.
      After my wife's decease my personable estate shall be dividedinto three parts. One-third unto my grandson Nickolis Copland, One-third unto my granddaughter Mary Brown an the remainer to be equally divided amongst the rest of my grand children.

      TO ALL TO WHOME this present writing Indenture of Award shall come Greeting. Whereas divers differences, controversies & disputes have lately arisen and been likely to arise Between WILLIAM SHORT of the Pish of St. Anns in the County of Essex and JOHN RETTERFORD of ye Parish & County aforesd all which controversies & disputes are only or chiefly touching and concerning a tract of land devised by NICHOLAS COPELAND to MARY the Wife of the sd JOHN for One hundred and seventy acres of land which they sold to ye sd WILLIAM & touching a Negro Womn. call'd Phillis which ye sd WM, gave in part payment at the rate of £25 for the sd land & touching the sum of Three thousand three hundred and twenty pounds of Tobacco which was likewise to pay for the sd land & Whereas for the putting of an End to the sd Differences & disputes they the sd WM. SHORT & JOHN RETTERFORD by their several bonds or obligations bearing date the 21 day of July last past are reciprocally become bound each to ye other in the penal Sum of £50 to stand & abide by the award and final Determination of us ROBERT BROOKE & JAMES GARNETT both of the Pish & County aforesd so as the said award be made in writing and ready to be Delivered to the parties in Difference on or before the 10th day of this Instant as by ye sd obligations & Conditions thereof (relation thereto being had) may appear NOW KNOW Ye that we the sd Arbitrators whose names are here unto written & Seals put takeing uppon us the burthen of the sd Award A, having fully examined & duly Considered th proofs & alligations of both the sd parties do for the settling Amity & friendship between them, make & publish this our Award by & between ye sd parties in manner & form following (that is to say) Imprimis we do Award & order that all Suits Quarrels & Controversies wt:soever had moved arisen or depending between the sd Parties in Law or Equity for any manner of causes wt:soever touching ye sd premises from the beginning of the World untell the day of the date of the sd Bonds or Obligations shall cease & be no further presented & that each of the parties shall pay or bear their own costs & charges in any wise relating to or concerning the premises & for as much as it appears to us that the sd JOHN RETTERFORD Intended only to sell and make Sure unto the sd WILLIAM SHORT all that parcel of land Devised to MARY his Wife as aforesd which upon a resurvey is found to be no more than Ninety acres, It likewise appears to us by the Evidence of JANE HART, CHARLES HART & EDD. VAWTER that the sd Negro Phillis was Subject to Convultion fitts of which she soon after being Deliver'd to ye sd JOHN RUTHERFORD died by falling in the fire therefore of Doe value & for the Three thousand three hundred and twenty lb of Tobo the one half of wch is pd by the sd WILLIAM SHORT to the sd RETTERFORD we rate at 14/ pr: wch made
      £23...4s..9d added to yet £25 „ is £48...4...9 the prices of the suppose One hundred and seventy acres Ninety acres at that rate comes to £25...10...9d of which there is only £11„.12...4 paid the Ball: at that rate being One thousand nine hundred and ninety lb Tobo which we award & order the said WM. SHORT to pay to the sd JOHN RETTERFORD & Lastly We order & do award that upon paymt, of the sd Sum of One thousand nine hundred and ninety lb Tobo that the sd JNO. RUTHERFORD & WM. SHORT aforesd, in due form of Law, Execute each to othr: of them Or to the others use general releases Sufficient in ye Law for ye Release by each to ye othr: their Exrs: & Admrs: of all actions Quarrels Controversies & demands whatsoever touching ye premises aforesd, or any thing thereunto relating from ye begining of ye world untell ye 21st day of July last (the date of ye bonds of Arbitration). In Witness we have hereunto put our hands & Seals this 7th day of Augt. 1738
