      1762, 1December: Date of will of Hannah Upshaw, Essex Co, VA., recorded 20 June 1763).
      In the name of God, amen. I Hannah Upshaw of the County of Essex, being sick and weak of body but
      of perfect sense and memory, therefore calling to mind the uncertainty of this transitory life, do make
      and ordain this my last Will and Testament in manner and form following, viz - Imprimis - I give & bequeath unto my son John Upshaw all the tract of land and plantation whereon I
      now live to the division line made by Capt. James Wood between my two sons Jeremiah and Richard
      and my large copper still and worm, to him and his heirs forever.
      Item - I give to my said son John Upshaw and to his heirs forever the tract of land that belonged to my
      son Richard whereon he formerly lived with the Proviso that he my said son John doth pay unto my
      grandson Richard Hipkins the full value of the said land according to its valuation by three Gentlemen
      by them Elected and Chosen.
      And in the case my said son John should refuse to pay the valuation as aforesaid, that then I give the
      said tract of land to my said grandson Richard Hipkins & his heirs forever.
      Item - I give to my grandson Leroy Upshaw the tract of land I purchased of William Major, reserving
      part of the use thereof to work the Negros hereafter devised to his Brother and Sister until they arrive at
      the age of twenty one or marriage to him and heirs forever.
      Item - I give to my said grandson Leroy Upshaw one young negro lad named James and to my
      grandson John Upshaw one negro boy named Jeechey and to my grand daughter Milley Upshaw one
      young negro woman named Milley, and to each of them one cow and calf, one ewe and lamb and one
      sow and piggs (sic) and if either of them should die before they come of age or marry, his or their part to
      be divided between the survivors.
      Item - I give to my daughter Margarett Hipkins one negro woman named Hannah and to my grand
      daughter Mary Ann Roane one negro woman named Letty and to my grand daughter Martha Hipkins
      one negro girl named Sarah to geather (sic) with their future increase.
      Item - I give to my grand daughter Mary Upshaw one negro girl named Rachel and to my grand
      daughter Sarah Upshaw one negro girl named Beck.
      Item - I give all the residue of my estate of what nature soever to be divided into seven equal parts
      amongst the following persons Viz = the representatives of my daughter Hannah, and of my so
      Jeremiah, and of my daughter Ann, and my daughter Sarah, my son John and my daughter Margarett,
      and my grandson Thomas Cooper Dickerson.
      Item - As there is a suit in Chancery now depending in the General Court against the Executor of
      Richard Upshaw, Dec'd., and others, and as the event is uncertain, I desire my son John who is Executor
      of the said Richard Upshaw, be indemnified out of my estate, in case there should be any damage
      decreed against him in the said suit.
      And I constitute and appoint my son in law Samuel Hipkins, John Upshaw and Thomas Roane,
      Executors of this my last Will and Testament.
      In Testimony whereof I have hereunto set my hand and seal this first day of December 1762.

      To my son Jeremiah Upshaw the plantation that I now live on 350 acres of the lower part of the track.
      To my son Richard Upshaw remaner part
      To my son William Upshaw all my quarter land lying in the fork of Jelson's Swamp.
      To my son John Upshaw my plantation in Gloster
      To my eldest dafter Cordilia Hipkins three pounds paid in a store.
      To my dauter Susanna Brooking 25 shillings paid in a store.
      To my mother Cordilia Martin deuring her life three pounds a year credit in a store.
      All the rest of my estate to be equily divided between my loving wife and the children that I had by her.

      Children of Hannah Forrest Gardner and William Upshaw are:
      1. i. Jeramiah Upshaw was born 1704 in "White Hall" King & Queen Co. VA, and died ABT 1746 in "White Hall" King & Queen Co. VA.
      ii. Hannah Upshaw was born 1706, and died BEF 1765.
      iii. Ann Upshaw was born 1708, and died ABT 1749.
      iv. Sarah Upshaw was born 1710 in Gloucester Co. VA, and died 1760 in "Bloomburg" near Rexburg, Essex Co. VA. She married William Roane, son of Charles Roane and Frances. He was born 1713 in Grenshaw, Ireland, and died 1757 in "Bloomsbury" near Rexburg, Essex Co. VA.
      v. Richard Upshaw was born 1712, and died 1755.
      vi. William Upshaw Jr. was born 1713, and died 1760 in Essex Co. VA.
      vii. John Upshaw was born 21 Jul 1715, and died 23 Jul 1801 in "White Hall" King & Queen Co. VA. He married Mary Lafon BEF 1766 in King & Queen Co. VA, daughter of Nicolas Lafon and Elizabeth Streshley. She was born 1744 in Essex Co. VA, and died 1809.
      viii. Margaret Upshaw was born 1716, and died ABT Feb 1769 in Essex Co. VA. She married Samuel Hipkins, son of John Hipkins. He died in Essex Co. VA.
      ix. Forrest Upshaw was born 1718, and died ABT 1759 in Essex Co. VA.

      THIS INDENTURE made the Sixteenth:seventeenth day of July 1722 Between ROBERT SMITH of Parish of St. Maries in County of Essex Gent. of one part and HANNAH UPSHAW of Parish of Southfarnham in County aforesaid Widdow Witnesseth that said Robert Smith for sum of ffifty five pounds Sterling to him paid doth grant unto said Hannah Upshaw her heirs forever all that tract of land where PASCHAL GREENHIL lately dwelt lying in the Parish of South Farnham containing 300 acres & upwards, Excepting only what land grant FRANCIS SHACKLEFORD & SARAH his Wife sold out of the same tract of land unto JOHN MOODY by Deed bearing date the Tenth of March 1703 bounded Beginning at a stake between two hickories Corner to Mr. THOMAS TODDs land & running thence North West to a white oak by a Branch of Hoskins Creek thence South crossing it to a great white oak thence South to the land of JOHN BRUSHWOOD to a stake by a red oak by his line North East to the place it began the said land lying between the Main Swamp of Pascataway & Hoskin's Creek but touches nor buts on Neither of the said & is part of 5100 acres of land granted to Mr. HENRY AWBERY by Patent dated the 19th of March one thousand seven hundred & seventy seven (Release) one thousand six hundred & seventy seven (Lease)

      THE CONDITION of the above Obligation is such that Whereas this day in Essex County Court in an action of Debt brought by the abovenamed Hannah Upshaw Plt. against Wm, Todd & Wm. Brooke Defts: the sd Defts: were cast & upon motion had an appeal granted to the 8th day of ye next Genll. Court giving security according to Law. If therefore the sd appellants shall accordingly appear & presente ye said appeal at ye next Genll, Court & shall stand & abide the award and Judgment of the sd Court and pay the damage of fifteen per Cent wch the Law gives if cast in such an appeal that then this Obligation to be Void otherwise to stand

      THIS INDENTURE made the fifteenth day of September in the Second year of the Reign of our Sovereign Lord GEORGE the Second, and in the year of our Lord one thousand seven hundred & Twenty Nine Between HANNAH UPSHAW of the Parish of South farnham in the County of Essex of one part and JEREMIAH UPSHAW of the Parish and County aforesd of other part Witnesseth that said HANNAH UPSHAW for the sum of Tenn pounds Sterling hath sold unto said JEREMIAH UPSHAW his heirs and assigns forever all that Plantation and tract of land where now sd JEREMIAH UPSHAW Dwelleth being in the Parish of South farnham in the County of Essex containing Two hundred and Twenty acres of land which sd land the sd HANNAH UPSHAW purchased of ROBERT SMITH by Indentures of Bargain and Sale relation being had to the record where it doth appear And is bounded beginning where a Stake formerly stood between the Hickorys corner of THOMAS TODDs land & comeing thence North West to a white Oak by a Branch of HOSKINSES CREEK thence South West to the sd Branch and crossing it to a great white Oak, thence North West to a red Oak on a hill, thence South West to a Stone and a white Oak marked by it thence South East to the land which was formerly one JOHN BRUSHWOODs to a Stake by a red Oak, thence by his line North East to a white Oak, a chesnut Oak in a Branch thence South East to the land of the sd TODD to a stake by a redd Oak, and lastly thence by his line North East to the place it begun the said land lying between the MAIN SWAMPS of PISCATAWAY & HOSKINSES CREEKS but touchetts nor butts on neither of the sd main Swamps and all houses Tobacco houses and appurtenances wtsoever belonging To Have and To Hold the said Tract of land & all premises hereby granted unto the sd JEREMIAH UPSHAW his heirs and assigns.       At a Court held for Essex County at Tappa. on the XXIst day of November MDCCXXXVIII Thomas Graves acknowledged this Indenture to be his act and deed which is admitted to record.
      And at a Court held for Essex County at Tappa, on the 111th day June MDCCXXXIX ELIZABETH GRAVES Wife of the within named Thomas Graves came into Court and relinquished her right of Dower which is admitted to record.
      KNOW ALL MEN by these presents that I Thomas Graves am firmly bound unto Hannah Sthreshly in the sum of Fifty pounds Currt. money of Virga. this 29th day of Augst 1738. The Condition of this obligation is such that if Thos. Graves shall at all times go into open Court wth his Wife Eliz. and make and acknowledg to Hannah Sthreshly such a pare of Deeds of Lease and Release then this obligation to be void otherwise to stand in full force.

      THIS INDENTURE made the Twenty first day of June in year of our Lord one thousand seven hundred and Forty eight Between HANNAH UPSHAW of Parish of Southfarnham in County of Essex of one part and JOHN UPSHAW, Son of said HANNAH, of the same Parish and County of other part; Witnesseth that whereas I the said HANNAH UPSHAW for divers good causes and considerations as well as good affection me hereunto moving by these presents do give and confirm unto JOHN UP-SHAW one certain tract of land containing by estimation one hundred acres (be the same more or less) lying in County of Essex and part of the tract I now dwell on bounded Beginning at a small redd Oak in RENNOLDS Line by the side of my Old Field, runing thence South two degrees East one hundred and forty two poles across the Plantation to the Main Road, thence along down the said Road eighty two poles to the line at STHRESHLEYs Old Field, thence North eighteen degrees East along the old Line seventy eight poles to a corner white Oak by a Branch, thence down the Branch its several! courses one hundred and thirty four poles to a large white Oak (RENNOLDS corner), thence North seventy five degrees West with said RENNOLDS Line eighty poles to the beginning; and the profitts of said one hundred acres of land; To have and to hold of me said HANNAH UPSHAW unto JOHN UPSHAW & to his heirs from henceforth, of which I said HANNAH UPSHAW have put said JOHN UPSHAW in full & peaceable possession some years past & by virtue hereof do confirm the same; In Witness whereof I have hereunto set my hand and seal the day and year first above written

      THIS INDENTURE made this 21st day of June in the Twenty second year of the Reign of our Sovereign Lord George the second by the grace of God of Great Britain France and Ireland, King Defender of the faith &c., and in the year of our Lord one thousand seven hundred & forty eight; Between HANNAH UPSHAW of Parish of Southfarnham in County of Essex of one part and FOREST UPSHAW, Son of said HANNAH, of same Parish and County of other part; Witnesseth that whereas I the said HANNAH UPSHAW for divers good causes and considerations as well as good affection me hereunto moving by these presents do give & confirm unto FOREST UPSHAW, one certain tract of land which land I purchased of WILLIAM MAJOR, containing by estimation One hundred & fifty five acres, (be the same more or less) lying in County of Essex and bounded, Begining at an Ash in HOSKINS's SWAMP standing in MERIWETHERs line and runing thence down the said Swamp the severall courses & meanders of the Run to a Poplar in said Swamp (GATEWOODs Line), thence North forty three degrees East one hundred & twenty eight poles to a small red Oak sapling in RICHARD UPSHAW s line thence North thirty two degrees West eighty three poles to a white Oak and two red Oake saplings (RENNOLDS corner) thence North eighteen degrees East one hundred & forty six poles to a small Hickory in RENNOLDS line, thence North thirty six degrees West forty two poles to a small Sassafras & Hickory in COLEMANs Line, thence South forty three degrees West fifty one poles to a small crooked Hickory and white Oak in COLE-MANs Line, thence South two degrees East seventeen poles to a Stake nigh a great red Oak, thence South forty three degrees West one hundred and sixty five poles to the beginning; To have and to hold the said One hundred and fifty five acres of land of me said HANNAH UPSHAW unto FOREST UPSHAW and to his heirs from henceforth of which premises I said HANNAH UPSHAW have put the said FOREST UPSHAW in full & peaceable possession some years past and by virtue hereof do confirm the same; In Witness whereof I said HANNAH UPSHAW have hereunto set my hand and seal the day and yeare first above written

      TO ALL XPIAN PEOPLE to whome these presents shall come, Know ye that Whereas my Daughter, ANN DAVIS, Widow, hath bargained and sold to me one 294 Negro girl named Frank with her future increase in consideration of the sum of Five pounds thirteen Shils. & three pence Sterl., by Bills of Excha: drawn payable on JONATHAN FORWARD Merch t„ in LONDON, Now its the true intent and meaning of the said parties to the said Sale that if ANN DAVIS at any time hereafter refund or repay me my heirs the sd, sum of five pounds thirteen shillings & three pence Sterl.. with interest & charges of Protest if the sd.
